The applicant, K.V. Properties of Lynwood, has filed an
application for a Conditional Use Permit and a Tentative
Parcel Map for the development of a supermarket and additional
retail shops at 10721 Atlantic Avenue (the former Lucky Market
Site).
RECOMMENDED ACTION:
Staff respectfully requests that the Planning Commission open
the public hearing for CUP No. 95-02 and TPM No. 94-04 and
continue these cases to the next regularly scheduled Planning
Commission meeting of May 9, 1995.
2. CONDITIONAL USE PERMIT CASE NO. CUP 95-03
Applicant: Maria DeJesus Llamas/E1 Rayo Elect.
PROPOSAL:
The applicant is requesting a modification of Conditional Use
Permit Case No. 52046 to permit auto electric repair where the
previous use permit allowed the sale of auto electric parts
and supplies only at 12001 Long Beach Boulevard, in the C-2A
(Medium Commercial) zone.
AECOMMENDED ACTION:
Staff respectfully requests that after consideration, the
Planning Commission continue this item to the next regularly
scheduled Planning Commission meeting of May 9, 1995 in order

3. CONDITIONAL USE PERMIT CASE NO. CUP 95-04
Applicant: St. Francis Medical Center
PROPOSAL:
The applicant is requesting approval of a Conditional Use
Permit to construct an 8 story plus hospital tower with single
bed rooms housing acute care patients on the medical center
campus located at 3630 Imperial Highway, in the H-M-D
(Hospital, Medical & Dental) zone. The. proposed structure
will replace portions of the existing hospital and reduce the
number of licensed patient beds from 478 to 350.

4. ZONING ORDINANCE AMENDMENT CASE NO ZOA 95-02
Applicant: City of Lynwood/Action Auto
PROPOSAL:
The City of Lynwood is proposing to amend Section 25-8.1 49a
(c) of the Zoning Ordinance and Chapter 12 of the Lynwood
Municipal Code (Section 12-1.5) to permit the collection and
storage of used motor oil in above ground containers in all
commercial zones except the CB-1 zone. Currently; used motor
oil can be collected only in the M(Manufacturing) zone.
RECO[�IENDED ACTION:
Staff respectfully requests that after consideration, the
Planning Commission adopt the attached Resolution No. 2541:
1. Certifying that the project will not have a
significant effect on the environment and that a
Negative Declaration has been issued pursuant to
the provisions of the California Environmental
Quality Act and State CEQA Guidelines.
2. Approving Zoning Ordinance Amendment No. Z0A 95-02
with any changes that may be recommended by the
Commission and recommending City Council adoption

PROPOSAL:
The applicant has requested approval of a subdivision to
divide an 8,000 sq. ft. parcel into two (2) lots, and a
variance to reduce the lot width from 50 feet to 40 feet at
11024-30 California Avenue, in the R-3 (Multi-Family) zone.
RECOMMENDED ACTION:
Staff respectfully requests that, after consideration, the �
Planning Commission authorize the withdrawal of Tentative
Parcel Map Case No. 95-03 and Variance Application Case No. 35
from the Planninq Commission agenda.
6. GENERAL PLAN AMENDMENT CASE NO. GPA 95-01
Applicant: KRS Development Corporation
PROPOSAL:
The applicant is requesting approval 'of a General Plan
Amendment to change the General Plan designation from
Commercial to Residential for approximately one acre of land

As directed by the Commission, Staff is requesting Commission

- 152 and evaluation of compliance with conditions of approval.
This CUP, legalizing the operation of an auto repair center
and tire sales facility, was approved at the regular
Commission meeting of November O8, 1994.
RECOMMENDED ACTION:
Staff respectfully requests that the Planing Commission, after
' consideration:
1. direct the applicant to make a good faith effort to
comply with all conditions of Conditional Use
Permit Case No. CUP 152 prior to the Commission's
next regular meeting on May 09, 1995.

