ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE CITY OF
RICHMOND
WHEREAS, the boundary of the City of Richmond, Indiana is contiguous to the real estate
described herein, and
WHEREAS, on May 10, 2006, a Petition for Annexation Into the City of Richmond, Indiana
was filed by the owners of said real estate requesting annexation of the area
pursuant to Indiana Code 36-4-3-5.1.
NOW THEREFORE, BE IT HEREBY ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF RICHMOND, WAYNE COUNTY, INDIANA, that:
Section. 1 The following described real estate be, and the same is, hereby annexed to
and declared a part of the City of Richmond, Wayne County, Indiana, to -wit:
Located in the northwest quarter of Section 10, Town 13 North, Range 1 West,
Wayne Township, Wayne County, Indiana, being part of the land conveyed to
Paul W. Lingle Unitrust, by Instrument Number 1999-016990 of the Wayne
County Deed Records and being more particularly described as follows:
Beginning at an iron pin found at the northeast corner of the northwest corner of
said Section 10, said iron pin also being at the intersection of the centerlines of
South L Street and Henley Road;
thence with the east line of the northwest quarter of said Section 10, Due South
for 762.00 feet;
thence South 79 degrees 00 minutes 00 seconds West for 165.00 feet to an iron
pin (5/8"x24") set at the northwest corner of a 0.41 acre tract of land conveyed to
Harry C. and Carolyn Gaylor Moss by deed recorded in Deed Book 266, page 13
of the Wayne County Deed Records, said iron pin also being the true point of
beginning for the tract hereinafter described;
thence Due South for 298.00 feet to an iron pin (5/8") found at the southwest
corner of a 0.595 acre tract of land conveyed to Michael and April Jones by deed
recorded in Deed Book 463, page 291 of the Wayne County Deed Records;
thence with the south line of the said Jones tract, North 79 degrees 00 minutes 00
seconds East for 165.00 feet to a railroad spike found in the east line of the
northwest quarter of said Section 10 and passing an iron pin (5/8") found at
142.00 feet along this course;
thence with the east line of the northwest quarter of said Section 10, Due South
for 628.15 feet to a railroad spike set at Paul W. Lingle Unitrust southeast corner;
thence with Paul W. Lingle Unitrust's south line, South 89 degrees 28 minutes 09
seconds West for 756.00 feet to an iron pin (5/8"x24") set and passing an iron pin
(5/8"x24") set at 23.00 feet along this course;
thence continuing with Paul W. Lingle Unitrust's south line, Due North 148.50
feet to an iron pin (5/8"x24) set;
thence continuing with Paul W. Lingle Unitrust's south line, South 89 degrees 28
minutes 09 seconds West for 594.00 feet to an iron pin (5/8"x24") set at Paul W.
Lingle Unitrust's southwest corner;
thence with Paul W. Lingle Unitrust's west line, North 0 degrees 10 minutes 04
seconds West for 500.00 feet to an iron pin (5/8"x24") set;
thence North 77 degrees 43 minutes 50 seconds East for 1217.24 feet to the true
point of beginning; containing 21.331 acres and subject to all easements,
restrictions and legal highways of record.
Said real estate shall be assigned to City Council District 4, subject to any later reapportionment.
Section. 2 Be it further ordained that the boundary of the City of Richmond, Indiana
is hereby extended to include all of the real estate described above as part of the City of
Richmond, Wayne County, Indiana.
Section. 3 This ordinance shall be in full force and effect from and after its passage
by the Common Council and its approval by the Mayor of the City of Richmond, Indiana and
publication in accordance with the law.
Passed and Adopted by the Common Council of the City of Richmond, Wayne County,
Indiana, upon this _19th day of _June , 2006.
