� A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
i OF LYNWOOD APPROVING A CONDITIONAL USE PERMIT TO
j CONSTRUCT FOUR (4) APARTMENT UNITS AND A FOUR-CAR
GARAGE IN THE R-3 (MULTI-FAMILY RESIDENTIAL) ZONE,
� 11126 DUNCAN AVENUE, LYNWOOD, CALIFORNIA
�
i WHEREAS, the Lynwood Planning Commission, pursuant to law,
� conducted a public hearing on subject application for a
; Conditional Use Permit;
' WHEREAS, the Planning Commission has carefully considered
` all pertinent testimony offered at the public hearing;
;
, WHEREAS,. a Conditional Use Permit is required for
development in the R-3 (Multi-family Residential) zone.
� Section 1. The Planning Commission hereby finds and
determines as follows:
� A. The site of the proposed use is adequate in size and
� shape to accommodate the structures, parking, walls,
landscaping, driveways and other development features
� required by the Zoning Ordinance.

+ B. The granting of the proposed conditional use permit
+ will not adversely affect the General Plan.
j: C. The structures as proposed, or modified, subject to
} conditions imposed, will not have a negative effect
; on the values of surrounding properties or interfere
± with or endanger the public health, safety or welfare.
i
� D. The site will be developed pursuant to the current
I zoning regulations and site plan submitted as reviewed
� and approved by the Site Plan Review Committee.
�
j E. The proposed development will add favorably to the
{ � housing stock in concert with the policies of. ths
; Housing Element to the General Plan.
,� .
j F. The proposed development will aid in aesthetically up-
grading the area and will act as a catalyst in
� fostering other quality developments.
: Section 2. The Planning Commission of the City of
[ Lynwood, based upon the aforementioned findings and
I �; determinations, hereby approves Conditional .Use Permit No.
'� 86090, provided the following conditions are observed and
��' complied with at all times:

�. 1. All requirements of all City departments shall be met.
� 2. All City of Lyrwood Municipal Municipal Code requirements
shall be met.
3. Ten (10) off-street parking spaces shall be.required; one-
half of the parking spaces shall be covered. The minimum
dimensions shall be lOft. x 20 ft., while the turning radius
� may not be less than 25 ft.

4. A minimum twenty-five (25°s) percent of the lot area shall be
1 landscaped and an automatic irrigation system shall be
installed.

� 5. A landscape plan shall be submitted prior to issuance of
' building permits for approval by the Planning Division.
! Landscaping shall include trees, shrubs and ground cover.
� Trees should be fifteen (15) gallon minimum, shrubs shall
� be five (5) gallon minimum.

i
E 6. No principal building on the site shall exceed a height of
j thirty-five (35') feet; no accessory building sha11 exceed a
; height of fifteen (15') feet.
7. A six (6') foot high masonry wall shall be provided along
; the perimeter of the project site, except within the twenty
� foot (20') front yard. In this frontage, the wall shall not
' exceed a height of 4 ft.,, measures from top of curb or 3
' ft., on the driveway side, if said driveway is adjacent to
the next property's driveway.
8. The addresses of the apartments shall be submitted to the
� Planning Division prior to occupancy.
9. Apartment numbers shall be a minimum of four (4) inches in
; height and shall be contrasting in color to the background.
1 10. The applicant, or his representative, shall sign a Statement
't of Acceptance stating that he has read, understands, and
� agrees to the conditions of this resolution within fifteen
� (15) days of the date of approval of said resolution.
;
� 11. The existing two-car garage shall be demolished.
'� 12. The parki.ng area shall have sufficient illumination for
� security.
; 13. In order to provide for a more recreational use of the
open space, a tot play apparatus of creative design shall
� be installed to the satisfaction of the Planning Division.
i 14. A ten (10') ft. distance between the existing single
i family dwelling and the proposed two-car garage shall be
� provided.
� BUILDING DIVISION
� 15. Provide grading plan showing parkway drains (soils report
I� is necessary if design is less than 1,000 lbs. sq. ft. soil
�; bearing pressure and if any fill is brought in to meet
�: grading requirements).

�� 16. Submit plans for plan check after obtainment of zoning
I � clearance from the Planning Division. Plans must show
� laundry and trash facilities, all windows, doors and rooms,
,. electrical and plumbing fixtures, notes to show concrete
�: strength, designed handrail and treads, roofinq materials,
general framinq and insulation, and venting. Al1 stamped
� and signed by Licensed Architect or Engineer.

� 17. State Energy Analysis required, Title 24.
i 18. Obtain County Sanitation permit (774-1733).
` 19.' For any utilities, water, gas electrical, verify easements
f with telephone, gas, Edison and water companies.

� 20. Provide approved (U.L. and State Fire Marshall) smoke
detector for each unit.

23. where security gates are installed on premises, the locking
mechanism shall be of the type that does not require a key
or any special knowledge to exit premises. Also, provide a
' Knox Box at front of property.
PUBLIC WORKS DEPARTMENT
' 24. Provide a grading plan signed by a registered Civil
' Engineer. No grading or building permits will be issued
until the grading plan has been approved by the Public Works
Department.
�. 25. Reconstruct damaged sidewalk per City Standards.
, 26. Construct curb and gutter and required adjacent asphaltic
, concrete pavement alonq Duncan Avenue.
27. Reconstruct damaged drive approach per City standards.
� 28. Construct two (2) wheelchair ramps at northeast and
� southeast corners of Duncan Avenue and Elmwood Avenue.
� 29. Remove overgrown parkway tree located in fron`_ of the
• property.
30. Plant one (1) parkway tree. Species, size and location to be
determined by Department of Public Works.
� 31. Underground all utilities.

