The Planning Commission of the City of Lynwood met in a Regulai
Session, in the Council Chambers of the City Hall, 11330 Bullis
Road, on the above date at 7:30�p.m. ;
Chairman McMiller presiding.
Commissioners Dove, Barnes, Lee, Evans, Muhsin and McMiller
answered to roll call. ,
Commissioner Haynes was absent.

Also present were Planning Manager Diplock, Deputy City Attorney
Bagneris, Associate Planner Barfield and Civil Engineering

Planning Manager Diplock announced the Agenda had been duly
posted in accordance with The Brown Act.
City Clerk Hooper swore in new Commissioner Jamina Barnes. �
CONTINUED PUBLIC HEARINGS ,
Chairman McMiller introduced the first item, Conditional Use
Permit Case No. CUP M95-03, Applicant: Maria DeJesus Llamas, and
called for a staff report.
Planning Manager Diplock stated the applicant is requesting;a
modification of Conditional Use Permit, in order to allow general
automotive repair, where the previous use permit allows the sale
of auto.electric parts and supplies only at 12001 Long Beach
Blvd. This case was continued from the May 9, 1995 meeting. At
this time staff respectfully requests approval of this item. '

After staff comments, Chairman McMiller opened the Public
Hearing.
Maria DeJesus Llamas, 12001 Long Beach Blvd., Applicant, spoke in
favor of the C.U.P. modification.
After further discussion, it was moved by Commissioner Lee to
continue this item pending further investigation by staff. ;

Commissioner Lee withdrew the motion. �,
Hearing no further discussion from the audience, Chairman
McMiller closed the Public Hearing. �
It was then moved by Commissioner Evans, seconded by Commissioner

Chairman McMiller then introduced the next item, Conditional Use
Permit Case No. CUP 152, Applicant: Eliu & Solio .Saucedo, and
called for a staff report. '
Planning'Manager Diplock stated, as directed by the Commission,
staff is requesting review of the status of CUP 152, and
evaluation of compliance with the Conditions of Approval: This
CUP, legalizing the operation of an auto repair center and tire .
sales facility, was approved at the Planning Commission meeting
of November 8, 1994. Several of the conditions have not been met
and the site has continued to operate in non-compliance. At this
time staff is requesting the Commission direct the applicant to
make a good faith effort to comply with all.conditions prior to
the next regular meeting of July 11, 1995, instruct staff to
report on the compliance at the June meeting, and direct the
applicant to present'a written schedule at the June meeting of

when and how he proposes to comply with any conditions that have
not been met. Staff also suggested that the Commission inform the
applicant that the Commission will consider revoking Conditional
Use Permit No. 152 at the next meeting if progress satisfactory
to the Commission has not been made.
After discussion, Chairman McMiller opened the Public Hearing.
Eliu Saucedo 12207 Lewis Ave., Downey, California, applicant
discussed with the Commission the status of his Conditional Use
Permit. �
Chairman McMiller excused himself from the remainder of the
meeting at 8:50, and turned the meeting over to Vice-Chairman
Lee.
It was moved,by Commissioner pove, seconded by Commissioner Evans
to take a five minute recess.
The Public Hearing regarding Conditional Use Permit #152 was
reopened at 9:05 p.m., and discussion pertaining to this item
resumed between the applicant and the Commission regarding the
time frame on the Conditions of Approval.
Hearing no further discussion, Vice-Chairman Lee closed the
Public Hearing. �

It was then moved by Vice-Chairman Lee, seconded by Commissioner �
Evans to continue this item to the next regular scheduled meeting i

Associate Planner Barfield stated the applicant is requesting a �
modification of Conditional Use Permit No. 88015 in order to �
provide auto repair services, in addition to tire sales and �
service, at 12519 Long Beach Boulevard. The applicant proposes i
to operate a full service automotive repair center (auto repair
and tire sales and service) in an existing structure which is i
presently vacant with minor proposed renovations. Presently,
there is no landscaping on site. Staff respectfully requests �
that, after consideration, the Planning Commission approve
Conditional Use Permit No. CUP M95-08, subject to the stated i

Commissioner Muhsin discussed Atlantic Avenue improvements and
parking moratoriums.
Commissioner Evans stated complaints with the fire hydrant in the �I
middle of the 3500 block of Magnolia. i
Commissioner Barnes thanked everyone for welcoming her to the
Commission.

