CALL TO ORDER Pursuant to Agenda posted November 17, 1989, Mayor Froehle called the meeting of the City Council to order at 7:30 P.M. on Tuesday, November 21, 1989. 2. The invocation was given by Reverend Norlyn Brough, Church of the Nazarene, 9953 Las Tunas Drive. 3. The Pledge of Allegiance to the Flag was led by Mayor Froehle. 4. ROLL CALL: Present: Absent: Also Present: Councilmembers Atkins, Breazeal, Swain and Froehle Councilmember Gillanders City Manager Koski, City Attorney Martin, Community Development Director Dawson, Public Works Coordinator Peterson, Parks & Recreation Director Kobett, Temple City Times Staff Writer Butko. Councilmember Breazeal moved to excuse Councilmember Gillander's absence for cause, seconded by Councilmember Swain and unanimously carried. 5. CONSENT CALENDAR: Councilmember Breazeal, commenting on Item B., agreed with the use of Live Oak facilities by the Senior Citizens as they have been extremely cooperative over the years. He also recommended that a copy of the Claim for Damages, Item H., be sent to the Traffic Commission. Councilmember Atkins moved to approve the Consent Calendar as presented, seconded by Councilmember Swain and unanimously carried. A. APPROVAL OF MINUTES - Regular Meeting of November 7, 1989 Approved as written. City Council Minutes, November 21, 1989 - Page 2 B. RECOMMENDATION FROM PARKS & RECREATION COMMISSION REGULAR MEETING OF NOVEMBER 15, 1989 - REQUEST FOR USE OF LIVE OAK PARK BY THE TEMPLE CITY SENIOR CITIZENS FOR 1990 - Request approved for use of Live Oak Park by the Temple City Senior Citizens for 1990, subject to the same use conditions as in the past. C. RECOMMENDATION FROM TRAFFIC COMMISSION REGULAR MEETING OF NOVEMBER 1, 1989 - TRAFFIC SIGNAL UPGRADE - Upgrade project approved for Traffic Signals at Temple City /Lemon, Longden /Oak and Live Oak Avenue /Baldwin as allocated in the FY 1989 -90 Budget. D. RELEASE OF ROAD IMPROVEMENT BOND, TRACT 46260 AT 9437 -41 BROADWAY - Council approved and accepted for maintenance the improve- ments as constructed, released the security deposit in the amount of $6,400 and instructed City Clerk to notify de- positor and Los Angeles County Public Works Department of said action. E. APPROVAL OF AGREEMENT: -JOINT OWNERSHIP OF MOBILE TRAFFIC ZONE RADAR DEVICE, CITY OF TEMPLE CITY AND CITY OF DUARTE - Approved agreement for joint ownership of a Mobile Traffic Zone Radar Device (SMART) between the City of Temple City and the City of Duarte and directed the Mayor and City Clerk to sign for Temple City. F. MUNICIPAL CODE AMENDMENT: ORDINANCE NO. 89 -658 (2ND READ- ING) - Waived further reading and adopted Ordinance No. 89 -658, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING VARIOUS SECTIONS OF THE MUNICIPAL CODE. G. FINAL MAP APPROVAL: TRACT MAP NO. 46590 AT 6029 -33 CAMEL- LIA AVENUE (TSAI -LU) /(ROSE PARK INTERNATIONAL, INC.) - Approved Final Tract Map No. 46590; accepted sanitary sewer easement; approved and accepted work agreements, improve- ment securities and findings as contained in County of Los Angeles Department of Public Works' letter dated November 3, 1989; and instructed City Clerk to endorse on the face of the map of Tract No. 46590, the certificate which embod- ies the approval of said map and acceptance of the dedica- tion shown thereon. 1 1 1 1 1 City Council Minutes, November 21, 1989 - Page 3 H. CLAIM FOR DAMAGES: FAREEDAH ALEEM - Denied and referred to JPIA. I. PLANNING COMMISSION ACTIONS FROM THEIR REGULAR MEETING HELD ON NOVEMBER 14, 1989 - Received and filed. J. RESOLUTION 89 -2915: APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. 