The applicant also is requesting a Zoning Ordinance Amendment to allow the development of a new legal use on a parcel accommodating an existing non-conforming use (church), pursuant to Code Section 25-15.13., at 11822 Atlantic Avenue in the CB-1 (Controlled Business) Zone. , Facts• l. Source of Authoritv: Section 25-25.10 and 25-25.1Ob of the Lynwood Municipal Code requires that a Conditional Use Permit be obtained for any alteration or expansion of a pre existing conditional use, unless the alteration is less than $2500. 2. ProneYty Location: � The subject site is located on the west side of Atlantic Avenue between Josephine Avenue and Lavina Avenue (see attachedlLocation Map). -3. Property Size: The subject property is a rectangular lot, approximately 127,000 square feet (180'x 155') in size. 4. Existing Land Use: The subject site currently contains a non-conforming church and a child care facility with 30 compact parking spaces. The surrounding land uses are as follows: North - Commercial South - Commercial East - Single family and multi-family Residential ' West - Commercial 5. Land Use Desianation: The General Plan Designation for the subject property is commercial, while the Zoning Classification is CB-1 (Controlled Business Zone). The surrounding land use designations and zoning are as follows: General Plaii Zoning North - Commercial North - CB-1 South - Commercial South - CB-1 'I East - Town House & Cluster Housing East - R-3 ! Proiect Characteristics: „� The applicant is proposing to expand/alter a legal non- conforming use by adding 3 cellular antenna arrays and 2 microwave dishes to an existing church. The equipment is to be enclosed in a new bell tower. Additionally, a 12ft x 30ft equipment shelter is proposed on the rear of the property. The cellular facility is unmanned with maintenance service - visits scheduled every 4-6 weeks. An existing garage is to be demolished to provide access to the equipment enclosure and three new parking spaces are to be provided. The applicant is also requesting a Zoning Ordinance Amendment to allow development of a new legal use on a parcel accommodating an existing non-conforming church use. 7. Site Plan Review At its regular meeting on June 1, 1994, the Site Plan Review Committee evaluated the proposal and recommended approval to the Planning Commission. 8. Zoninct Enforcement History None on file at the time this report was prepared. 9. Public Response None on record at the time this report was prepared. ANALYSTS AND CONCLUSION: ' 1. Consistency with General Plan and Zoning The proposed use is consistent with the existing zoning classification of CB-1 (Controlled Business Zone) and the General Plan designation of Commercial. 2. Site Suitabilitv The property is adequate in size and shape to accommodate the proposed development relative to structures, walls, fences, landscaping, driveways and other development features required by the Zoning Ordinance. However, the existing church is deficient by 32 parking spaces. The proposed addition/alteration would not require additional parking spaces. However, three additional spaces will be provided to replace spaces lost by the demolition of the garage. 3. Compatibilitv The proposed development is surrounded by a mixture of uses, with commercial to the north, south and west of the subject site, and residential to the east. The uses in this area are mostly commercial and residential and the proposed bell tower would be compatible with the characteristics of the neighborhood. 4. Compliance with Develobment �tandards The proposal meets the development standards required by the Zoning Ordinance with respect to setbacks, lot coverage, building height and density. 5_ Benefits to Communitv The proposal will assist in upgrading the church property and will be a much more compatible and attractive development than the conventional exposed free standing antenna systems 2 �i that are currently permitted in the zone. _, The addition as proposed, providing a bell tower 23 feet above the roof line of a 40ft. high church is within the height limits of the CB-1 zone. 6. Environmental Assessment The Director of Community development has determined that no substantial environmental impact will result from the proposed development, therefore a Negative Declaration has be filed in the Community Development Department and the Office of the City Clerk. RECOMMENDATION: Staff respectfully requests that, after consideration, the Planning Commission adopt the attached Resolution No.2521: 1. Finding that the Conditional Use Permit Case No.147, will not have a significant effect on the environment and certifying the Negative Declaration as complete. 