A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM, PALM BEACH COUNTY, FLORIDA,
VACATING AND ABANDONINGAPORTION OF THE RIGHT-
OF-WAY COMMONLY KNOWN AS MIDDLE ROAD AS
SHOWN ON THE PLAT OF GULF STREAM COVE, AS
RECORDED IN PLAT BOOK 24, PAGE 185, PUBLIC RECORDS
OF PALMBEACHCOUNTY,FLORIDA, AND DEDICATINGAN
ALTERNATE RIGHT-OF-WAY
WHEREAS, the owners of the lands abutting the properties hereinafter described have
petitioned the Town to abandon and vacate a portion of the right-of-way commonly known as
Middle Road, over and across the lands more fully hereinafter described; and
WHEREAS, the Town Commission of the Town of Gulf Stream does hereby find and
determine that the necessity for that portion of the said right-of-way is no longer necessary for use
as a right-of-way, nor is it necessary for public use, as long as the alternate right-of-way described
herein is dedicated as a public right-of-way.

I propose that the parties who are divesting themselves of any right they may have to the abandoned
road right-of-way execute a quit claim deed for that portion of the property to which they might have
some claim. The quit claim deed would pass to the property owners underlying parcels 3 and 4 as
shown on your sketch.
In order to complete the quit claim deed, I will need the legal descriptions of parcels 1 and 2 as
identified on your sketch which are the parcels to be abandoned.

336.046 Regulation of bus benches and transit
shelters within rights-of-way.—Any bus bench or tran-
sit shelter located on a sidewalk within the rights-of-way
of any road on the county road system shall be located
so as to leave at least 36 inches clearance for pedestri-
ans and persons in wheelchairs. Such clearance shall
be measured in a direction perpendicular to the
centedine of the road.

336.048 Temporary closing traveling lane of road.
Whenever any road on the county road or city street
system is repaired, reconstructed, or otherwise altered
in a manner that necessitates the closing of one or
more traveling lanes of the road for a period of time
exceeding 2 hours, the party performing such work
shall give notice to the appropriate local law enforce-
ment agency within whose jurisdiction such road is
located prior to commencing work on the project. How-
ever, when the closing of one or more lanes is required
because of emergency conditions, such notice shall be
waived.

336.05 Naming of county roads; recording.—
(1) The commissioners are authorized to name and
rename streets and roads, except state roads desig-
nated by number by the department, lying outside the
boundaries of any incorporated municipality.
(2) The commissioners are authorized to refuse to
approve for recording in accordance with chapter 177
any map or plat of a subdivision when recording of such
plat would result in duplication of names of streets or
roads or when such plat, in the opinion of the commis-
sioners, will not provide adequate and safe access or
drainage.

336.08 Relocation or change of roads.—The com-
missioners may establish, locate, change, or discon-
tinue public county roads by resolution.

336.09 Closing and abandonment of roads;
authority.—
(1) The commissioners, with respect to property
under their control may in their own discretion, and of
their own motion, or upon the request of any agency of
the state, or of the federal government, or upon petition
of any person or persons, are hereby authorized and
empowered to:
(a) Vacate, abandon, discontinue and close any
existing public or private street, alleyway, road, high.
way, or other place used for travel, or any portion
thereof, other than a state or federal highway, and to
renounce and disclaim any right of the county and the
public in and to any land in connection therewith;
(b) Renounce and disclaim any right of the county
and the public in and to any land, or interest therein,
acquired by purchase, gift, devise, dedication or pre.
scription for street, alleyway, road or highway pur.
poses, other than lands acquired for state and federal
highway; and
(c) Renounce and disclaim any right of the county
and the public in and to land, other than land constitut-
ing, or acquired for, a stale or federal highway, delin-
eated on any recorded map or plat as a street, alley-

(2) The commissioners, upon such motion,
request, or petition, may adopt a resolution declaring
that at a definite time and place a public hearing will be
held to consider the advisability of exercising the
authority granted in this section.

336.10 Closing and abandonment of roads; publi-
cation of notice.—Before any such road shall be
closed and vacated, or before any right or interest of
the county or public in any land delineated on any rec-
orded map or plat as a road shall be renounced and dis-
claimed, the commissioners shall hold a public hearing,
and shall publish notice thereof, one time, in a newspa-
per of general circulation in such county at least 2
weeks prior to the date staled therein for such hearing.
After such public hearing, any action of the commis-
sioners, as herein authorized, shall be evidenced by a
resolution duly adopted and entered upon the minutes
of the commissioners. The request of any agency of the
state, or of the United Stales, or of any person, to the
commissioners to take such action shall be in writing
and shall be spread upon the minutes of the commis-
sioners; provided, however, that the commissioners of
their own motion and discretion, may take action for the
purposes hereof. Notice of the adoption of such a reso-
lution by the commissioners shall be published one
time, within 30 days following its adoption, in one issue
of a newspaper of general circulation published in the
county. The proof of publication of notice of public hear-
ing, the resolution as adopted, and the proof of publica-
tion of the notice of the adoption of such resolution shall
be recorded in the deed records of the county.

In regard to the abandonment we discussed, I am forwarding a form which could be used as an
application for abandonment by the two property owners who seek the abandonment and who will
dedicate land back to the Town. I do not know if you have exacted a fee for such an abandonment
in the past or whether you would require one in this instance, so I have not included that requirement
in the application. You will note thatthe legal description should be included in the application so
we will need to have the property surveyed, said survey to include the property to be abandoned as
well as the property that will be deeded back to the Town. At item 7 of the application, I have listed
only BellSouth and Florida Power and Light. You will have to provide me with the names of any
other utilities in the area.
I have also enclosed a forret for a notice of public hearing relating to the abandonment. This notice
should be published at least two weeks prior to the hearing. In the event the property is abandoned
at the public hearing, the Town Commission would then pass a resolution vacating and abandoning
the property upon stipulation that the property needed for the cul-de-sac would be deeded back to
the Town- The property owners would then have to sign a separate instrument deeding that property
which the Town needs for the cul-de-sac back to the Town.