89 -2915 allowing claims and demands in the amount of $101,993.52, 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: ORDINANCE NO. 89 -659 ADOPTING THE L.A. COUNTY BUILDING, ELECTRICAL, PLUMBING AND MECHANICAL FEES BY REFERENCE - As background information, the City Council on November 7, 1989 introduced Ordinance No. 89 -659 for first reading and set this public hearing to consider adoption of Los Angeles County Building, Electrical, Plumbing and Mechanical fees. The current fee schedule was adopted as part of the 1984 Code and has not been revised since that time. The in- crease in fees reflects increased costs and expanded plan check and inspection requirements. Historically, the City has adopted the Los Angeles County fee schedule and as- sessed an additional 50 percent surcharge on the building permit fee to cover expenses. Mr. Bruce Hooper, District Engineer, Los Angeles Building & Safety Department was in attendance to answer any ques- tions. Mayor Froehle declared the public hearing open and invited anyone wishing to address Council on this item to come forward at this time. As there was no one who wished to speak on this matter, Councilmember Breazeal moved to close the public hearing, seconded by Councilmember Swain and unanimously carried. Councilmember Breazeal moved to waive further reading and adopt Ordinance No. 89 -659, AN ORDINANCE OF THE CITY COUN- CIL OF THE CITY OF TEMPLE CITY ADOPTING L. A. COUNTY ORDI- NANCES NOS. 89 -0056, 89 -0057, 89 -0058 AND 89 -0059 BY REFERENCE AS THEY PERTAIN TO THE BUILDING, ELECTRICAL, PLUMBING AND MECHANICAL PERMIT FEES, seconded by Council - member Swain and unanimously carried. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF NOVEMBER 1, 1989 REGARDING PROPOSED TEMPLE CITY MUNICIPAL CODE AMENDMENT - VEHICLE WIDTH AND WEIGHT RESTRICTION PARKING ON CITY STREETS - City Manager Koski, providing background information, reported that the Traffic Commission and Council held a joint study session on September 19, 1989 to discuss issues of width and weight of vehicles parked on City streets. Currently, commercial vehicles which carry goods and exceed the specified weight limit are required to operate on designated truck routes only. In response to complaints that large trucks parked for extended periods on truck routes block visibility, the Traffic Commission recommended a one -hour parking limit be established. The City streets which are not truck routes have a weight limit of 6,000 pounds. This restriction does not apply to commercial vehicles making pick -ups or deliveries. The Traffic Com- mission and Council concurred the 80" width limit should be lifted to match the Vehicle Code which allows 102" and the weight limit on local streets for all vehicles should be increased to 10,000 from 6,000 pounds. On October 4, 1989, the Traffic Commission determined to keep the weight limit at 6,000 pounds (3 tons). The changes proposed will allow motorhomes and campers or large vans to be parked at the curb for more than just 30 minutes. Councilmember Breazeal asked staff if the proposed changes meant that motorhomes can park in the street except over- night. If so, this means they can park on the street and block the view of anyone exiting a driveway. Public Works Coordinator Peterson replied that motorhomes can park wherever it is legal to park a vehicle. Councilmember Atkins recalled that at the study session no one knew where the 80" width requirement came from but with the new sport pickup trucks, etc., it is not practical. He is supportive of what the Traffic Commission is recommend- ing. Councilmember Swain remarked that when people in motorhomes come into town to visit, the only place to park is in front of homes adjacent to the curb and get overnight parking permits. She is supportive of this and feels it is some- thing they need to allow the residents to do. Mayor Froehle expressed his concern regarding annual overnight parking permits issued for motorhomes to park on the street. 