Dear Custodian of Records, I am interested in discovering and inspecting any information about the Town's policy of allowing property owners to place things in the Town's right-of-way (that area of land located between a private property and the edge of pavement of a Town road. If the policy is different for the rights-of-way on some roads rather than others I would like to know about that too. Please produce for my inspection the portion of any written policy of the Town that includes provisions that permit (or ever permitted) property owners to install objects in the Town's right-of-way. Further, please note that pursuant to the public records laws, the duty of the Town of Gulf Stream is to provide access to, or copies of, public records at a reasonable time under reasonable conditions. The Town is not required to give out information from these records nor give information about these records. In an attempt to comply with your broad and vague request in good faith, the Town has inquired of staff and reviewed the Town’s Construction Site Management Handbook. It seems simple enough. It certainly does not seem broad or vague as you have described it. I refer you to that request by reference. By way of clarification I offer the same request with the part you find insufficiently specific crossed out. I hope the deletion of the phrase "the portion of from the request makes it sufficiently particular for you to produce responsive records. Please produce for my inspection the pertien of any written policy of the Town that includes provisions that permit (or ever permitted) property owners to install objects in the Town's right-of-way. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. I hereby reserve all rights granted to me under the Florida Constitution and Florida Statutes.
