HomeMy Public PortalAbout20070116REGULAR COUNCIL MEETING JANUARY 16, 2007 1 CALL TO ORDER The Regular Council Meeting of January 16, 2007, was convened at 6:00 P.M. by Mayor John Landwehr. Prayer was offered by Councilman Mike Harvey, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Berry, Crane, Ferguson, Harvey, Klindt, Layton, Oetting, Pope, and Vogel Absent: Brown A quorum was declared present. Mayor John Landwehr stated that Staff has asked that the Council consider amending the agenda to add Bill 2006 -127, and asked City Administrator Steve Rasmussen and Pat Sullivan to come forward to present this information. MISCELLAN EOUS AGENDA ITEMS City Administrator Steve Rasmussen and Community Development Director Pat Sullivan explained that staff is requesting that an emergency supplemental appropriation bill be added to tonight's agenda to fund the purchase of street chemicals and salt. He stated that the recent ice and snow storms experienced in the city have reduced the city's chemical and salt supply to levels that would place the city in a very bad situation if another storm occurred. He indicated that a motion of the Council will need to be approved in order to add this item to the agenda. A motion was made by Councilman Michael Berry to add Bill 2006 -127 to the agenda under Bills Introduced, seconded by Councilman Cindy Layton, and approved unanimously. Councilman Michael Berry asked if suspension of the rules would be beneficial. Mr. Sullivan stated that staff had not intended to ask for suspension of the rules, but if Council decided to do that on its own, any uncertainty about the issue would then be eliminated. MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr announced that the following minutes and reports have been REGULAR COUNCIL MEETING JANUARY 16, 2007 2 received and are on file and may be reviewed in the City Clerk's office: a. Transportation & Traffic Commission, November 9, 2006 b. Board of Electrical Examiners and Review, April 12, 2006 c. Housing Authority Board of Commissioners, November 29, 2006 d. CAMPO Technical Committee special meeting, November 21, 2006 e. Public Safety Committee, December 12, 2006 f. Human Relations Commission, December 12, 2006 g. Historic Preservation Commission, December 12, 2006 Mayor John Landwehr thanked the numerous members of these boards and commissions for giving of their valuable time and expertise for the betterment of the City of Jefferson. COUNCIL LIAISON REPORTS The following reports were made from Council members who are liaisons to boards and commissions, or Chairmen of Council committees: Finance Committee - Vice - Chairman Bryan Pope gave a brief update in the absence Chairman Kevin Brown. He stated that staff is putting together material to hold a meeting to discuss supplemental appropriations, but that no date has been set for the meeting yet. Public Works & Planning Committee - Report given by Chairman Michael Berry, who announced another meeting will be held January 18 at 7:30 A.M. He stated there will also be a Storm Water Users Group meeting on January 17. Administration Committee - Report given by Chairman Brian Crane, who stated that the committee met last week to discuss, among other things, the issue temporary food establishments. He also reported on the status of an RFP which will be issued for composting. The next meeting will be January 23 at 7:45 A.M. Mayor John Landwehr requested that Chairman Crane add to his January 23 agenda the topic of annexation. Public Safety Committee - Report given by Vice - Chairman Dan Klindt in the absence of Chairman Kevin Brown. Councilman Klindt stated that a meeting was held January 9, and that a bill is currently being discussed regarding issue of assaulting police and emergency personnel; approval of the MUSTANG appropriation, as well as several other topics. ANNOUNCEMENTS OF OTHER UPCOMING MEETING AND EVENTS Community Director Pat Sullivan announced the Storm Water Users Group meeting at 7:30 A.M. on January 31 in the Boone - Bancroft Room. He also announced that an Open House for the public will be held on January 29 beginning at 5:30 P.M. in the City Council Chambers to discuss proposed amendments to the Storm Water code. REGULAR COUNCIL MEETING JANUARY 16, 2007 3 APPOINTMENTS BY THE MAYOR Mayor Landwehr then recommended the following appointments for Council approval: Convention & Visitors Bureau Board: a. RENEW (2nd Term) - Lisa Steiner, term expires 12 -2009 b. APPOINT - Brian Allen (to replace Joe LoMonaco), term expires 12 -2007 c. APPOINT - Chris Hackman & Nathan Cook, terms expire 12 -2009 A motion was made by Councilman Kenneth Ferguson for approval of the appointment as presented, seconded by Councilman Brian Crane, and approved unanimously PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS Mr. Vic Puri, Vinca Enterprises, Inc., made a brief presentation to show the Council and public the artist's rendition of what the Hotel LaBella property will look like when their project is completed. He stated their company is asking for an easement along the south side of the property to allow them to dig down and reinforce the footings, and that the company will then replace the sidewalks which they will need to dig up. He stated that there are currently three -foot sidewalks, and they plan to replace those with five -foot sidewalks. Mr. Kent Trimble made a presentation regarding a proclamation honoring the late Willis Porter Corwin, a resident of Jefferson City who participated in an historic radio relay event during WWI. He invited the public to attend events commemorating that