COUNCIL MINUTES
SPECIAL MEETING - DECEMBER 15, 1992
The special meeting of the Bat Harbour Village Council was
held on Tuesday, December 15. 1992 in the Council Chamber at Hal
Harbour Village Hall. The meeting was called to order at 5:15 p.m.
by Mayor Stern. The roll was called and those present were:
Mayor Estelle Stern
Assistant Mayor Andrew R. Hirschl
Councilman Matthew B. Blank
Councilman James E. Boggess
Councilman Sol M. Taplin
Also present: Carole S. Morris, village Manager
Jeanette Horton. Village Clerk
Richard J. Weiss. Village Attorney
2. Ordinance - Second ReadingLPublic Hearing: An Ordinance
was read by title, by the Village Clerk, that would provide for
findings of fact: statement of purpose; definitions; jurisdiction:
basis for establishing areas of special flood hazard; establishment
of development permits; compliance; abrogation and greater
restrictions; interpretation; warning and a disclaimer of
liability: penalties for violations: designation of local
administrator: permit procedures; duties and responsibilities of
the Building Official; procedures for variances from this:
Ordinance; general and specific standards for hazard reduction;
standards for streams without established base flood elevations;
and standards for subdivision proposals. Mayor Stern then opened
the Public Hearing.
Mr. Weiss explained that in the past the Village had an interlocal
agreement with Dade County. The Federal Government has changed
their policy regarding the National Flood Insurance Program. They
are now requiring that each municipality qualify individually.
Mrs. Morris stated that the Building Official will be responsible
in enforcing this Ordinance and all buildings must comply in order
to receive flood insurance. There being no further comments. Mayor
Stern closed the Public Hearing.
A motion was offered by Councilman Blank and seconded by Councilman
Boggess to enact this Ordinance. The motion carried and the vote
was as follows: Mayor Stern aye; Assistant Mayor Hirschl aye:
Councilman Blank aye: Councilman Boggess aye; Councilman Taplin
aye; thus becoming .

SHORT TITLE; PROVIDING A STATEMENT OF PURPOSE:
PROVIDING OBJECTIVES; PROVIDING DEFINITIONS;
PROVIDING JURISDICTION: PROVIDING FOR ESTABLISHING

:AREAS OF SPECIAL. FLOOD HAZARD: PROVIDING FOR
ESTABLISHMENT OF DEVELOPMENT PERMITS: PROVIDING
FOR COMPLIANCE: PROVIDING FOR ABROGATION AND
GREATER RESTRICTIONS; PROVIDING FOR INTERPRETATION:
PROVIDING A WARNING AND A DISCLAIMER OF LIABILITY:
PROVIDING PENALTIES FOR VIOLATION; PROVIDING FOR

IN THE CODE. AND AN EFFECTIVE DATE.
3. Other Business: Mayor Stern stated that there are two
employees to be considered for a Performance Bonus. the Village
Manager and the Village Clerk. Councilman Boggess stated that both
had received raises in October and at this time could not see
granting a bonus. He further stated it is his understanding that
the Village Manager does not participate in the Holiday Fund and
the Village Clerk is a participant.
A motion was offered by Councilman Blank and seconded by Assistant
Mayor Hirschl recommending that the Village Manager be given a .1'r,
Performance Bonus and the Village Clerk a 2%. The motion carried
with the vote as follows: Mayor Stern aye: Assistant Mayor Hirschi
aye: Councilman Blank aye; Councilman Boggess aye; Councilman
Taplin aye.
4. Adjourn: There being no further business to come before
the Council. a motion was offered by Councilman Blank and seconded
by Councilman Taplin to adjourn. The motion carried unanimously
(5-0). and the meeting adjourned at 5:45 p.m.