Commissioner Evans requested speed bumps along Magnolia, stated
complaints with the abundance of Automotive Repair shops along
Long Beach Boulevard. ,

Review of Status of Conditional Use Permit Case No. CUP 152,
Applicant Eliu and Solio Saucedo. ,
Planning Manager Diplock stated that at the Commissions la5t
meeting this Conditional Use Permit was continued £or thirty days
in order to allow the applicant sufficient time to comply with
the Conditions of Ap�roval, legalizing the operation of an Autio
Repair Center and Tire Sale Facility. Staff recommends
revocation of the CUP, based on non-compliance by the applicant
' � with the requirements of the Conditional Use Permit.

10700 Atlantic Avenue. Since December 6, 1994, staff has been
reviewing the site, and has found the business to be in violation
of several of the conditions of approval set forth, such as
fencing and storage of abandoned cars. The property owner has
met with staff to discuss possible commercial rehabilitation

three months. As part of this change, a draft ordinance has

Session in the Council Chambers of the City Hall, 11330 Bullis
Road, on the above date at 7:30 p.m.
Vice-Chairman Lee presiding.

Associate Planner Barfield reported this case was continued from
the meeting of August 8, 1995, in order to allow the property
owner/operator to comply with Conditions of Approval. on
September 6, 1995, the property owner/operator was in the process
of completing the required landscape area. Work is also being �
done on the property signage, but staff has yet to receive a �
proposed signage plan for review and approval. However, other '
conditions, such as damaged and wrecked vehicles stored onsite, i
open storage of materials, landscaping, elevation drawings, and i
security fences architecturally compatible with the design of the
subject have yet to be met or not met at all. (

Commissioner pove agreed with the thirty day extension, feels the
owner is making a legitimate attempt to comply with conditions of '
approval. '

Supervisor, of the Lynwood High School construction project
offered a presentation and discussion on the design concept for
the new High School. .
CONTINUED PUBLIC HEARINGS
Chairman McMiller introduced the first public hearing,
Conditional Use Permit Case No. CUP 67RE, and called for a staff
zeport. 1
Planning Manager Diplock stated this case was continued £rom the
-0ctober 10, 1995 Planning Commission meeting in order to allow
the property owner/operator to comply with all Conditions o;f
Approval within seven days of that meeting. The Commission
' required that staff monitor the business and note the number of
cars on the lot, during investigations. The permitee is stil�l
not in compliance with all conditions of the Conditional Use
Permit as contained in Resolution No. 2367 and was not in
, compliance on October 18, 1995, the deadline set by the Planning
Commission. Significant improvements have been made in meeting
the requirements for landscaping, signage, and trash containment'.
- However, the number of vehicles observed on the property since
the last Commission meeting violates requirements unde'r
Conditions 12 and 15. Therefore, staff has proposed draft
Resolution No. 2564 in order to revoke Conditional Use Permit No'.
67. An alternative to revocation of Conditional use Permit would
be to add the following conditions to the existing Conditional
Use Permit: i

Condition 42: All parking and storage spaces shall be striped. �
Condition 43: No vehicles may be stored in the six spaces
reserved for customer parking. Customer vehicles only may be
parked temporarily in these spaces, i
i
• Condition 44: All stored vehicles must have valid and current
work orders prepared and available for staff review. �
i
Condition 45: No more than 10 vehicles awaiting repair may be _
kept on this site at any one time. Vehicles may be parked behind
each other only in bhe storage area on the south side of the
property and no more than two deep. �
At this time staff respectfully recommends that, after public
° testimony and consideration by the Commission, the Planning
Commission determine either: 4
1) to adopt Resolution No. 2564 revoking Conditional Use Permit
67, or

2) to adopt Resolution 2568 adding the £our suggested conditions
to the existing conditional Use Permit and direct staff to report
back to the Commission in two months on permittee's compliance
with all conditions.

