Please let me know if you would like me to do so. Dear Mr. Thrasher: I know that you had met with Tom Laudani recently to discuss the existing five foot wide drainage easement between Lots 6 & 7 (aka. 3180 and 3140 Polo Drive, respectively) on the west side of Polo Drive within the Town. In speaking with Tom, I understand that you are seeking clarification or input from me as to the feasibility of relocating this existing drainage easement. The subject easement was established by virtue of the original plat for these lots which was recorded back in 1955. 1 have attached this document for your records. The plat documents were a little less specific back then than they are today —the plat simply indicates that the easement is for "drainage purposes only." However, it can safely be assumed that this easement was intended for the future drainage of the Polo Drive roadway improvements into the Intracoastal, if needed. The plat shows the existence of a similar easement on the next block to the south, as well. It is important to note that my physical inspection of the property did not reveal any drainage improvements within this easement. There is no drainage inlet within the right-of-way for Polo Drive in alignment with this easement, nor was I able to detect any pipe penetrating through the seawall in line with this easement on the Intracoastal side. Additionally, topo information was obtained by our surveyor and revealed that the areas of the easement is essentially a highpoint within Polo Drive and that this roadway slopes away from the easement to the north and to the south. Accordingly, there is no low point in the street in proximity to this existing easement that would be a logical collection point for a drainage structure. Therefore, by all appearances, there really is no need to keep this easement in place. However, I had recommended to Mr. Laudani that if he would like to abandon this existing easement, he should offer the Town a replacement drainage easement on his lot line on the south side of Lot 7. This way, if the Town ever feels that they have the need to install drainage improvements along Polo Drive in the future, they have not relinquished their ability to make a piped connection to the Intracoastal in this location. Please refer to the attached plat, as it shows the location of the proposal replacement easement. Moreover, the replacement easement will be 10 feet wide (as opposed to the existing five-foot wide easement), so the Town is not just made whole in terms of the replacement easement, they will actually be in a much better position to construct and maintain a drainage pipe in this location if needed, as a five-foot easement is really not sufficient width to construct or maintain an underground pipe.
