Bock,CLERK & Co))PTROLLER Pga 1995 - 19%; Qpgs) RESOLUTION NO. 14-16 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, VACATING AND ABANDONING A DRAINAGE EASEMENT WITHIN THE NORTH 5 FEET OF LOT 7 AS SHOWN ON THE PLAT OF GULF STREAM COVE, AS RECORDED IN PLAT BOOK 24, PAGE 185, PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA (`LOT 7"), AND ACCEPTING AN ALTERNATE DRAINAGE EASEMENT WITHIN THE SOUTH 10' OF LOT 7 WHEREAS, the owner of Lot 7 petitioned the Town to abandon and vacate a five (5) foot drainage easement over and across the north five (5) feet of Lot 7; and WHEREAS, the Town Commission of the Town of Gulf Stream does hereby find and determine that the necessity for that five (5) foot drainage easement is no longer necessary as it was never actually used as a drainage easement, nor is it necessary for public use, as long as the alternate drainage easement described herein is dedicated as a public drainage easement. NOW THEREFORE BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows: That five (5) foot drainage easement, as shown on the Plat of Gulf Stream Cove, more particularly described as follows, to -wit: PROPOSED ABANDONMENT OF DRAINAGE EASEMENT WITHIN THE NORTH FIVE (5) FEET OF LOT 7, PLAT OF GULF STREAM COVE, IN THE TOWN OF GULF STREAM, FLORIDA, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 24, PAGE 185, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, be and the same is hereby vacated and abandoned. In substitution for the five (5) foot drainage easement, herein abandoned, there is hereby accepted by the Town a new ten (10) foot drainage easement on the following described property: THE SOUTH TEN (10) FEET OF LOT 7, GULF STREAM COVE, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 24, PAGE 185 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. (1) The commissioners, with respect to property un- der their control may in their own discretion, and of their own motion, or upon the request of any agency of the stale, or of the federal government, or upon petition of any person or persons, are hereby authorized and em- powered to: (a) Vacate, abandon, discontinue and close any ex- isting public or private street, alleyway, road, highway, or other place used for travel, or any portion thereof, oth- er than a state or federal highway, and to renounce and disclaim any right of the county and the public in and to any land in connection therewith; (b) Renounce and disclaim any right of the county and the public in and to any land, or interest therein, ac- quired by purchase, gift, devise, dedication or prescrip- tion for street, alleyway, road or highway purposes, oth- er than lands acquired for state and federal highway; and (c) Renounce and disclaim any right of the county and the public in and to land, other than land constitut- ing, or acquired for, a state or federal highway, delineat- ed on any recorded map or plat as a street, alleyway, road or highway. H19tM. 9.49. tlh. 29965. 1955, 336.10 Closing and abandonment of roads; publi- cation of notice.—Before any such road shall be closed and vacated, or before any right or interest of the county or public in any land delineated on any recorded map or plat as a road shall be renounced and disclaimed, the commissioners shall hold a public hearing, and she publish notice thereof, one time, in a newspaper of gen- eral circulation in such county at least 2 weeks prior to the date stated therein for such hearing. After such pub- lic hearing, any action of the commissioners, as herein authorized, shall be evidenced by a resolution duly adopted and entered upon the minutes of the commis- sioners. The request of any agency of the state, or of the United States, or of any person, to the commissioners to take such action shall be in writing and shall be spread upon the minutes of the commissioners; provid- ed, however, that the commissioners of their own motion and discretion, may take action for the purposes hereof. Notice of the adoption of such a resolution by the com- missioners shall be published one time, within 30 days following its adoption, in one issue of a newspaper of general circulation published in the county. The proof of Publication of notice of public hearing, the resolution as adopted, and the proof of publication of the notice of the adoption of such resolution shall be recorded in the deed records of the county. High". -9.50, M. 29965. 1955. 336.11 Closing and abandonment of roads; ratifi- cation of prior actions.