staff is requesting review of the status of CUP 152, and
evaluation of compliance with the Conditions of Approval: This
CUP, legalizing the operation of an auto repair center and tire .
sales facility, was approved at the Planning Commission meeting
of November 8, 1994. Several of the conditions have not been met
and the site has continued to operate in non-compliance. At this
time staff is requesting the Commission direct the applicant to
make a good faith effort to comply with all.conditions prior to
the next regular meeting of July 11, 1995, instruct staff to
report on the compliance at the June meeting, and direct the
applicant to present'a written schedule at the June meeting of

not been met. Staff also suggested that the Commission inform the

PROPOSAL: '
The applicant is requesting approval of a Conditional Use Permit �
to develop two (2) two story residential dwelling units and a six
(6) car garage at 3366 Los Flores Avenue in the R-3 (Multi-
Family Residential) zone. This case was continued from the �
February 13, 1996 Commission Meeting in order to address issues �
surrounding the required six (6) foot high block wall fence for
the proposed project.
i FACTS:
1. Source of Authoritv
Section 25-4.2 of the Lynwood Zoning Ordinance requires that
a Conditional Use Permit be obtained for any residential
" development in the R-2 and R-3 (Residential) zones. �
2. Prooerty Location .
The site is located on south side of Los Flores
Boulevard between Long Beach Boulevard and California Avenue
(see attached location map).
3. Propertv size
The site consists of a rectangularly shaped lot,
approximately 9,000 square feet in size.
4. Existing Land Use
The property is developed with a single family dwelling and
a one (1) bedroom residential unit, with two (2) covered
parking spaces. The surrounding land uses are as follows:

South - Commercial Retail

The applicant is requesting approval of a Conditional Use
Permit to develop an additional two story apartment unit on
this property. On the second floor of each unit, the living
quarters are proposed. The living quarters will contain two
(2) bedrooms, a kitchen/dining area, and a living room.
Attached to, and between the proposed apartment units, the.
plans call for a laundry room. The project will provide a
new six (6) car garage and a detached two '(2) car garage ( a
relocati�n of the existing two (2) parking spaces). More
than 25 8 of the site is planned for landscaping.
7. Site Plan Review
On January 30, 1996, the Site Plan Review Committee
evaluated the proposed development and recommended approval
to the Planning Commission, subject to specific conditions
and requirements.

ISSUES AND ANALYSIS
1. Consistencv with General Plan and Zoning
The proposed land use is consistent with the existing
General Plan designation of MultiFamily Residential..
Therefore, granting Conditional Use Permi.t No. 95-16 will
not adversely affect the General Plan. The proposal also
meets the use and density regulations of the Zoning
Ordinance. •
2. Site Suitabilitv
The subject property is adequate in size and shape to
accommodate the proposed development relative to the
proposed density, bulk of the structures, parking, walls,
fences, driveways, and other development features required
by the Zoning Ordinance. Furthermore, the subject property
is adequately served with the required public utilities and ,
offers adequate vehicular and pedestrian accessibility.
3. Compliance with Develooment Standards
The proposed development meets all the development standards
required by the Zoning Ordinance regarding of£-street
parking, front and rear, yard setbacks, lot coverage,
building height, unit size, and density. �
However, during the February 12, 1996 Commission meeting, �
the applicant questioned to Condition 13, of Resolution No.
2575, requiring a six (6') foot high block wall fence around �
the perimeter of the site (with the exception of the front
yard setback). Requiring walls to separate multifamily '
residential development is a standard City policy.
Staff revisited the site on February 15 and March 6, 1996.
The site is bordered by a brick and concrete commercial
building at the rear property line, a neighbor's garage �
adjacent to the east property line, and, an existing block
wall fence along the west property line (see Aerial Map).
To comply with Condition 13, the applicant need only to
provide 175 feet o£ additional block wall along the east and
west property lines. Therefore, Staff recommends that
Condition 13 be maintained as a requirement for the proposed

