TO: PLANNING COMMISSION FROM: Kenrick Karefa-Johnson, Interim Director Community Development Department SUBJECT: ZONE CHANGE - CASE NO. 3(ZC31 Applicant: Mahandra Patel PROPOSAL The applicant is requesting a Zone Change from CB-1 (Controlled Business) zone to C-2A (Medium Commercial) zone, in order to develop a 49 unit motel on parcels approximately one (1.2) and two tenth acres in size, at the southwest carner of Mulford Avenue and Long Beach Boulevard. FACTS The proposed rezoning area is located seventy five (75) feet north of Mulford Avenue between Long Beach Boulevard and Plaza Street and south of Mulford Avenue to the I-105 Century Freeway, between Long Beach Boulevard and Court Street (see attached location map). The area is approximately 93,789 square feet, or two (2.2) and two tenths acres in size. The eastern half of the area (the shaded area on the location map) is vacant (and slated for motel development). The western half of the area is developed with city facilities. Adjacent and to the north of the area is a major shopping center (Lynwood Town Center) and Lynwood School District facilities. To the east of the area are commercial/retail uses; and, to the south, the I-105 Century Freeway. ' ISSUES AND ANALYSIS The present zoning classification (CB-1) prohibits motel uses in the subject area. Also, the current zoning would not carry out , the goals and policies of the draft General Plan for the area as intended. The proposed zone change would allow construction of the proposed motel and more effectively carry out the goals and policies of the draft General Plan. The proposed motel will be a two (2) story, forty nine (49) unit complex approximately 55, 158 square feet in size and will be developed on the eastern portion of the subject property. The proposal includes a lobby, managers's quarters, conference room, swimming pool and spa, and seventy four (74) parking spaces. The proposed project is desiqned to have a minimum of seven (7�) percent landscaping. disk74:zc3 1 " , � � The draft General Plan recommends, that plans be developed that encourage new patterns of land uses which complement the overall character of existing uses and offer opportunities for compatible development of vacant and underutilized parcels (Land Use Goal: 4). The Plan, also, calls for the promotion of land uses that capitalize on the opportunities of the City�s adjacency to major transportation systems (Land IIse Goal: 6). Policies of the Plan also, recommend that commercial retail uses adjacent to the Lynwood Town Center be intensified to take advantage of existing land uses and make use of new patterns of accessibility provided by the Century Freeway ( I-105 ). The proposed rezoning would allow for motel development that would complement and attain these goals. ENVIRONMENTAL ASSESSMENT: Pursuant to Section 15073 of the State CEQA Guidelines, as amended, a Negative Declaration has been prepared. It has been determined that the project could not have a significant effect on the environment based upon the completion of the Initial Study and Environmental Checklist, which has found that there are no significant impacts resulting from the project. RECOMMENDATION: Staff respectfully requests that after consideration, the Planning Commission adopt the attached Resolution No. 2345: 1. Recommend that the City Council certify the Negative Declaration as adequate. 2. Adopt Resolution No. 2345 recommending City Council adoption oning Change, Case No. 3. WHEREAS, the�Lynwood Planning Commission, pursuant to law, conducted a public hearing on a proposed zone change for certain properties as described above; and WHEREAS, the Commission reports the legal publication was made in the Lynwood Press (Wave), that notice to property owners was mailed, and notice of hearing was posted, all as required by ordinance and in the time required by law; and WHEREAS, the subject site located in the CB-1 (Controlled Business) zone will be changed to C-2A (Medium Commercial) zone. NOW, THEREFORE, the Planning Commission of the City of Lynwood does hereby find, determine, and resolve as follows: Section 1. The Commission recommends a change of zone from CB-1 to C-2A for the properties, as designated in the ordinance and map attached hereto, marked Exhibit A, based on the following findings: A. The current CB-1 (Controlled Business) zone of the subject area is inadequate to carry out the intent of the goals and policies of the draft General Plan. B. The subject area would accommodate proposed development due to its size, location, and proximity to the Lynwood Town Center and the Century Freeway. C. A zone change of C-2A (Medium Commercial) would be consistent with the draft General Plan designation of Commercial. � disk74:zc3 3 . , � � D. The proposed zone change will not be detrimental to the properties surrounding the subject area. Section 2. Pursuant to the terms and provisions of the State CEQA Guidelines, as amended, Section 15073, the Director of Community Development caused a Negative Declaration to be prepared, and the Commission recommends that the City Council certify said Negative Declaration. Section 3. Chapfer 25 of the Lynwood Municipal Code and the Zoning Map of the City of Lynwood are hereby amended to reclassify certain real property described as per attached map. Section 2. Amendment of the Lynwood Zoning Map, as per attached map draft is consistent with the draft General Plan of ' the City of Lynwood. � Section 3. SEVERABILITY. If any section, subsection, subdivision, sentence, clause, phrase,'or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the "decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions. of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. ' BACKGROUND• At its regularly scheduled meeting of June 12 , the City Planning Commission approved Resolution No. 2340, recommending that the City Council adopt the proposed Draft General Plan. ' The City Council held its first public hearing on the General Plan at its regularly scheduled meeting of July 3. ' At the July 17 meetinq, the City Council requested a workshop to thoroughly review the plan and comment on its consistency with Council objectives. The Draft General Plan is currently being reviewed by the City Council, and is scheduled for adoption August 7. ISSUES AND ANALYSIS: The next step in the work program is to complete the process of the Draft Environmental Impact Report. No action can be taken on the General Plan, until the Environmental Report has been _ reviewed by the Council and public testimony is taken. The 45 day public review period for the EIR concluded on July 30. The Planning Commission should recommend adoption to the City Council, at which time, the Council will hold a public hearing on the matter and consider adoption of both the EIR and General Plan. The final step will be the revision of the City's Zoning Map and code. Mr. Mahandra Patel, 10216 Long Beach Boulevard, Lynwood, rose to explain that his project will be a franchise of the Travelodge motel chain. It has been written in the DDA contract that, should he suffer problems during construction and have to drop out, the property will revert to the Travelodge chain and the project will continue. There is simply too much money involved, he stated. There being no one else wishing to speak for or against the project, Chairperson Dove closed the Public Hearing. Mr. Fenderson introduced Mr. Morales, who read pertinent information and informed the Commissioners that the Resolution should be changed: Under No. 2, the word "adoption" should be replaced with "certification." Chairperson Dove opened the Public Hearing. Mr. Terry Hayes, of Terry A. Hayes Associates, 100 Corporate Pointe, Suite 105, Culver City, 90230, rose to discuss the "Draft Environmental Impact Report, City of Lynwood General Plan (1990 Revision)". He explained that a probable projection of Lynwood's population is an increase of 35,000 people. Lynwood is already deficient in park areas and he foresees problems with transportation and_the circulation element. If present trends continue, he sees a down-zoning of multiple family apartment buildings and an increase in both single family dwellings and commercial properties. The Army Corps of Engineers has decided that in a 100-year flood, a large portion of Lynwood will be under 1-3' of water. There being no one wishing to speak in favor of, or in opposition to the EIR, Chairperson Dove closed the Public Aearing. Both Chairperson Dove and Commissioner Haynes complimented Mr. Aayes on his excellent report.