—The actions by the commis- sioners, heretofore taken, closing, vacating, or abandon- ing any road as herein described, and appearing in the minutes of such commissioners, are hereby ratified, ap- proved and confirmed in all respects, and such roads are declared closed, vacated and abandoned, consist- ent with the provisions of the resolution or other action of such commissioners, as shown by their minutes. HIMMY. 9. 51, r . 29965. 1955. 336.12 Closing and abandonment of roads; termi- nation of easement; conveyance of fee.—The act of any commissioners in closing or abandoning any such road, or in renouncing or disclaiming any rights in any land delineated on any recorded map as a road, shall ab- rogate the easement theretofore owned, held, claimed or used by or on behalf of the public and the title of fee owners shall be freed and released therefrom; and if the fee of road space has been vested in the county, same will be thereby surrendered and will vest in the abutting fee owners to the extent and in the same manner as in case of termination of an easement for road purposes. MIM—9. 52. ch. 29965, 1955. 336.41 Counties; employing labor and providing road equipment; definitions.— (1) The commissioners may employ labor and pro- vide equipment as may be necessary, except as provid- ed in subsection (3), for constructing and opening of new roads or bridges and repair and maintenance of any existing roads and bridges. (2) It shall be the duty of all persons to whom the commissioners deliver equipment and supplies for road and bridge purposes to make a strict accounting of the same to the commissioners. (3) All construction and reconstruction of roads and bridges, including resurfacing, full scale mineral seal coating, and major bridge and bridge system repairs, to be performed utilizing the proceeds of the 80 -percent portion of the surplus of the constitutional gas tax shall be let to contract to the lowest responsible bidder by competitive bid, except for: (a) Construction and maintenance in emergency sit- uations, and (b) In addition to emergency work, construction and reconstruction, including resurfacing, mineral seal coat- ing, and bridge repairs, having a total cumulative annual value not to exceed 5 percent of its 60 -percent portion of the constitutional as tax or $250,000, whichever is greater, for which the county may utilize its own forces. However, if, after proper advertising, no bids are received by a county for a specific project, the county may use its own forces to construct the project, notwithstanding the limi- tation of this subsection. Nothing in this section shall prevent the county from performing routine mainte- nance as authorized by law. OF COUNSEL Please place on the agenda of the next Town Council Meeting the matter of the Abandonment of the 15 foot right-of-way known as "Palm Way" as shown on the Plat of Gulf Stream Properties No. 2 in Plat Book 19, Page 42 Public Records of Palm Beach County. The right-of-way known as "Palm Way" was used as a means for ingress and egress between the old polo barns and the original polo fields. Since its discontinued use, the right-of-way has been assessed and taxed as part of the lots adjacent to the right-of-way. Enclosed is a copy of the survey of Lot 55 including the portion of Palm Way and copies of 1988 and 1989 tax statements for Lot 55 and East 112 of Palm Way. Mr. Iglehart said he felt the Town Commission had a strong obligation to the Town and its residents to look ahead to providing water to the Town in the future realizing that the water contract with the Club will expire in 1969. He felt the Town should prepare now for future sources of water and thought the Town should locate land west of the Intra -coastal waterway for use as well fields and purchase it now or secure options on land suitable for use as a water supply. In the event other water sourses can be obtained in 1969 he felt the Town could always dispose of the land at no loss. Mr. Iglehart moved that a committee be set up to locate suitable land for use as a water supply. Motion passed unanimously. Mayor Dodson appointed Mr. Iglehart, Mr. Hart and Mr. William Koch to the committee. Further discussion of the Water Improvments Report were tabled. The Police Reports were read and approved. A street light survey, prepared by Fla. Power and Light Co. was presented to the Commission. The Commission authorized the installation of 17 new 2500 Lumen street lights as recommended. Their recommendations for increased lighting power along Ai.A was not accepted. This would have cost gp202.50 a year More and the Commission felt that the lighting was adaquate for the Towns needs. Mayor Dodson appointed a committee of Mr. Koch, Mr. Gwynn and