• 4. Compatibilitv
The proposed project will be located in a neighborhood that
is in substantial transition from single-family to multi-
family residences.
5. Conditions of A�proval
The proposed project, subject to the conditions recommended
by the Site Plan Review Committee, will not have a negative
effect on the values of the surrounding properties or
interfere with or endanger the public health, safety or
welfare. _
6. Benefits to Communitv
The proposed devel.opment will add to the City's affordable,
. housing stock in furtherance of the policies of the Housing
Element of the General Plan.
7. Environmental Assessment
The Community Development Department Staff has determined
that the project is Categorically Exempt from the California
Environmental Qual.ity Act pursuant to Section 15061 B(3) of
the State of California Environmental Quality guidelines as
amended.
RECOMMENDATION:
Staff respectfully requests that, after consideration, the
Planning Commission adopts the attached Resolution No. 2575:
1. Certifying that the project is Categorically Exempt
from the provisions of the California Environmental
Quality Act pursuant to State CEQA Guidelines, Section
15061 b(3).
2. Approving Conditional Use Permit, Case No. 95-16, �
subject to the stated conditions and requirements.

A RESOLUTION UF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING CONDITIONAL USE
PERMIT NO. 95-16 (CUP 95-16) TO DEVELOP TWO
` (2) TWO STORY RESIDENTIAL DWELLING UNITS AND
A SIX (6) CAR GARAGE AT 3366 LOS FLORES
BOUliEVARD IN THE R-3 (MULTI-FAMILY
RESIDENTIAL) ZONE, LYNWOOD, CALIFORNIA.
WHEREAS, the Lynwood Planning Commission, pursuant to law,
on February 13, 1996 conducted a public hearing on the subject
" applicat'ion; and
WHEREAS, the Planning Commission, .considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
- that the proposal is exempt from the provisions of the California
Environmental Quality Act pursuant to Section 15303b of the State
CEQA Guidelines as amended; and
WHEREAS, a Conditional Use Permit is. required for
residential development in the R-3 (Multi-Family Residential)
zone.
Section 1. The Planning Commission hereby finds and
'. determines as follows:
A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parking, walls,
landscaping, driveways and other development features
' required by the Official Zoning Ordinance.
• B. " The structures, as proposed, subject to conditions,
will not have a negative effect on the values of
surrounding properties or interfere with or endanger
the public health, safety, or welfare.
C. The site will be developed pursuant to the current
zoning regulations and site plan submitted and approved
by the Site Plan Review Committee.
D. The granting of the Conditional Use Permit will not
. adversely affect the General Plan.
- E. The proposed development will add to the City's
affordable housing stock in accord with the policies
of the Housing Element of the General Plan.
Section 2. The Planning Commission of the City of Lynwood,
based upon the aforementioned findings and determinations, hereby
- approves Conditional Use Permit, Case No. 95-16, provided the
. following cpnditions are observed and complied with at all times:

- COMMUNITY DEVELOPMENT DEPARTMENT
' 1. The proposed development shall comply with all applicable
regulations of th.e Lynwood Municipal Code, the Uniform
,� Building Code and the Fire Code and be in s.ubstantial
compliance with plans on file with the Community Development
Department.
2. Any proposed subsequent modification of the subject site or
• structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review of
said modifications.
3. The applicant shall meet the requirements of all other City
` Departments.
4. The applicant and/or his,representative shall sign a
Statement of Acceptance stating that he/she has read,
understands, and agrees to all conditions of this,resolution
prior to issuance af any building permits.
. 5. This Conditional Use Permit shall lapse and become void one
' hundred and twenty (120) days after the use permitted has
been abandoned or has ceased to be actively exercised.
PLANNING DIVISION CONDITIONS
• 6. All work shall be performed by a licensed contractor as per
plans, specificatians and current codes.
7. The applicant shall contact the U.S. Post Office (Lynwood
main office) to est.ablish the location of mail boxes serving
_ the proposed development.
8. Construction shall commence within (6) months from date
of issuance of buil.ding permits.
� 9. Landscaped areas are to be a minimum of twenty-five (25�)
percent of the lot area.
10. Landscaping and irrigation shall be installed in accordance
with a detailed plan to be submitted and approved by the
Planning Division prior to issuance of any building permits.
The minimum plant material shall be trees and shrubs
` combined with ground cover as follows: One (1) five'(5)
gallon shrub for each 100 square feet of landscaped area;
and two (2) fifteen gallon trees for each 500 square feet of
landscaped areas.
11. The required front, rear, and side yar,ds shall be landscaped
- and shall consist predominately of plant materials except
for necessary walks, drives and fences.
12. A minimum two (2) covered parking spaces shall'be provided
for each dwelling �n site. The project shall contain three
' (3) two car garage, attached and one (1) detached two car
garage.
. 13. A six (6'.) £oot high block wall sha11 be installed along the
: perimeter of the property, except within the twenty (20')
foot front yard setback. In this setback, if built, the wall
' shall not exceed a height of four (4') feet measured from
top of curb.
14. No side yard shall be less than five (5') feet.