32. Connect to public sewer. Provide a separate lateral for new
building.
Section 3. The Community Development Department has
determined that the proposed project will not have an adverse
effect on the environment; and a Negative Declaration has been
prepared and is hereby determined to be adequate.
Section 4. A copy of this resolution shall be delivered
to the applicant.

� � This is an application for a Conditional Use Permit for the
operation of tire sales and service, and automobile sales to be
conducted at 10327 Long Beach Blvd.
� Facts
j 1. Location: The subject property is on the west side of Long ,
°'r Beach Blvd between Cherokee and Sequora Avenues.

' 2. Lot Size The site is rectangular in shape with a total area
; of 9997.5 sq. ft.
3. Existing Land Use: The subject property is zoned C-3
{ (Heavy Commercial). The property is currently not in use.
� Former land use was a food store with a parking lot on front
; and rear side of the property. ,

,� 4. Proposal: The applicant proposes to utilize an exisiting
structure with minor alterations for use as storage room,
,� and automobile sales. There.will be no automobile
repairing service permitted on the premises.
I 5. Parking: Seven (7) parking spaces (one (1) for handicapped
parking) will be required on site for parking of
'3 employee/customer vehicles. On site parking of vehicles ,
� for sale must be in striped spaces with clear access
, aisles a minimum of ten (10) feet in width.
� 6. Landscaping: Five percent (5$) of the total lot area
� shall be improved with well maintained landscaping as

1� while the zoning classification is C-3 (Heavy Commercial).
�� Thus the General Plan designation, zoning classification

� 2. The proposed use meets the requirements for front, side
�6�, and rear yard setbacks, lot coverage, height of structures,
� minimum building size and location.

� 3. Other,issue's considered are related to the requirements
� of the Zoning Ordinance.

� A RESOLUTION OF THE PLANNING COMMISSION OF THE
� CITY OF LYNWOOD APPROVING A.CONDITIONAL USE
PERMIT FOR AUTOMOBILE SALES AND TIRES SALES
! AND SERVICE AT 10327 LONG BEACH BOULEVARD.

> WHEREAS, the Planning Commission of the City of Lynwood,
� pursuant to law conducted a public hearing on subject application
; for a Conditional Use Permit; and
�
,� WHEREAS, the Planning Commission has carefully
'; considered all pertinent testimony offered at the public hearing;
i and
WHEREAS, a Conditional Use Permit is required for an
3 automobile sales and tires sales and service business in the
' Commercial Zones.
� Section 1. The Planning Commission hereby finds and
; determines as follows:

'; A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parking, walls,
} landscaping, driveways and other development features
� required by the Zoninq Ordinance.
; B_ _..The grantinq of the proposed Conditional Use Permit
! will not adversely affect the General Plan.

{' C. .The .autbmotive use, as proposed, subject to
� conditions imposed, will not have a negative effect
� on the values of surrounding properties or interfere
� with or endanger the public health, safety, or welfare.
� D. The site will be developed pursuant to the current
� zoning regulations and site plan submitted as
'i reviewed and approved by the Planning Division.

' E. The site is served by streets adeguate in width and
; improved as necessary to carry the kind and quantity

Section 2 . The Planning Commission of the City of

CONDITIONS OF APPROVAL
1. All conditions of the State Map Act and the City's

Deposit $50 with City Engineer to guarantee receipt by City
of recorded, reproducible mylar, parcel map prior to
recordation.
All special assessments and utilities or sewer connection
fees are to be paid.prior to recording the final map. All
requirements fo the serving utilities to be met or guarantee
prior to recoi•ding of the final map.
4. Public Improv_ements:
The developer shall install all public improvements, as
required by the Director of Public Works/City Engineer prior
to issuance of any occupancy permits for this development.
Public improvements shall include, but not be limited to:
Construction of sidewalk, curb and gutter, cross gutters,
pavement, drive approaches, undergrounding of utilities,
relocating of ail existing insta�llations and facilities that
are in conflict with the proposed development. These items
include, but are not limited to: Street lights with
underground services and utilities,,fire hydrants, traffic
signals, traffic signal controllers, catch basins, storm
drains, manholes, valves, meters, pull boxes, etc.� (all
existing installations shall be upgrading to City standards,
i.e., replace existing wooden or steel light poles with �
marbelite poles)�constructing tree wells with cast iron covers �
and planting trees, construction of planters to separate �
vehicular traffic from sidewalk area.' All changes and repairs j
in existing curbs, gutters, and sidewalks and other public �
improvements shall be paid for by the developer. If
improvements are to be guaranteed, a faithful performance bond i
shall be posted by the developer to guarantee installation of
said public improvements and an agreement for completion of
improvements with the City Council shall be entered into. �
Submit Policy of Insurance or bond protecting City against i
damage or injury to persons or property growing out•of, related �
to, or resulting from improvements or work. The Di.rector of �

Public Works/City Engineer will determine amount and form.
Deposit with the Director of Public Works/City Engineer before j
commencing any improvements, a sum estimated by the Director of ,
Public Works/City Engineer to cover cost of inspection of ali

S. Grading And Draining
A grading plan shall be submitted for the approval of the
Director of Public Works/City Engineer and the Director of
Community Development. The grading plan shall include the .
topography of all contiguous properties and streets and shall
provide for the methods of drainage in accordance with all
applicable City standards. Retaining walls and other
` protective measures may be required. Offsite drainage
easements may be necessary.
The structural section of all parking areas shall be
designed by a civil engineer based upon soils analysis
supplied by a recognized and approved soils engineering
firm. The structural section shall be approved by the
Director of Public Works/City Engineer. In the event that
the design is not provided, the minimum structural section
that will be approved by the Director of Public Works/City ,
Engineer would be 2 inches of asphalt on 4 inches on
untreated rock base.
, Submit to this office a Geologic/Soils Report signed by a
Registered Soils Engineer.
6. Sewers and Water Systems_
In conjunction with the proposed plan for the subject I
development, City is conducting an analysis to determine the
impact of this development on the existing facilities, and to �
determine alterations of -.the'Present facilities that will be !
required as a result of this development. The developer shall
pay for the study, any required design, construction and , '
administration of new sewer system and water system as �
determined per studies, and as determined by the Director of
Pubiic Works/City Engineer.