SUBJECT: Zoninq Ordinance Amendment ZOA 95-02 and Municioal Code
Amendment Section 12-1.5
Applicant: City of Lynwood/Action Auto
PROPOSAL
The City of Lynwood is proposinq to amend Sect. 25-8.1 49a (c) of
the Zoning Ordinance and Chapter 12 of the Lynwood Municipal Code
(Section 12-1.5) to permit the collection and storage of used motor
oil in aboveground containers in all commercial zones except the
CB-T zone. Currently, used motor oil can be collected only in the
M (manufacturing) zone.
FACTS
1. Backqround•
The City is participating jointly with several surrounding
communities in the California lntegrated Waste Management Board's
Used Oil Opportunities Grant Program. The objective is to reduce
illegal dumping and disposal of used motor oil. State funds are
available to provide storage containers at appropriate collection
points. In order to implement this program, it is necessary to
amend our current ordinances.
2. Source of Authoritv:
Section 25-27.2 of the Lynwood Zoning Ordinance states that a
change in zoning regulations may be initiated by the Council,.
Planning Commission or City Manager.
3. Propertv Location:
This ordinance will affect property citywide, with primary impacts
on the commercial corridors of Atlantic Avenue, Long Beach
Boulevard, and Imperial Avenue. A request by Action Auto Supply at '
3861 Imperial Highway brought the need for an ordinance amendment
to the City's attention.

�4. Summary of Proposal:
In order to permit the installation of aboveground storage tanks
for the collection of used motor oil in Commercial zones, it is
necessary to amend Section 12-1.5 of the Municipal Code, which
currently limits aboveground storage of combustible liquids to the
M (manufacturing) zone.
It is also necessary to amend Section 25-8.1 a 49a of the Zoning
Ordinance which currently restricts the collection of used motor
oil to "industrially zoned property only".
5. Public Response:
Staff has received one request to install an aboveground used oil
, storage container at an auto repair facili•ty on Imperial Boulevard.
We have received no other public inquiries or complaints.

ISSUES AND ANALYSIS
Unlawful dumping of used oil has become a serious problem and the
State of California has set up a program to establish used oil
collection centers. Three State certified centers have been
approved in Lynwood and the City is encouraging residents to use
them.
In order .to operate more efficiently,. at least one of these
facilities wishes to .install a permanent aboveqround storage tank.
However, there is a conflict with our current ordinances, which
limit the collection and aboveground storage of used motor oil to
M zones only.
Since the City is participating in the used oil recycling program,
staff believes that it makes sense to update our ordinances to
permit used oil collection at gas stations, quick lube facilities
and auto repair shops. However, appropriate restrictions and
conditions need to be established.
1. Some sort of sitinq review should be required. The current
ordinance requirement for site plan review for small
collection facilities should be sufficient. This allows review
by the Fire Department and the Public Works department, as
well as £he Planning Division.
2. Like other small recycling facilities, used oil collection
tanks should be permitted only in conjunction with established
businesses - in this case, with auto service and r e p a i r
facilities. This means limiting the location to C-2 and
higher commercial zones. our most restrictive commercial
district, CB-1, does not permit gas'stations or auto repair:
3. There should be some limit on the size of above ground storage
tanks. The largest available tank is over l0 feet long! An
appropriate size limit would probably be a 240 gallon tank,
which measures approximately 3ft. x 3ft. x 5ft. According to
the consultant working on this project, this is the size that
most collection centers are installing. The next larger size
is 6ft. long.
Tank safety, spill and venting requirements are already covered by
the Uniform Fire Code in great detail .
Attached are draft amendments to the Municipal Code and the Zoning
Ordinance that would establish these changes and restrictions. The
, amendments have been prepared in "legislative style", with
underline material indicatinq additions and strikeouts indicating
deletions.
ENVIRONMENTAL REVIEW
This action is being proposed in order to help reduce an
environmental problem, the illegal dumping of used motor oil into
storm drains, the ground or the trash. Although the aboveground
storage of used oil could potentially lead to spills or fire
hazards, any storage tanks must meet stringent requirements
contained in the Uniform Fire Code. These include double wall
construction, 150% secondary containment and seismic safety
requirements.
Therefore, the Director of Community Development has determined
that no significant adverse environmental impact will result from .�
the proposed Ordinanc:e change; therefore, a Negative Declaration
has been filed in the Community Development Department in the
office of the City Clerk.

THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS
FOLLOWS:
Section 1. Chapter 12 of the Lynwood Municipal Code is hereby
amended as follows: .
12-1.5 Establishment of Limits of Districts in Which Storaqe
of Flammable or Combustible Liquids in outside Aboveground Tanks is
to Be Prohibited.
a. The limits referred to in Section 79.501 of the Uniform .
, Fire Code, in which the storage of flammable or combustible liquids
in outside aboveground tanks is prohibited, is hereby established
as follows: No flammable or combustible liquids may'be stored in
abovearound tanks anywhere within the City' limits except ert
1. upon propertv zoned M bv the Zonina Ordinance. and
2. for used lubricatinq oil onlv, as defined in State Public
Resources Code Section 48618, uoon property zoned C-2 C-2a
and C-3 after securina site plan review approval and
complvinq with the provisions of Section 25-8.1 a 49a."
Section 2. Chapter 25 of the Lynwood Municipal Code is hereby
amended as follows:
Section 25-8.1 a 49a. (c) -
(2) Small collection facilities: Small collection facilities
may be sited in commercial and industrial zones provided they
comply with the following conditions:
i. Shall be established in conjunction with an existing
commercial �se or community service facility which is in
compliance with the Zoninq, Building and Fire Codes of the
City. In the specified C zones, collection facilities for
used lubricating oil, as defined in California Public
Resources Code, Section 48618, mav be established onlv in
conjunction with automobile service stations, and auto repair
and maintenance facilities.
ii. Shall be no larger than 500 square feet and occupy no
more than five (5) parking spaces not including space that
will be periodically needed for removal of materials or
exchange e-� of containers provided that the spaces are not
required to serve the primary land use.
iii. Shall be set back at least ten (l0) feet from any
street line and shall not obstruct pedestrian or vehicle
circulation or encroach into t-ke required landscape areas.
iv. Sha11 accept only glass, metals, and plastic
containers—, except that �used lubricatinq m�n�r oil may be
accepted w-��r-�e�s��= on propertv within M, C-2, C-2a,
and C-3 zones upon approval of the Fire Department and the

RESOLUTION NO: 2541
A RESOLUTZON OF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING ZONING ORDINANCE
AMENDMENT ZOA 95-02 AND RECOMMENDING COUNCIL
ADOPTION OF AN ORDINANCE AMENDING SECTION
12-1.5 OF CHAPTER 12 AND SECTION 25-8.1A OF
CHAPTER 25 OF THE MUNICIPAL CODE TO PERMIT
' THE COLLECTION AND STORAGE OF �SED MOTOR OIL
IN ABOVEGROUND TANKS IN ALL COMMERCIAL ZONES
EXCEPT THE CB-1 ZONE.
WHEREAS, the Planninq Commission of the City of Lynwood,
pursuant to law, held public hearinqs on the subject proposal at
their regular meeting on April 11, 1995; and
WHEREAS, the Planning Commission has heard testimony
concerning the need to revise existing Code and ordinance
provisions in order to facilitate local and State efforts to
encourage the recycling of used motor oil; and
WHEREAS, the Planning Commission has carefully considered all
pertinent testimony offered at the public hearing; and
WHEREAS, the Director of Community Development has determined
that the proposed Code amendments will not have a significant
adverse effect on the environment, and has prepared a Negative
Declaration for the proposed amendments; now therefore
Section 1. The Planning Commission of the City of Lynwood hereby
Pinds and determines as follows:
A: Unlawful dumping of used oil has become a serious problem
in the State and in the community.
B. The City is participating jointly with several surrounding
communities in a State sponsored program to encourage
recycling of used motor oil.
C. There is need to revise and amend current Municipal Code
provisions to implement this program by permitting the
collection and storage of used motor oil in aboveground
tanks in appropriate commercial zones.
D. Adoption of the proposed Code amendments will not have
a significant adverse effect on the environment.
Section 2. The Planning Commission of the City of Lynwood, based
upon the aforementioned findings and det§rminations:
1. approves the Negative Declaration for Zoning Ordinance
Amendment ZOA 95-02.
2. approves Zoning Ordinance Amendment ZOA 95-02.
3. recommends that the City Council adopt the proposed Municipal
Code amendments as contained in Zoninq Ordinance Amendment
Case ZOA 95-02.
Section 3. A copy of this resolution shall be delivered to the
City Clerk.