15. Final building elevations, including materials of
consfruction, sha:Ll be submitted to and approved by the.
Building Official and the Planning Division prior to
issuance of any building permits.
16. Before any building permits shall be issued, the developer
� shall pay_$1.72 per square foot for residential buildings to
" the Lynwood Unified School District, pursuant to Government
Code Section 53080.
17. All driveway and pa.rking areas shall be paved.
18. Acoustical construction materials shall be used throughout
the units to mitigate freeway noise to the standards and
satisfaction of the Building and Safety Division.
19. Residential structures shall have an exterior siding of
brick, stucco, wood, metal; concrete, or other similar
" material other than the reflective glossy, pol'ished and/or
rolled-formed type metal siding.
, 20: Prior to obtaining a building permit, the design of any
exterior elevation changes to the building must be approved
by the Director of Community Development or his/her
designee.
21. All building elevations shall be architecturally treated in
a consistent manner, including the incorporation within the
side and rear building elevations of some or all of the
design elements used for the primar.y (front) facades.
: 22. All security fences, grills, etc. shall be architecturally
compatible with the design of the subject and adjacent
building. In addition, no security fences, grills, etc.
' shall be installed without the prior written approval of the
Director of Community Development.
23. Air conditioners, heating, cooling ventilation equipment,
swimming pool pumps and heaters and all other mechanical
' devices shall be located within the rear yard or side yards.
Such equipment shall be screened from surrounding properties
and streets and operated so that they do not disturb the
peace, quiet and comfort of neighboring residents, in
accordance with the City's Noise Ordinance.
24. A cover sheet of approved.conditions must be attached to
plans prior to submission to the Building and Safety
' Division.
25. The owner of the site shall maintain a pro-active approach
to the elimination of graffiti from the structures, fences
and accessory build.ings, on a daily basis.
26. For the purpose of providing heating for any dwelling
proposed, only an energy efficient forced air furnace
or approved equivalent shall be used, and the use of any ,
wall furnace is expressly prohibited.
PUBLIC WORKS ENGINEERING DEPARTMENT
27. Provide documentation that lots composing the property were .
legally subdivided to the satisfaction of the Department of
Public Works. A£ter reviewing the documents, the Department
of Public Works may require the submission and recordation
of a parcel map.

31. Connect to public sewer. Each building shall be connected

34. A permit from the Engineering Division is required for all

35. All required water meters, meter service changes and/or fire

On February 27, 1996, the Site Plan Review Committee
evaluated the proposed development and determined that
problems exist regarding parking and school play area for
the project. The Committee suggested that the applicant
return to its next scheduled meeting in order to resolve
these issues.

On March 4, 1996 the applicant submitted a letter to Staff

24. A cover sheet of approved conditions must be attached to
plans prior to submission to the Building and Safety

25. The owner of the site shall maintain a pro-active approach
to the elimination of graffiti from the structures, fences

26. For the purpose of providing heating for any dwelling
proposed, only an energy efficient forced air furnace

billiard room. The project will be located in an existing one
(1) story building fronting Long Beach Boulevard. The
building will contain ten (10) pool tables, a small office,
and two (2) required bathrooms. Five (5) parking spaces will
be provided at the rear of building.
7. Site Plan Review
At its regular meeting on February 22, 1996, the Site Plan
Review Committee evaluated the proposed development and
recommended approval to the Planning Commission provided ten
(10) parking space could be secured for the project.
8. City Council
On March 5, 1996, the City Council waived the parking
requirement for the project.