All conditions of the Lynwood Fire Department must be met '
prior to recordation. '
7. Public Easements and Right=Of=Way: i
Where drainage, sewer and other such easements are required, ,
the minimum easement width shall be ten (10) feet to j
facilitate maintenance unless otherwise approved by the
Director of Public Works/City Engineer. The cost of all �
improvements and relocations as required by Utility companies �
per their study of tract map shall be paid-by the Developer. i

Dedicate a twenty five (25) foot wide strip of property along
Long Beach Soulevard from Sanborn Avenue to most southerly
property line; dedicate sufficient property at the northwest
corner of Long Beach Boulevard and Beechwood Avenue for
installation of a bus turnout.
8. Street Impro_vement Plans
Prepare and submit street improvement plans for streets for
streets to be widened and for the installation of bus
turnaround at Long Beach Boulevard and Beechwood Aver.ue.
9. Sidewalks:
Design, configuration and i'ocations shall be subject to the
approval of the Director of Public Works/City &ngineer, and
the Director of Community Development. Ramps for physically
handicapped persons shall be provided both on-site and off-
site as required by. State and local regulations.
10. Dust Control and Pedestrian Safety:
Prior to the issuance of demolition or grading permits, the
developer shall:
a. Submit a plan indicating safety methods to be provided
to maintain safe pedestrian ways around all areas of
- construction. This may require proper and adequate
signs, fences, barricades, or other approved control
devices as required by the Director of Public Works/
City Engineer and the Director of Community Development.

Applicant, H.A. Taylor Awning Co.
PROPOSAL
This is an application for a Variance to allow the construction
of an enclosed patio to encroach two (2) feet into the side yard
set back on the south side of the property at 11200 Harris Avenue
in the R-1 (single family residential) zone.
FACTS
1. Location: The subject property is a corner lot located south
of Beechwood Avenue and east of Harris Avenue.
2. Lot Area: The lot is rectangular in shape with a total area
of approximately 6,250 square feet.
3. The General Plan designation for the site is Single family
residential and the zoning classification is R-1 (single
family residential).
4. Existing Land Use: The subject property is presently used
for a single family residence. '
5. Environmental: The proposal is categorically exempt from
CEQA requirements as amended, Section 15061 (6) (3), I
6. Side yard set back requirement for the R-1 zone is 5 feet. �
7. Proposed improvement will encroach two (2) feet into the '
sideyard setback.

S. Field inspection revealed that at least sevem (7) properties I
in the same zone and in the area adjacent to said site have
a side yard set back less than five (5) feet. i
ISSUES & ANALYSIS: i

2. The strict or literal interpretation and enforcement of the �

applicant of privileqes enjoyed by the owners on other
properties in the same area and zone. i
3 Grantinq of the Variance will not be detrimental to the ,
public health, safety or welfare, or materially injurious to '
properties or improvements in the vicinity. �

specified regulations may result in practical difficulty or I
unnecessary physical hardship inconsistent with the

A RESOLUTION OF THE CITY OF LYNWOOD GRANTING A
VARIANCE OF THE R-1 ZONING DISTRICTS SIDE YARD
SETBACK FOR PROPERTY DESCRIBED AS LOT 10, TRACT
9337, COMMONLY KNOWN AS 11200 HARRIS AVENUE,
LYNWOOD.
' WHEREAS, the Planning Commission of the City of
Lynwood, pursuant to law, did, on January 13, 1987, hold a public
hearing on the subject application;
wHEREAS, the Commission has carefully considered
all pertinent testimony offered in the case at the Public
hearing;
WHEREAS, it has been determined that the project is
cateqorically exempt from the provisions of CEQA;
Section 1: The Planning Commission hereby
determines as follows:
A. The strict or literal interpretation and
enforcement of , the side yard setback
requirement for the R-1 Zoning District would
result in practical difficulty or unnecessary �
physical hardship inconsistent with the ;
objectives of the"2oning Ordinance; i
B. There are exceptional or extraordinary
i
circumstances or conditions applicable to the �
subject property which.do not apply generally �
to other properties in the R-1 Zone; i
C. The strict or literal interpretation and �
enforcement of the side yard setback �
requirement for the R-1 Zoning District would I
deprive the applicant of priviledges enjoyed �
by the owners of the other properties in the '
vicinity and zoned R-1. �
D. The granting of the Variance will not �
constitute the granting of a special priviledge
inconsistent with the limitations on other
properties..in the vicinity which are classified I

E. The granting of the Variance will not be I
detrimental to the public health, safety, or i
welfare, or will not be materially injurious to
properties or improvemments in the vicinity; �
The qranting of the Variance will not adversely �
affect the orderly development of the City. (
Section 2: The Planning Commission of the City ?
of Lynwood hereby approves a variance of the R-1 �
Zoning District sideyard set back requirement. �
This variance applies to the construction of an I
enclosed Patio which will encroach two feet into
the required side yard setback for a linear i
distance of seventeen (17) feet.
Section 3: A copy of this resolution shall be �
delive'red to the applicant �

