Dear Custodian of Records, I am interested in discovering and inspecting any information I can find in the Town's public records about the Town using the Waters of the State. By Waters of the State I mean any water within the Town's boundaries that the State of Florida and the Town recognize to be Waters of the State. I will be writing you again in the future to discover more about this but at this time I am only requesting to inspect one record related to the matter I have described above. I understand from comments at public meetings that the Town discharges stormwater into polo cove. I also understand the Town has been granted utility easements from property owners for this purpose. I request to inspect any survey of a pipe located in a Town owned easement which is intended to provide storm water discharge into Polo Cove. I understand from your response that you do not believe you have a public record of "a survey of a pipe" located in a Town owned easement intended for the discharge of storm water into Polo Cove. You have asked me to clarify exactly what I am seeking in my request. I have already explained to you that I am interested in discovering and inspecting any information I can find about the Town using the Waters of the State. In this instance I am requesting public records of any survey that identifies a utility easement and includes any pipe into Polo Cove. To further clarify my request I am specifically looking for any public record of any survey that includes a utility easement and identifies a pipe located within that easement which pipe projects into Polo Cove. I hope this clarification enables you to determine what record I seek to inspect. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. It has already been over two months since I requested this record. Based on this understanding, the Town estimates that to respond to your request will require approximately two hours of administrative support at $37.34 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (Two hours @ $37.34) = Deposit Due: $74.68 in cash or check.