ANALYSIS AND CONCLUSION:
1. Consistencv with General Plan and Zoning Ordinance
The proposed land use is consistent with the existing zoning
classification C-2 (General Commercial) Zone, and the General
Plan designation of Commercial.
2. .Site Suitabilitv
The property is adequate in size and shape to accommodate the
proposed development relative to use, structures, walls,
fences, landscaping, driveways and other development features
required by the Zoning Ordinance. However, the size of the
site does not permit the applicant to meet parking
requirements of the Code.
3. Compatibilitv
` The proposed development is surrounded by a mixture of
commercial and residential uses. Approval of this
Conditional Use Permit request would be compatible with the
adjacent commercial uses, and would not have a negative
effect on nearby residential development.
4. Compliance with Development Standards
'I The proposal meets the development standards required by the
Zoning Ordinance with respect to setbacks; lot coverage and
� building height and parking (see Number 8).
The improvements as proposed, will not a negative effect on
surrounding properties and interfere with or endanger the

A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF LYNWOOD
-` APPROVING CONDITIONAL USE PERMIT
NO. CUP 96-04 FOR THE ESTABLISHMENT
AND OPERATION OF A PUBLIC BILLIARD
ROOM IN THE C-2 (GENERAL
COMMERCIAL ) ZONE, AT 11410 LONG
BEACH BOULEVARD, LYNWOOD,
CALIFORNIA.
wHEREAS, the Planning Commission of the City of Lynwood
pursuant to law, on March 12, 1996, conducted a public hearing on
the subject application; and •
WHEREAS, the Planning Commission has carefully considered all
pertinent testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal is exempt from the provisions of the California
Environmental Act pursuant to Section 15061b(3) of the State CEgA
Guidelines as amended; and
WHEREAS, the project is consistent with the intent of the
General Plan in that the subject site is classified C-2 (Light
Commercial zone);
Section 1. The Planning Commission'hereby finds and
determines as follows:
A. That the granting of the proposed Conditional Use Permit
will not adversely affect the General Plan.
B. That the proposed location of the Conditional Use is in
accord with the objectives of the Zoning Ordinance and
the purpose of the zone in which the site is located.
C. That the proposed location of the Conditional Use and the
conditions under which it would be operated or maintained
will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or ,
improvements in the vicinity;
D. That the proposed Conditional Use will comply with each
of the applicable provisions of the Zoning Ordinance as
stated in the conditions below;
Section 2. The Planning Commission of the City of Lynwood
approves the proposed project subject to the following
conditions.

COMMUNITY DEVELOPMENT
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Building Code and the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review.
3. The applicant, or his representative, shall sign a Statement
of Acceptance stating that he/she has read, understands, and
agrees to the conditions stated herein before any building
permits are issued.
PLANNING DIVISION
4. This permit shall become void one hundred twenty (120) days,
unless extended, after the use permitted has been abandoned
or has ceased to be actively exercised.
5. The applicant shall contact the U.S. Post Office (Lynwood
main office) to establish the location of mail boxes serving
the proposed development.
6. The use shall be for a public billiard room or hall. All
use activity shall be conducted entirely within an enclosed
building.
7. Daily operating hours shall be from 10:00 a.m. to 2:00
. a.m.
. 8. A person under the age of eighteen (18) years shall not be,
remain in, enter,or visit any billiard room or pool hall,
unless accomplish by his or her parents or legal guardian.
9. Within the proposed structure, and if the use is located on
the ground floor, no screen, partition, barrier, closet,
alcove, or object may obstruct the visibility of any part of
the subject use, except for restrooms.
10. The billiard room shall not be open at any time between 2:00
a.m. and 6:00 a.m. of any day.
11. The use shall provide five (5) parking spaces, including one
• handicapped space. Spaces shall be striped and shall be a
minimum of 9 ft. by 20 ft. except for handicapped space.
12. The rear parking area shall be illuminated with lights
directed and shielded to prevent light intrusion to adjacent
properties. All lights shall be a minimum of two (2) foot
candles of intensity.
13. No owner, manager, or other persons in charge or other
person in charge of a billiard room or pool hall shall allow
or permit any intoxicated, quarreling, or disorderly person
or persons to be or remain in billiard room.
14. A Certificate of Occupancy and Business License must be
obtained from the City of Lynwood be£ore operation of the
proposed use.
15. All signage shall be reviewed and approved by the
Planning, Building and Redevelopment Divisions prior to the
issuance of a business license.
16. All necessary permits and licenses shall be obtained prior
! to operation.