WHEREAS, the Planning Commission of the City of Lynwood,
pursuant to law, conducted a public hearing on the subject
application;
WHEREAS, the Planning Commission has carefully considered
all pertinent testimony offered in the case as presented at the
public hearinq;
WHEREAS, the Community Development Department has determined
that the proposed project is categorically exempt from the
provisions of the State CEQA Guidelines, as amended, Section i
15061 (b) (3).
Section 1. The Planning Commission does hereby find and �
determine that said Tentative Parcel Map No. 18408 should be �

A. The combination of lots meets all the applicable I
requirements and conditions imposed by the State I
Subdivision Map Act and the Subdivision Regulations �
of the Lynwood Municipal Code. I
B. The proposed combination of lots is consistent with �
the applicable elements of the General Plan and the I
Official Zoning Ordinance of the City of Lynwood. �

C. Proper and reasonable provisions have been made for i
adequate ingress and egress to the lots being ;
combined. �
I
D. Proper and adequate provisions have been made for all �
public utilities and public services,including �
sewers. I
Section 2. The Planning Commission of the City of Lynwood i
hereby approves Tentative Parcel Map No. 18408 in the C-2A
(Medium Commercial) zone, subject to the following conditions: i
PLANNING DIVISION ,

1. Within twenty-four (29) months after approval or conditional I
approval of the Tentative Parcel Map, the subdivider shall ;
file with the City of Lynwood, a final parcel map in '
substantial conformance with the Tentative Parcel Map as �
approved or conditionally approved, and in conformance with '
the Subdivision Map Act and the Subdivision Regulations of �
the City of Lynwood.

2. Prior to the expiration of the tentative parcel map, the
subdivider may file an application with the Community
Development Department for Planning Commission action on an
extension of the expiration period.
3. The final parcel map shall be filed with the City Engineer
of the City of Lynwood.
PUBLIC WORKS DEPARTMENT
4. Submitted Tentative Parcel Map does not include minimum
requirements. Resubmit Tentative Parcel Map and show
existing and proposed property lines, show all required
dedication as set per Site Plan Review Committee, show
existing structures, utilities, etc., located in public
� right-of-way and include proposed improvements such as new

drive approaches, etc..
5. All conditions of the State Map Act and the City's
Subdivision Ordinance must be met prior to recordation.
All matters and improvements shall be consistent with the
ordinances, standards, and ,procedures of the City's
Development Standards, and Planting Standards of the
Department of Parks and Recreation.
The developer is responsible for checkinq with staff for j

existing street light pole on Tenaya Avenue and replacing it
with a marbelite street light pole with un3erground conduit
and services. Construct tree wells with cast iron covers
and plant street trees and applicant shall pay for
relocation cost of traffic signal pole at southeast corner
of Long Beach Boulevard and Tenaya Avenue. All changes and
. repairs in existing curbs, gutters, and sidewalks and other
public improvements shall be paid for by the developer. If
improvements are to be guaranteed, a faithful performance
bond shall be posted by the developer to guarantee
installation of said public improvements and an agreement
for completion of improvements with the City Council shall
be entered into. Submit Policy of Insurance or bond
protecting City against damage or injury to persons or
property growing out of, related to, or resulting from
improvements or work. The Director of Public Works/City
Engineer will determine amount and form. Deposit with the
Director of Public Works/City Engineer before commencing any
improvements, a sum estimated by the Director of Public
Works/City Engineer to cover cost of inspection of all
improvements under his jurisdiction.
9. Gradina and Draininct:
A grading plan shall be submitted for the approval of the
Director of Public Works/City Engineer and the D$ector of
Community Development. The grading plan shall include the
topography of all contiguous properties and streets and
shall provide for the methods of drainage in accordance with
all applicable City standards. Retaining walls and other
protective measures may be required. Offsite drainage
easements may be necessary. �

The structural section of all parking areas shall be � !
designed by a civil engineer based upon soils analysis I
� supplied by a recognized and approved soils engineering
firm. The structural section shall be approved by the
Director of Public Works/City Engineer. In the event that �
the design is not provided, the minimum structural section ;
that will be approved by the Director of Public Works/City
Engineer would be two (2) inches of asphalt on four (4) �
inches of untreated rock base. �

Submit to this office a Geologic/SOils Report signed by a �

The developer shall construct a water system including water '
services, fire hydrants and appurtenances throuqh the �
development as required by the Director of Public Works/City �
Enqineer. The developer shall submit a water system plan to �
the City of Lynwood Fire Department for fire hydrant ;
locations. The City will install water meters only. �
Payment for said meters shall be made to the City prior to '
issuance of building permits. The developer shall install '
on-site water facilities including stubs for water meters �
and fire hydrants on interior and on boundary arterial �

12. Public Easements and Right-of-Way:
Where drainage, sewer and other such easements are required,
the minimum easement width shall be ten (10) feet to
facilitate maintenance unless otherwise approved by the
Director of Public Works/City Engineer. The cost of all
�improvements and relocations as required by Utility
companies per their study of parcel map shall be paid by the
Developer.
Dedicate a ten (10) foot wide strip of property along Long
Beach Boulevard, dedicate a five (5) foot wide strip of
property alonq Tenaya Avenue, and dedicate sufficient
property at northwest corner of property to accommodate
radius.
13. Sidewalks
Design, configuration and locations shall be subject to the
approval of the Director of Public Works/City Engineer, and
the Director of Community Development. Ramps for physically
handicapped persons shall be provided both on-site and off-
site as required by State and local regulations.
14. Dust Control and Pedestrian Safety:
Prior to the issuance of demolition or grading permits, the
developer shall:
a. Submit a plan indicating safety methods to be provided
to maintain safe pedestrian .ways around all areas of
construction. This may require proper and adequate signs,
fences, barricades, or other approved control devices as
required by the Directorof Public Works/City Engineer and
the Director of Community Development.
Section 3. The Community Development Department has I
determined that the Tentative Parcel Map�is categorically exempt
from the provisions of the State CEQA Guidelines, as amended, �
Section 15061(b)(3), and is hereby determined to be appropriate. (

