I am curious about the arrangement the Town has with the State regarding any agreement between these parties for the continual occupation of State land by this utility crossing. I will be writing you in the future to discover more about this but at this time I am only requesting to inspect a single record related to the matter I have described above. I request to inspect the Bill of Sale for the pipe lying under the ICW. If there is no record of a Bill of Sale then please produce the record of its disposition. Now you ask, "Ifyou have more, I request to inspect them." The record we produced is part of a larger file. If you want us to produce that file, it will take approximately one hour of administrative support at $37.34 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (One hour @ $37.34) = Deposit Due: $37.34 in cash or check. Upon receipt of your deposit, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time. If we do not hear back from you within 30 days of this letter, we will consider this request closed. Instead I received a record titled CONTINUATION SHEET containing itemized values for various phases of a project. When I wrote you two weeks ago and asked, "Is this the onlypublic record you have that you consider responsive to my request? V you have more, I request to inspect them." I was trying to be polite. What I meant to communicate by this statement was, '7 do not think this record is responsive to my request, please produce the responsive record." I apologize that my follow up was not more clear but I thought that my original request was sufficiently clear. As I stated in my original request, I want a single record. That record is the Bill of Sale for the pipe Nine under the ICW. As a courtesy to you and in order to help you find the record I request to inspect I offer the following clarification of certain phrases used in my request: Bill of Sale means a record that is a "Bill of Sale" and constitutes a binding agreement for the transfer of ownership and/or interest in property and/or rights of use. pine means the entire pipeline including easements. Nine under the ICW means already lying (at least partially) on or beneath the bottom of the Intracoastal Waterway In order to further clarify the description of the record I request to inspect, I tell you that I anticipate the record will contain the phrase BILL OF SALE and the transaction will include granting the Town use of the pipe and easements associated with the pipe. Please let me know how much money you want in order to produce this single record rather then the entire file you propose to produce for $37.34. I respectfully ask that you please do not produce any more records in response to this request that are not identified as a Bill of Sale. May I hear from you soon?