17. A parking space designed for the handicapped shall be
' provided. This space may be provided as follows:
a. Dimensions. The minimum dimensions of each automobile
parking stall for the handicapped shall be not less than
fourteen (14) feet in width by eighteen (18) feet in
length. Said stalls shall be lined to provide a nine
(9) foot parking area and a five (5) foot loading and
unloading area or; •
b. Location. All parking spaces for the handicapped shall
be located adjacent to the main�entrance of the facility
for which the spaces are provided. The parking spaces
: shall be positioned so that the handicapped persons
shall not be required to walk or wheel behind parked
vehicles.
18. Parking spaces shall not be used for storage of inoperative
vehicles or as work space. The parking area shall be paved
as required and approved by the Director of Community
Development.
19. The applicant shall submit elevation drawings to the Plan-
ning Division showing the exterior building design includ-
ing the specification of colors, and materials. Prior to
the issuance of building permits, the design of the subject
building including color and materials, must be approved by
the Community Development Director or his/her designee.
20. Prior to the installation, display, enlarging, modifying
relocating or changing of signs, a permit must be obtained
from the Department of Community Development, Planning
Division.
21. All security fences, grills, etc. shall be architecturally
compatible with the design of the subject and adjacent
buildings. In addition, no security fences, grills, etc.
shall be installed without the prior written approval of the
Director of Community Development and the securing of
required building permits.
22. The existing property shall be cleaned and maintained in a
sanitary condition and shall be maintained in a neat and
orderly manner at all times. Failure to comply may result
in revocation of the Conditional Use Permit.
23. A cover sheet of approved Conditions must be attached to any
plans prior to submission to the Building and Safety
Division.
24. Any violation of said conditions in this resolution may
result in revocation or modification of the Conditional Use
Permit by the issuing body at a regularly scheduled meeting.
CODE ENFORCEMENT
25. Entity/Agency will maintain a pro-active approach to the
elimination of graffiti from any structure, fences or
accessory building at the site. Daily inspections will be
conducted in order to have all graffiti removed by 12:00
p.m.
26. Maintenance of sidewalk, parking area, gutters and all
surrounding area will be done at least once a day before
starting of operation.
27. Parking area will be maintained at all times either by the
agent/owner employees or a commercial parking company.
' 28. Entity/Agency will not allow/authorize any other uses except
those listed in their business license.

Staff is requesting a determination of whether a proposed use, a
parking area for trucks and truck trailers, can be considered a
permitted use in the M(Manufacturing) zone. �
FACTS: 1 �
An applicant has proposed to establish a parking area for large '
trucks and truck trailers on a vacant parcel on Louise Avenue. This
use is not specifically permitted in the M zone although "freight �
and trucking yards or terminals" are listed as permitted.