event and Mr. Corwin's life and contribution to Jefferson City on January 27 at 10:00 A.M., 11:00 A.M., and 2:00 P.M. Following his presentation, Mayor John Landwehr presented Mr. Trimble with a proclamation proclaiming January 27 as Willis Porter Corwin Day in Jefferson City. Fire Chief Robert Rennick reported to the Council that the city is cooperating with other communities who are still suffering from the severe ice storms recently occurring in the state. He stated several city personnel are on site in the Springfield area, and that the city will also be sending one of its fire trucks to help as well. PRESENTATIONS FROM THE GALLERY Mr. Leonard Steinman made a presentation to thank the staff of the City of Jefferson for the exemplary job they did in cleaning streets following the last two major storm events. He compared it to the City of Columbia and stated Jefferson City should be very proud of the way it has performed following these storms. REGULAR COUNCIL MEETING JANUARY 16, 2007 4 COUNCIL COMMENTS IN RESPONSE TO PRESENTATIONS FROM THE GALLERY Councilman Dan Klindt asked who is responsible to clean sidewalks following ice and snow storms. City Counselor Nathan Nickolaus answered that the City Code stated it is the property owners' responsibility to keep their sidewalks clean. CONSENT AGENDA The following items were brought before the Council for approval by Consent at this time. a. Minutes of December 29, 2006, and January 2, 2007 City Council Meetings A motion was made by Councilman Cindy Layton to approve all items on the Consent Agenda as presented, seconded by Councilman Dan Klindt, and approved unanimously. BILLS INTRODUCED Bill 2006 -123, sponsored by Councilman Oetting, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 18 (MISCELLANEOUS PROVISIONS AND OFFENSES) BY ENACTING SECTION 18 -230 CREATING THE OFFENSE OF INTERFERING WITH THE DELIVERY OF POSTAL SERVICE TO A MAILBOX. Bill 2006 -124, sponsored by Councilman Berry, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A MASTER LEASE WITH MISSOURI OFFICE OF ADMINISTRATION FOR PARKING. Councilman Edith Vogel asked if the state can sublease its parking spaces at a higher rate. City Counselor Nathan Nickolaus stated he will check into that and get the answer back to the Council before it votes on this bill. Bill 2006 -125, sponsored by Councilmen Vogel and Oetting, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING THE PETITION PROPOSING THE CREATION OF THE SOUTHSIDE MUNICHBURG COMMUNITY IMPROVEMENT DISTRICT. REGULAR COUNCIL MEETING JANUARY 16, 2007 5 Council asked staff if the date for the public hearing will need to be confirmed before this bill is voted on. Mayor John Landwehr asked staff to check into that and get the answer back to Council before the next Council meeting. Bill 2006 -126, sponsored by Councilman Berry, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DEVELOPMENT AGREEMENT WITH VINCA ENTERPRISES, INC. Bill 2006 -127, sponsored by Councilman Pope, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE 2006 -2007 BUDGET OF THE CITY OF JEFFERSON, MISSOURI BY APPROPRIATING ADDITIONAL FUNDS WITHIN THE GENERAL FUND. A motion was made by Councilman Mike Harvey, seconded by Councilman Kenneth Ferguson, to suspend the rules on Bill 2006 -127 so that staff can order the needed supplies immediately. Councilman Brian Crane stated that staff has told the Council it did not believe the rules needed to be suspended, so he would be voting no on suspending the rules for that reason. The motion was then approved with Councilman Brian Crane voting "Nay." The rules will be suspended. Councilman Berry requested that Bill 2006 -107 remain on the Informal Calendar. REGULAR COUNCIL MEETING JANUARY 16, 2007 7 Bill 2006 -108, sponsored by Councilmen Berry, Ferguson, and Harvey, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING THE NAME OF CITY VIEW DRIVE TO McCARTY STREET AND ESTABLISHING THE NAME OF THE NEW ROADWAY TO EXTEND SOUTH OF THE INTERCHANGE AT U.S. HIGHWAY 50/63 AND WHAT IS NOW CITY VIEW DRIVE TO McCARTY STREET. Councilman Harvey requested that Bill 2006 -108 remain on the Informal Calendar at this time. Bill 2006 -114, sponsored by Councilmen Klindt and Harvey, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 8, ARTICLE VI (BUILDINGS AND BUILDING REGULATIONS, FLOOD HAZARD REGULATIONS) AND CHAPTER 31 (STORMWATER MANAGEMENT), OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY REPEALING THE PRESENT SECTION 8, ARTICLE VI AND SECTION 31 ENACTING A NEW CHAPTER 31 IN LIEU THEREOF. Councilmen Mike Harvey and Dan Klindt requested that Bill 2006 -114 remain on the Informal Calendar at this time. RESOLUTIONS RS2006 -26: Endorsing Plan for Permanent Location of I.T. Department, sponsored by Councilman Ferguson Councilman Brian Crane stated that he wants staff to keep the Council informed of this project as it proceeds so they can see if the costs are within the proposed amounts. A motion was made by Councilman Kenneth Ferguson for adoption of the resolution, seconded by Councilman Bryan Pope, and approved unanimously. SCHEDULED REPORTS No reports were scheduled to be made at this time. NEW BUSINESS No New Business was brought forward at this time. APPROVAL OF CLOSED SESSION MINUTES January 2, 2007, closed session: Mayor John Landwehr stated he has some technical questions about the minutes and has requested that approval be deferred until the next Council meeting. GO INTO CLOSED SESSION Mayor John Landwehr stated that, Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion to go into Closed Session to discuss the following: a.