1.' Conditional Use Permit - Case No. 86061
Mr. Patei, the applicant in this case;was not present at the
time the Chair of the Planning Commission called . for the
applicant.
The Planninq Commission decided to continue with the following
� agenda items and recall Mr. Patel upon his arrival.
With respect to Case No. 86083 Chairperson Kanka explained
that no action will be taken at this time, and that it
will be continued at the next .reqular meeting of the Plan-
ning Commission scheduled for November 11, 1986.
2. Conditional Use Permit - Case No. 86094
Mr. Karefa-Johnson briefecl the Commission on the application
for a Conditional Use Permit to rebuild an existing church
facility and expand the existing child care center at 11820
� Atlantic Avenue, Lynwood, California.

Mr. Karefa-Johnson explained that an area of 4,515 square feet
would be added to the.main_ sanctuary. This addition would
consist of a second story with offices and storage space. He
also explained that the existing church is legal non-
conforming, because churches are prohibited in an CB-1 Zone.
However, ordinance No. 1202 allows non-conforming churches to
"alter, expand or rebuild." Any additions or expansions
require that the use conform to the regulations currently in
effect with respect to parkinq.
A Determination of the required number of parking spaces for
the proposed project consists of the following:
1. Ratio of 1 space per 10 fixed seats was applied to the
current seating capacity of the sanctuary.
2. Ratio of 1 space per 5 fixed seats was applied to the
residual of the proposed seating capacity (the difference
between the current seating capacity and the seating
capacity after the expansion).
3. An administrative adjustment of 10�.
Mr. Karefa-Johnson stated that the Site Plan Review Committee
reviewed the proposed project at its meeting on September 10,
1986. The Committee approved the project, as submitted, with
only minor'changes. Mr. Karefa-Johnson recommended that the
Commission .approve the findings on Data Sheet No. 3, Approve
..Conditional Use .Permit, Case No. _86094, subject to the
Suggested Conditions of Approval and Adopt Resolution No. 2064.

The public hearing was opened and the applicant was asked to
come forward.
The representative for Christ New Testament Church; Rev.
Henderson came forward.
Rev. Henderson spoke of the 22-mile march he and his members
made from Los Angeles to Lynwood in 1973. Their goal was to
. build a beautiful church building for God in the City of
. Lynwood. He spoke of the. good things that have been
accomplished in Lynwood. He expressed gratitude for the set-
backs, financial and otherwise, that he encountered before
building the church.
Rev. Henderson mentioned that on June 17, 1986, he addressed
the Council with respect to the parking requirement. At that
time, Rev. Henderson said the ordinance was changed to state
1 parking space per 5 fixed seats, although the original plan
� • required 1/10.
He noted that 1 in 5 resulted in cut-backs within church
_ operations, he has spoken with Council hoping for
consideration, however it appears none was given they allowed 1
on 10 and not the 1 on 5. Rev. Henderson feels that this is
noi. proper, but .due to.procedural costs he had to re-vamp
church and christian education.
Rev. Henderson explained that he had discussed with Mr. Hahn
(Architect) a number of plans and have finally come up with the
one which is being submitted today. He also mentioned that he
had spoken with Mr. Karefa-Johnson, Senior Planner, and had
some difference of opinions but they had reached an aqreement.
Rev. Henderson said that he stood with some members .of the
church tonight to find out Council's answer. He feels that
� between Mr. Karefa-Johnson, Senior Planner, and his architect
that progress has been made. -

Chairperson Ranka asked the applicant if he was aware of and
, agreed with all the thirty-eight conditions.
Rev. Henderson asked Mr. Karefa-Johnson if they were allowing 38
as opposed to 40 parking.
Mr. Karefa-Johnson stated that 40 parking spaces were provided
while 38 are required.
� Rev: Henderson aqreed with all conditions. '
Mr. Karefa-Johnson brouqht to the attention of the Planning
Commission the addition of section 2.8a to the Resolution No.
, 2064. This section required an attendant for the parking area
at the rear of the child care center, as approved by the Site
` Plan Review Committee. Although this matter was discussed with
the applicant, it was omitted in the final first draft. It was a
valid requirement which has the approval of the applicant a�
well as the Site Plan Review Committee.
Chsirperson Kanka explained that this had been done due to the
narrow driveway which would be hazardous and that an attendant
. would be needed.
_ Those wishing to speak for or against the application were
. asked to come forward. There being no further response the
public hearing was closed.
Commissioner Gilbert inquired about the number and ages of the
children who would be attending the child care center.
Rev. Henderson stated that he anticipated between seventy
• (70) to ninety (90) children, although they had .space for
twice as many. The ages would range from two (2) to six (6)
years of age. No infant care will be provided.
Chairperson Kanka inquired if.the attendant for the parking
area would be fulltime. �
" Rev..Henderson responded that an attendant would be provided at
a1L of the necessary.times.
Commissioner pove asked if the pre-School and church
service would be operating at the same time.
Rev. Henderson responded that normally they would not, and
that the pre-school is open five (5) days a week. The
' church services operate on Sundays.
Commissioner Raymond moved, and Commissioner pove
seconded, to approve this application, subject to
Sugqested Conditions of Approval, and to adopt Resolution