himself to negoiate a new Fire Contract withthe City of Boynton Beach. The present contract is to expire IHay 182 1964. A request from Mr. John Thomas for a building permit to be issued prior to April 1, 1964 was denied. A request from Mr. Henry Pope for a building permit to be issued prior to April 1, 1964 was denied. The Commission also instructed Mr. Gwynn to not issue a permit for Lot 55 Gulf Stream Prop #2 until Mr. Pope can furnish proof of ownership of 10,000 sq. ft. of building site as required by the Town Zoning ordinance. The Commission did however waive the requirements of ordinance #123 which would require the building be set back 781 from the centerline of AIA, since in the case of lot 55 Gulf Stream Properties #2 it would render the lot useless for a building site, which was not the intent of this ordinance. Kathleen Kirton, Messrs Lilienthal, Cowart, Gwynn, Byron Webster and Henry Mayor Dodson called the meeting to order. The minutes of the meeting held April 11, 1964 were read approved and adopted. The Financial Report for April, 1964 was read and approved. All expenditures included in this report were approved. Mr. Byron Webster explained the serious drainage problem that existed on Middle Road and the flooding that occurs after each rain. He presented a proposal from Hardrives, Inc. to install two catch basins and drainage pipe. Subject to obtaining an easement through Mr. George Walkers property. The Commission indicated their concern over this matter but it was Town's position not to finance drainage projedts. The Commission suggested that Mr. Webster discuss this matter with Mr. Hoyle, since he and other property owners on Palm Way had solved that drainage problem among themselves. A resolution from the Bethesda Memorial Hospital urging the con- struction of Interstate Road #95 be started as soon as possible was read to the Commission. It was moved seconded and passed that the Town accept the terms of a nea three year fire contract with tke City of Boynton Beach and authorized Mayor Dodson to sign said contract for the Town. In addition to the terms included in the old contract which ex- ires May 1$2 1961 it called for annual payments of $3,000.002 13250.00 and $3,500.00. The police reports were read and approved. Mr. Pope requested that a permit be issued for him to construct a swimming pool, partially within the setback area of his property on Alk and Banyan Road. Mr. Gwynn pointed out that the ordinances were net clear on this paint and that there would be no enclosure over the pool and also it was Mr. Pope's plans to erect a wall around this portion of his property. Mr. Gwynn further stated that it seems the intent of the ordinance is to allow for an adequate supply of light and air to adjacent properties and the swimming pool itself would not work contrary to this intent. The commission authorized Mr. Gwynn to issue the permit. Mr. Hart informed the Commission that the Club was going to hire a watchman for the summer months for additional protection to the CLUB buildings and grounds. The Resolution will require the insertion of the appropriate legal description. Also, for your information I have enclosed a copy of the state statute regarding abandonment of county roads. Since we do not have a procedure far abandonment, I believe it would be appropriate to follow the requirements of this statute. A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, VACATING AND ABANDONING A CERTAIN FIFTEEN FOOT RIGHT-OF-WAY ON THE PLAT OF GULF STREAM PROPERTIES NO. 2, AS RECORDED IN PLAT BOOK 19, PAGE 42, PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, the owners of the lands abutting the property hereinafter described have petitioned the Town to abandon and vacate that certain fifteen foot (151) right-of-way, commonly known as Palm Way, located over and across the land more fully hereinafter described; and WHEREAS, said right-of-way has never been paved and has never been used by the public; and WHEREAS, the Town Commission of the Town of Gulf Stream does hereby find and determine that the necessity for the fifteen foot right-of-way located on the following described property does not serve any public purpose and is not necessary for public use; NOW THEREFORE BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows: That that certain right-of-way, commonly known as Palm Way, as shown on the Plat of Gulf Stream Properties No. 2, more particularly described as follows, to -wit: be and the same is hereby vacated and abandoned. 1 The Town Clerk is hereby authorized to advertise and record this Resolution pursuant to law.