The Site Plan Review ("SPR") Committee reviewed the proposed
amendment and concluded that such request to amend the General
, Plan would brinq the General Plan and the zoning in conformity
i with each other and the land use designation would be
' consistent with the existing uses in the general vicinity of
the subject site.

ISSUES AND ANALYSIS
1. Consistencv with General Plan
The existinq General Plan land use designation of commercial
is inconsistent with the existing zoning classification of R-1
• (Single-Family). The General Plan Amendment, if granted,
would eliminate the inconsistency and would allow a proposed
residential development to be found consistent with the
General Plan.
2. Area Suitabilitv
The surrounding area is primarily developed with single family
housing. The freeway to the north is elevated so that exterior
noise levels fall within an acceptable range. Streets and
utilities in the area are sufficient to serve future
• development.
3. Compliance with Development Standards
Any future residential development in the area will comply
with City development standards. However, the current
development proposal will require some minor variances in rear
yard setbacks and lot depth because of the shape of the
property,
4. Comoatibility
The amendment is compatible with existing development in the
area of the subject site.
5. Community Imnact
The General Plan Amendment will not have a negative effect on
the values of the surrounding properties or interfere with or
endanger the public health, safety or welfare.
6. Benefits to Communitv
The proposed General Plan Amendment will enhance the
_ residential development in the surrounding area, and provide
additional commercial services for the neighborhood.
7. Environmental Assessment ,
The Director of Community Development has determined that no
substantial environment impact will result from the proposed
General Plan Amendment; therefore, a Negative Declaration has
been filed in the Community Development Department and in the
Office of the City C1erk.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF LYNWOOD RECOMNIENDING AN
AMENDMENT TO THE LYNWOOD GENERAL PLAN
PERTAINING TO A PORTION OF LOTS 8-10
And A PORTION OF LOTS 14-42 OF MODJESKA
14 PARK TRACT PAGES 9-142-143 OF THE LOS
ANGELES COUNTY RECORDER OFFICE, LOS ANGELES
COUNTY, LOCATED IN THE CITY OF LYNWOOD, '
CALIFORNIA
WHEREAS, the Planning Commission of the City of Lynwood,
pursuant to law, held a public hearing on subject application; ,
and •
. wHEREAS, the Planning Commission has carefully considered all
pertinent testimony offered at the public hearing; and
WHEREAS, the Commission has determined that residential use of
this property would be consistent with the goals and policies of
_ the General Plan; and
WHEREAS, the Director of Community Development has determined
that the proposal- will not have a negative effect on the
environment, and has thereby declared a Negative Declaration for
the project; and
Section 1. The Planning Commission of the City of Lynwood
hereby finds and determines as follows:
A. A residential designation of this property would be
compatible with surrounding land use.
B. The subject site would accommodate proposed development
due to its size, location, and proximity'.to other and residential
land uses.
C. The General Plan Amendment to Residential would be
consistent with the goals and policies of the General Plan.
D. The proposed General Plan Amendment will not be
, detrimental to the properties surrounding the site.
Section 2. The Planning Commission of the City of Lynwood,
based upon the aforementioned findings and determinations, hereby
approves General Plan Amendment Case No. 92-01, and recommends City
Council adoption of a resolution changinq the General Plan map
designation for this property from Commercial to Residential.
Section 3. A copy of this resolution shall be delivered to
the applicant.