Section 25-24.1 of the Zoning Ordinance establishes a procedure for
determination by the Planning Commission "whether a use not
specifically listed as a permitted or conditional use in any zone
shall be deemed a permitted or conditional use in any one or more
zones on the basis of similarity to uses specifically listed."
Pronerty Location: '
The location of the proposed use is on a vacant parcel on Louise
Avenue, an area of mixed residential, industrial and warehousing.
Discussion•
Truck parking or storage appears to be a use similar to the
permitted use of "freight and trucking yards or terminals". The
problem with this particular site is the poor condition of the �
street, the lack of curbs and gutters, and the non conforming
residential uses in the area.
It appears that truck storage in this area could be permitted and
would fill a pressing need in the City for such facilities.
However, there may be a need to impose conditions on such a use
because of the potential impact on the street and the neighborhood.
It would be appropriate to require a conditional use permit for
this activity as specifically provided in the Zoning Ordinance.
RECOMMENDATION:
Staff respectfully requests that after consideration, the Planning
Commission find that the proposed use, a truck and truck trailer '
parking and storage area could be permitted in the M
(Manufacturing) zone upon granting of a Conditional Use Permit. �

SUBJECT: REQUEST FOR EXEMPTION FROM FENCE ORDINANCE REQUIREMENTS
FOR TWO HOMES IN R-1 RESIDENTIAL ZONES
REQUEST:
In the last few weeks staff has received two requests to be allowed
to build fences in the front yard setback.
Backaround:
Attached are two letters received by staff requesting'variances or
exemption from Zoning Ordinance regulations relating to fences. One
resul.ted from a citation from Code Enforcement for building without
a permit. The second was the result of a counter request. (There �
was a third case cited by Code Enforcement, but the person decided
to remove the fence in the front yard).
Discussion:
Currently the Zoning Ordinance states that no fences are permitted
in the front 20 ft. setback in the R-1 residential zone. The only
possible exception is for corner lots where significant trespass
can be demonstrated. The Ordinance language is:
"Upon application to the Director of Community Development, a
fence, not to exceed 3 ft. if solid and 4 feet if wrought iron, may
be approved in the front yard setback area for the corner portion
of. a corner lot adjacent to a major arterial street or in other
situations where it can be demonstrated that a fence is necessary
to prevent significant trespass."
The two letters attached are not located on a corner, but claim '�
significant trespass. One applicant has started construction �
(Abbott), the second has not (Hulme). A visit to the site showed �
the following: '
1. 10952 Hulme - lot is in mid block, no fences on either
side, one fence across the street and one chain link �
fence on the same side of the street, three houses to the �
south.

2. 4737 Abbott - second house from corner, no other fences �
in front yaYds on the block. . �
Staff's site inspection at 12:45 p.m. on March 07, 1996 showed no
trespass at that time, and no apparent need to provide some sort of
variance or exemption from ordinance requirements. These are nice
residential areas, with only a few fences on the Hulme block and j
none on Abbott. It appears that these are problems between
neighbors that should not require City regulation or interference. �
It does appear that the City could allow the already constructed
fence on the north side of the Hulme Street property to remain ;
without causing any adverse impact to the rest of the block. !
Recommendation:
Staff respectfully requests that, after review, the Commission
direct staff to inform the applicants that an exemption from ,
ordinance regulations is not merited but that the owner of the
Hulme Street property may retain and complete the fence along the
north property line, but the remainder of the partially completed
fence must be removed.

Dear Mr. Diplock:
My name is Ranulfo Carrillo, owner of property located at 4737 Abbott
� Rd., City ot Lynwood.
I hereby request to be permitted to build a block wall fence to surround
the front boundaries of my property, due to the fact of the following:
-need to keep off trespassers. People passing by walking on the
lawn and ruining it.
-neighbor's children, about five minors that keep using my front
yard as a football soccer field after repeatedly asking them to
keep out of my yard. �
-people passing by and picking grapefruit from a three on the side
of my house.
' -I started the construction without a permit not knowing a needed
one for a block wall fence of 4ft. high. All the foundation is done
and the work if half way finished.
-I learned that no permits were being issued since last October
when I went to requesYthe permit upon instructions of the
inspector that came by my property while construction was in
progress.
I would appreciate you understanding the need I have to build the 4ft �
high block wall fence and request an exemption to the permit issuance
considering all the above facts besides the investment I have already
done by buying all the material needed.
Enclosed you will find a copy of the plan (blueprint) with ail the projected
construction information.

March 16 or March 30 are alternative Saturdays. Mr Chicots