4. Aoplication for a Variance - Case No. 86097
Mr. Karefa-Johnson briefed ,the Commission on the
application for a Home Occupation Permit to have an
office for a land development business. He noted that
the business activity would only consist of transactions
by telephone and that it was the applicant's objective
' to purchase and develop the land. The owner will be
the only employee. No delivery or pick-up of goods
- or materials would-occur.at the residence. The address
for said.establishment was 3942 Woodlawn Avenue.
� '�The public hearing was opened, and the applicant was
asked to come forward.
Mr. Lumpkin, the applicant came forward, confirming
that he had received the twelve (12) conditions along
with their stipulations. He stated that a Home Office
. would be basically operated by telephone only, with an
occassional visit of an architect cominq to the office
to look over the plans and that his business would not
be creating any more traffic and that no materials were
, to be stored on the property. Mr. Lumpkin explained
that his business consisted of arranqing shipment of
metal frame buildings/homes from manufacturer to
building site.
Commissioner Raymond inquired where the manufacturer
was located. The applicant responded that • the
manufacturer was Price Field in Texas.
Commissioner Raymond also asked if the applicant was
their representative here. The applicant replied
affirmative.
Mr. .Lumpkin further explained that the metal frames
had the strength of steel with 9' insulation which was
very energy efficient. They had R30 rating
versus R19 for residential homes. When Mr. Lumpkin was
asked about the cost, he explained that their buildings
were cost-wise very competitive.
Commissioner Raymond asked if sliding doors would be
utilized, and if the metal frames would be used
' commercially. Mr. Lumpkin responded that they were used
as conventional homes, as well as commercial development.
Commissioner Raymond inquired if the metal frames were
` pre-fabricated. The aoplicant replied in the
` affirmative. (The exterior is pre-fabricated in Texas)..
Commissioner pove asked the applicant if he would be
able to build two-story buildings. The applicant.
answered in the affirmative.

• 5. Abolication for a Variance - Case No. 86098
Mr. Karefa-Johnson explained that the applicant in this
case has withdrawn the application for a variance because
the proponent felt the process would be too
cumbersome.
Commissioner pove asked if it was customary to have monies
refunded when an application was withdrawn.
Mr.-Karefa-Johnson answered in the affirmative, and the
' money-refunded depended on what stage the application was
� in. Mr. Karefa-Johnson recommended that the Planning
Commission officially withdraw the application.
6.' Conditional Use Permit - Case No. 86098
` Mr. Mas briefed the Commission on the application to
construct a 111,980 square foot shopping center on a 9.90
acre site, including a 60,000 square foot market, 19,000
_ square foot drugstore and miscellaneous pad buildings
xanginq from 2,000 7,500 square feet. -
In conjunction with the market would be off-sale alcoholic
beverages.
Mr. Mas stated that the-proposed development was reviewed
and approved by the Site Plan Review Committee at it's
meeting of September 10, 1986.
' Mr. Mas noted that no comments were received from the.
public or the Sheriff's Department in opposition to the
selling of alcoholic beverages at the site. He explained
that the applieant and staff were still negotiating some
of the conditions of approval and as soon as staff and the
developer agreed upon the final conditions to be imposed,
, the conditions may be subject to final approval by the
Redevelopment Agency.
Mr. Mas pointed out that a typoqraphical error was made in
the recommendations. It should read approve the findings
not denial as is currently written.

Jeff Armour (Hopkins�Development Co.) 13 Corporate Plaza,
Suite 200, Newport Beach, addressed the Commission stating
that he reguested that the Conditional Use Permit be
approved, subject to negotiating some of the conditions
currently being imposed on the project. For the record he
said that Hopkins Development Company agreed with
conditions 1-15, 24-26, 28-32, 41, 43-52, 54-55; however,
conditions 16-23, 27, 33-40, 42, 53, 56 are subject to
` ' negotiations with staff. `
`Mr. Mas explained the reason the conditions were not final.
He stated that the entire area is a commercial site and
that staff needs to review the application in relation to
the development.
Mr. Yeager advised the commission that They could approve
the application and defer the final agreement on the
conditions to staff and the developer.
Jeff Armour stated that the issues at hand were technical and
• related to dedication; the site was a maze of utility lines,
and the conditions he did not agree on have to be
� worked out.
Commissioner pove asked the representative if the site
would be linked up to the Montoqmery Ward site. The
� applicant replied in the affirmative.
Mr. Mas stated that the whole area could be re-designed.

Art Grosscost, 3200 Sanborn, Lynwood, CA, came
forward. He stated that he had no objections to
this application, but was concerned about closing of
. Sanborn Avenue as this is the only access for
large trucks to his building. Mr. Grosscost
explained that the drivers already had to back up
down Sanborn to.exit because they were not able to
make the turn on Peach Street.
Robert Fry, 12501 Alpine Avenue, Lynwood, expressed concern
about the development. Mr. Fry said that there were enough
establishments selling alcoholic beverages in Lynwood, such
examples were Seven-Eleven, B and C, drug stores and
market. Fie inquired if any smaller stores intend on
selling alcoholic beverages. He didn't understand about
negotiating on the balance of the conditions, and had
asked if the City would be responsible if the rest of the
site should be deemed not feasible for devel.opment.
Mr. Mas stated that on February 24th an agreement was
made which stated that the developer had to perform.
Mr. Yeager, General Counsel, replied that this was
., a safequard.
Mr. Fry inquired about the signage that,was proposed. He
said the current plastered signs in the City are outdated
and a eyesore, because they are not properly maintained.
He also mentioned the availability of alcoholic beverages
in the City. Mr. Fry said he has.witnessed several minors
intoxicated and walking down the street.