, As directed by the Commission, Staff is requesting Commission
, review of the status of Conditional Use Permit CUP 152 and
evaluation of compliance with conditions of approval. This CUP,
legalizing the operation of an auto repa'ir center and tire sales
facility, wa,s approved at the regular Commission meeting of
November 08, 1994.
Facts•
" l. Proiect Characteristics:
_ The Conditional Use permit approved the operation of a full
service automotive center (automobile repair, body and fender
- work and tire sales). The tire sales and body shop are located
in a 1600 sq. ft. structure while the automobile repair shop
consists.of a small office and a covered outdoor work area.
2. Source of Authorify '
" Section 25-25.12 of the Lynwood Zoning ordinance provides
� that, upon failure to comply with conditions, that a
- Conditional Use Permit'is automatically suspended and requires' ,
the Planning Commission to hold a public hearing within 40
- days to determine what actions need'•to be taken.
. 3. Propert� Location
The subject property is a regularly shaped lot located on the
northwest corner of E. Imperial Highway and State Street (see
attached location map).
Preliminarv Evaluation of Compliance with Conditions of Abproval:
The property owner has requested a preliminary evaluation of
compliance with conditions of CUP 152 prior to formal review at the
" Commission's May meeting. In response to this request, Staff�has
been by to inspect the site twice during March and on April 05,
1995. .
In the past several months, Mr. Saucedo, the property owner, has'
taken action to improve the appearance of his property. He has
, � constructed a block arid wrought iron wall that conceals part of the
auto repair work being done on site. He has also provided
landscaping, painted the buildinqs and installed new signs.
However, since the approval of CUP 152, it appears that Mr. Saucedo
has done little or nothing to comply with the Conditions of
Approval. Many of these conditions can be complied with at little
or no cost and involve nothing more than requiring his tenants to
limit the number of junked or-wrecked cars and trucks kept on site.
The following'are,conditions that have not been complied with:

except that tires may be repaired and installed outside...
(WOrk is consistently being done in the driveways and parking
areas of the site).
10. No damaged or wrecked vehicles shall be stored on site.
(There are a number of damaged and wrecked vehicles on site
that are not being worked on).
11. Al1 damaged vehicles awaitinq repair shall be effectively
screened....
, (Cars are being stored in the area that is supposed to be used
for parking and in the- driveways and can be seen from the
street).
13. Applicant/tenant shall provide adequate.vehicular circulation
.... There shall be no automotive repairs parking or storaqe
in the driveways ....
� (Cars are consistently stored in the driveways. It is
impossible to drive through the site).
15. All siqnaqe must be reviewed and approved....
( No siqn permit or review has been submitted or requested).
19. There shall be a minimum of nine off street parking spaces ...
(NO parking spaces are visible on the site. The area
designated for parking on the site plan consistently contains
wrecked and inoperative vehicles).
20. A parking space for the handicapped shall be provided.
(No handicapped parking space has been provided).
32a. Repair damaged sidewalk.......
Damaged sidewalk has not been repaired.
33 through 51. Fire Department Conditions
(A report on compliance with Fire Department conditions will
be presented at the meeting).
RECOMMENDATION:
Staff respectfully requests that the PTanning Commission, after
cbnsideration:
1. direct the applicant to make a good faith effort to comply
with all Conditions of Conditional Use Permit CUP 152 prior to
the Commission's next regular meeting on May 09,1995.
2. instruct staff to present a detailed report on the status of
compliance at the May meeting.
3. request the applicant, at the May meeting, to present a
' written schedule of when and how he proposes to comply,with
any conditions that have not been met at that time.