1 1 City Council Minutes, November 21, 1989 - Page 5 City Manager Koski stated they could add the restriction of not issuing annual overnight parking permits to vehicles over 80" in width. Councilmember Swain suggested changing or adding a section to the ordinance prohibiting annual overnight parking permits for motorhomes. Councilmember Breazeal stated this all came about because of large trucks parking on truck routes. Now they are allowed on all routes. We are digressing. Mayor Froehle said their original concern was large vehi- cles parked for extended periods of time on truck routes. Councilmember Swain was addressing the occasional parking of motorhomes on the street. Councilmember Atkins moved to introduce for first reading by title only Ordinance No. 89 -660, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING TIME LIMITATIONS ON PARKING OF COMMERCIAL VEHICLES ON TRUCK ROUTES AND DELETING THE 80" WIDTH LIMIT FOR ALL VEHICLES ON LOCAL CITY STREETS, together with establishing a policy that the maximum width of any vehicle to be granted an annual overnight parking permit not to exceed 80 "; sec- onded by Councilmember Swain and unanimously carried. 7. NEW BUSINESS: A. PROPOSED MUNICIPAL CODE AMENDMENT: REGARDING THE DUTIES OF THE PARKS & RECREATION COMMISSION - As background, Mr. Koski stated that pursuant to a recent meeting with the Mayor, Mayor Pro Tem, Parks & Recreation Commission Chairman and Vice Chairman, a discussion was held pertaining to the Municipal Code Section regarding the duties of the Parks & Recreation Commission. Proposed amendments to the Municipal Code are contained in Draft Ordinance No. 89 -661 for Council's review and comment. Councilmember Breazeal commented that this item had been previously discussed and moved to introduce for first reading by title only Ordinance No. 89 -661, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SEC- TION 2606 OF THE TEMPLE CITY MUNICIPAL CODE AS IT RELATES TO THE DUTIES OF THE PARKS & RECREATION COMMISSION; sec- onded by Councilmember Swain and unanimously carried. City Council Minutes, November 21, 1989 - Page 6 8. COMMUNICATIONS: A. LETTER FROM L.A. COUNTY SHERIFF SHERMAN BLOCK REQUESTING SUPPORT FOR FEDERAL ANTI -DRUG FUNDING - Providing background information, City Manager Koski re- ported that Sheriff Block is requesting support from cities in getting Los Angeles County designated as a "High Inten- sity Drug Trafficking Area" pursuant to the Wilson -Heinz provisions of the Anti -Drug Abuse Act of 1988 to aid in getting additional Federal resources for the County's war on drugs. After a brief discussion by Council, Councilmember Swain move to adopt Resolution No. 89 -2916, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, URGING THE IMPLEMENTATION OF THE ANTI -DRUG ABUSE ACT OF 1988 TARGETING RESOURCES MADE AVAILABLE UNDER THE ACT TO THOSE AREAS WHICH HAVE INDICATED THE GREATEST NEED INCLUDING LOS ANGELES COUNTY; seconded by Councilmember Breazeal and unanimously carried. Councilmember Swain requested that letters transmitting this Resolution be sent to County and Federal Agencies, as well as elected officials in Washing- ton, D.C. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: NONE RECESS TO CRA: At 7:50 P.M. the City Council met as the Temple City Community Redevelopment Agency; approved the Minutes of the regular meeting of November 7, 1989 and adopted Resolution No. CRA 89 -382 allowing warrants and demands in the amount of $1,937.74. The Minutes of the Agency are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: NONE 11. MATTERS FROM CITY OFFICIALS: Councilmember Breazeal requested Council for their input on the proposed resolutions pertaining to the League of California Cities' policies that he will be voting on at the League's Conference in San Francisco. Councilmember Swain wished everyone a Happy Thanksgiving. Mayor Froehle reported that he received notice from Assemblyman Charles Calderon's office of a meeting scheduled for November 27, 1989 at 1:00 P.M. at the Alhambra City Hall on the poten- tial hazards of malathion spray. 1 1 1 1 City Council Minutes, November 21, 1989 - Page 7 Mayor Froehle announced a study session has been scheduled for Monday, December 4, 1989 at 7:30 P.M. in Council Chambers to review the Katz Hollis Report regarding the downtown area. 12. ADJOURNMENT: At 7:55 P.M. it was moved, seconded and unanimously carried to adjourn. The next regular meeting of the City Council will be held on Tuesday, December 5, 1989 at 7:30 P.M. in Council Chambers, 5938 North Kauffman Avenue.