Ray Chavira, 1134 Plum, came forward, he submitted data
, and suggested conditoons to staff and the Commissioners in
protest of the application. He expressed concern that the
conditions imposed are sufficient and suggested the usage
of local controls, which have been suggested by ABC. Mr.
Chavira suggested circulating flyers instead of the
plastered advertisements which he stated are unkempt. Mr.
Chavira states that he would like to know the location of
churches and schools in relation to this application.
, Commissioner pove stated that he agreed with Mr.
" Chavira regarding advertisements and said that this matter
should be solved on a city-wide basis.
Mr. Yeager advised that the Sign Ordinance addresses this
issue.
, Mr. Mas explaine� that provisions exist between agency and
the developer that prohibit this type of advertising.
Mr. Chavira expressed concern about.the hours of the
business, specifically, the time alcoholic beverages will
be sold. He wants to see the area maintained properly.
_..COmmisssioner Raymond asked the applicant about the store
hours.
Mr. Armor responded that there are no fixed hours yet. xe
. added that the community people shop for all required items
all times of the day. He mentioned that he is discussing
volume sales and that convenience stores are another issue.
Iie stated that they will be sweeping the parking lot on a
daily basis.
Mr. Mas mentioned that the city is making a substantial
; investment and that all efforts will be made to maintain
the community. He further explained that the Conditional
Use Permit runs with the land.
There being no further response from the audience, the
public hearing was closed.
Mr. Yeager requested clarification on the changing of
conditions and asked if staff agreed on the conditons the
developer wants deleted.
Commissioner.Raymond suggested going.through the conditions
' and discussing them. with regard co Condition �53, he
asked the applicant if the point in question was solid
• waste or sewage.
Mr. Armor .responded that it was industrial sewage, and
requested a re-wording of the condition.
Upon discussion of this matter it was the consensus of
the Commissioners Resolution Number be changed from #2068
to #2064, and Conditions 16-23, 27, 33-40, 42, 56 be
deleted and Condition #53 be modified.

STAFF REPORTS/COMMENTS
Mr. Karefa-Johnson informed the Planning Commission that the
Director of Community Development has received an appeal to the City
Council of the Planning Commission's decision to adopt Resolution
#2063.
Mr. Mas explained that this section of the agenda is intended to
keep the Commission informed ot acfivities in the city and in the.
, planning.field.
Commissioner Raymond requested comment from counsel regarding
Attachment B.
Mr. Yeager stated that the Commission would be seeing a lot of those
kinds of lawsuits claiming violation of equal protection. He stated
that the suit claimed that the City has no power to prohibit a
combination of alcohol beverages and gasoline sales.
. Mr. Mas stated that regarding Item #C, no action has been taken _
(denial), and that staff has received another application reducing
the intensity of the Motel Use from 21 rooms to 16 rooms.
It was noted that Commissioner Robb:ins resigned, and Mr. Lee Sampson
has been nominated. The final determination will be made at the
first Council meeting in November, 1986.
PUBLIC ORALS
Evelyn Fry 12501 Alpine, Lynwood, came forward and asked if the
market and drugstore will sell liquor, what effect would this
have on other establishments such as pizza parlors, etc. Mrs. Fry
contends there are enouqh establishments selling alcoholic beverages
Mrs. Fry mention that helicopters are constantly hovering overhead
every night, due to the high crime rate. She said that some of
the problems include intoxication and loitering. Mrs. Fry said
mare businesses are needed which will upgrade the community.

' Ray Chavira, 11434 Plum, Lynwood, spoke regarding Attachment E. He
said he felt lawsuits against cities over prohibitions on combined
sales of alcoholic beverages and gasoline are because of bill over-
ride.
Robert Fry, 12501 Alpine; came forward. He commented that the five
hundred ,(500) foot distance between packaged liquor stores was
reduced to 300 feet in error. He mentioned that he fiad canvassed
a number of people and they wanted to have the ordinance changed
back to a spatial distance of 500 ft. He mentioned that one of the
, persons canvassed was Nlayor Henning. Mr. Fry commented that there
would not be as many problems if convenience stores were not selling
liquor. He requested the Planning Commission to use its power
to see that the 500 ft. distance between liquor stores be re-
established.

Upon motion of Commissioner pove, seconded by Commissioner Raymond,
the meeting was adjourned to the next regular meeting of the

Mr. Karefa-Johnson presented the staff report '
indicating as follows: '�

This is an application to build four units on property j
located at 11126 Duncan Avenue; Lynwood, in the R-3 �
(Multi-Family Residential) zone. The plans for this ?
development were submitted in August, 1986; however, a '
major issue at that time was insufficient landscaping �
and open space, although the development met the �
required density. There is a single family dwelling i
and a two-car garage on site. The garage will be �
demolished. -
The General Plan designation for the site is Multi-
Family and the zoning classificatior. is R-3 (Multi- ;
Family Residential). Therefore, the General Plan,
zoning and land use are consistent. ',

It is staff's professional opinion that the development !
will not have a`siqnificant effect on the environment, i
and a Negative Declaration has been prepared.

Chairperson Kanka opened the public hearing; anyone �
wishing to speak for or against the proposed
development was invited to come forward. , i
Neither the applicant nor his representative was �
• present. The chairperson said if no one speaks on j
_ behalf of the application, then the case should be ;
continued until the' next regular meeting of the !
Planning Commission. However, she suggested that this ;

The proponent is requesting a Conditional Use Permit to 7
construct three (3), two-bedroom apartments and a j
three-car garage at 11306 Louise Avenue, in the R-3. i
(Multi-Family Residential) zone. There is a single ;
� family dwelling and a two-car garage on site; the ;
garage is in disrepair and will be demolished. "`

Chairperson Kanka opened the public hearing. _
Alphonso Avila, 9625 San Gabriel Avenue, South Gate, �
' California, spoke in behalf of the applicant. He said ;
he was aware of the 27 conditions imposed and that .he
would be able to meet them.
� Helen Ellis, 11276 Louise Avenue, Lynwood, California, '
asked how the applicant would be able to construct 3 �
�garages on the property. Mr. Mas showed her the plot
plan for the proposed development. The parkinq ;
structures would be placed at the rear of the site. �
Mr: Karefa-Johnson commented that a new driveway will '
be constructed also.
Mrs. Ellis contended that people drive through the .
�' driveway at the subject property and have knocked down
a fence. She claimed she has called the Fire �
Department and the Sheriff's Station, but to no avail.
�
Mr. Mas remarked that one of the conditions imposed is
' that the contractor has to build a six-foot wall around '
the property.
The Chairperson asked Mr. Avila if he wanted to respond
to any of the testimony.
Mr. Avila said.he was not aware of any problems with �
respect to the driveway.

When asked if the property had been surveyed, Mr. Avila '

Commission. He said the landscaping will be completed ;
before the buildings. �

4. Variance - Case No. 86110 %
Mr. Mas reported that the applicant, Hopkins 4
Development Company, requested a"variance" from '
Section 506 (a) of the Uniform Building Code, which '.
requires a 60 ft. separation on three sides of the �
building. ;
The Director stated that the application was f
inadvertently processed as a Variance. However, only a �
waiver of compliance was required. Therefore, in lieu �
of the 60 ft. setback, the Building Division and the
Fire Department requested the applicant�to build a fire '
.
wall separation and install sprinklers. '
i
Mr. Mas remarked that the matter was resolved i
administratively; therefore, no Planning Commission
action is necessary. '
III. STAFF COMMENTS AND REPORTS �

A. Reauest for zone change--Lynwood Church of Christ �
i
Mr. Karefa-Johnson presented the report indicating.as i
follows: j
Staff .received a request for a zone change for the i
subject property located at 3841 EastImperial Highway, •"
(C-2 zone). The applicant is considering building a
12-unit senior citizen facility on the vacant lots j
adjacent to the church. One of the lots is zoned R-1 �
and is located on Fracar St. The other vacant lots are �

zoned C-2; the General Plan designation on the i
C-2 properties is Townhouse & Cluster Housing.

� The requested zoning classification is inconsistent j
, with the General Plan, zoning, and land use. k
Therefore, staff elected not to take any action on the �
request because of the complex land use issues
involved. �

' Mr. Karefa-Johnson mentioned that one of the proponents �
was in the audience. �

Lewis Clark, Anaheim, said he is a member of the �
Anaheim Church of Christ. Ae remarked that the Church �
-of Christ has started a.concept of providing low-cost
housing.for its members. He said the Church would like ;
to build 8 to 12 units on the Imperial Highway site and i
would like to have some guidelines from the Commission. t

The Commissioners discussed the parkinq for the �
proposal. Mr. Mas replied that underground parking ;
would _be an alternative, even though expensive. The �
Director suggested that another lot would have to be t
i
purchased to provide sufficient parking for the units. �
Mr. Clark said they could possibly have the apartments �
above a surface parking lot and install an elevator; i,
this would be cheaper than making underground parking. I

Mr. Mas suggested rezoning all of the lots to R-3; in
the R-3 zone, churches and senior citizen housing are
conditionally permitted uses. The Commission discussed
the feasibility of rezoning the site. !
Mr. Meisner said he would research the matter io j
determine if there would be a problem in rezoning the ;
subject properties. (

The attorney advised the Commission that no action is i
required at this time. '

B. Revision of off-street parking requirements for I
mini-shopping centers . t
Mr. Mas said the off-street parking requirements for �
small shopping centers should probably be increased. He ;
explained that the present requirement is one space for
each 400 sq. ft. of gross floor area; and parking '
for a restaurant is 1/100 GFA. He mentioned that many z
of the spaces in the shopping centers are being leased �
for restaurants. The Director said some of the
developers are considering paying a fee in lieu of !
providing the parking spaces. j

A recommendation will be brought to the Commission at j
a later date, according to Mr. Mas.

C. ` Issues in controlling alcohol availability "
i
Mr. Karefa-Johnson pointed out that studies have shown i
that there seems to be an increasinq correlation between
alcohol availability and misdemeanors. He suggested F
that our ordinance regulatinq businesses selling
alcoholic beverages should be amended. ;

Mr. _Mas informed the Commission that an appeal to the ;
City Council has been filed with respect to the Circle K �
market. (
� Staff has received a business license application for `
liquor sales at the Lynwood Hotel. Mr. Mas said an ,
application to open 20 rooms is also being processed, �
as there are no legal qrounds for the City to prevent
the use. f

The attorr.ey advised that the City cannot.deny the use. �
Further, he said there is no evidence that the Lynwood ,
Hotel does not comply with the law.
with respect to the memo from staff to the Council
(December 8, 1986), Mr. Mas reported that it reviewed
the concerns regarding establishments selling alcoholic .
beverages. The Director commented that it would be
desirable at this time to study the ordinance and
determine whether it would be appropriate to establish
controlling mechanisms. The City Council is considering
this. I

V. PUBLIC ORALS
Tom Sersaw, 3132 Norton Avenue, Lynwood, CA., mentioned that
there ' are approximately 95 liquor stores in the city. He
does'not feel any more are needed. .
, , ,
Mr. Sersaw also said a traffic light is needed at the Norton
and State Street intersection. He claims there are several
accidents at that location each week because someone .is
always' running the stop sign. He was advised to take the '
matter�to the Traffic Commission. '
' Dave Staples, 10789 State Street, Lynwood, CA., agreed with {
Mr. Sersaw that there is a serious traffic problem at Norton �
and State street. i

Department of Public Social Services than in any other nearby