2. The Planning Commission hereby finds and determines as I follows: i A. The site of the proposed use is adequate in size and ! shape to accommodate the structures, parking, walls, i landscaping, driveways and other development features_as required by the Official Zoning Ordinance. � B. The structure, as proposed, subject to conditions, will � not have a negative effect on the values of surrounding I properties or interfere with or endanger the public, � health, safety, or welfare. C. The site will be developed pursuant to the current � zoning regulations and site plan submitted and reviewed ; by the Site Plan Review Committee. , D. The granting of the Conditional Use Permit will be in ' conformance with and not adversely affect the General , Plan. � i E. The proposed development will aid in aesthetically ; upgrading the area. The proposed development shall comply with all applicable regulations of the Lynwood Municipal Code, the Uniform Buildinq Code and the Uniform Fire Code. 2. Any proposed subsequent modification of the subject site or structures thereon, shall be first reported to the Community Development Department, Planning Division, for review. 3. The applicant and/or his representative shall sign a Statement of Acceptance stating thaE he/she has read, understands, and agrees to all conditions of this resolution prior to issuance of any building permits. REDEVELOPMENT DIVISION 4. The proposed project located in Redevelopment Project Area � "A", shall be presented to the Redevelopment Agency for ! approval. � I i 5. The development shall be of a quality and character which � enhances and harmonizes with existing development located in i the surrounding area. 6. The proposed tower and service building design shall be � compatible with existing development in the area in terms of ' scale, height, bulk, materials, colors. � 7. The applicant or his/her successor in interest shall provide r evidence of good-faith compliance with all of the � requirements at the time of Redevelopment Agency review. � � PLANNING DIVISION I � CONDITIONS OF APPROVAL FOR DISH ANTENNAS AND MICROWAVE � 8. The maximum number of antennas that may be installed within � the tower shall not exceed four (4) cellular antennas per , face up to maximum of 12. � I I 9. The maximum number of microwave dish that may be installed i within the tower shall not exceed two (2), i 10. No antennas, satellite receiver dish or microwave dish shall � be installed in any zone, when it impedes the normal � circulation, including ingress or egress, to and from any � structure or facility including parking areas. � 11. Antennas will be screened through the addition of i architectural features and/ or landscaping that harmonize � with the characteristic of the property pursuant to a plan approved by the Director of Community Development. � 12. The mast or tower shall be noncombustible and corrosive � resistant material, � 13. Every antenna shall be adequately grounded for the � protection against a direct strike of lightning, with adequate ground wire. The wire shall be of a type approved ; by the latest edition of the Electrical Code for grounding � masts and lightning arrestors. ; 14. Antenna transmission lines shall be underground. � i i 2 I 1 . � :; 15. The tower shall maintain at least 6 feet horizontal and 12 feet vertical clearance of utility lines. 16. Engineering calculations signed by a licensed engineer shall be provided. 17. The antennas and tower shall be maintained in good condition and in accordance with all requirement of this section. 18. Every antenna shall be subject to periodic reinspection by the inspector, in order to ascertain whether or not the antennas continue to remain in safe condition, and in compliance with the terms of this section. 19. In case any condition is found which might result in the danger to life or property, the inspector shall give a written notice to the owner or operator of such antenna tower at last known address stating .conditions, and notifying him that the same must be corrected within the (10) days after such notice. Failure to abide by and � faithfully comply with this section or with any and all i conditions that may be imposed shall constitute grounds for ! the revocation of permit by the Community Development ' Director or authorized representative. � 20. This Conditional Use Permit shall lapse and become void one � hundred and twenty (120) days after the Conditional Use i Permit has been abandoned or has ceased to be actively , exercised. i 21. Construction shall commence within six (6) months from date ' of issuance of building permits. , I 22. The applicant shall submit elevation drawings to the Planning Division showing the exterior building design, � including the specification of colors, and materials. Prior ; to the issuance of building permits, the design of the tower � including color and materials, must be approved by the ' Director of Community Development. � 23. Heating, cooling, ventilation equipment, pumps and heaters i and any such mechanical devices shall be screened from the � public view and from surrounding properties and streets. They shall be operated so that they do not disturb the peace, quiet and comfort of neighboring residents, in ;� accordance with the City�s Noise Ordinance. � 24. All means of access to the supporting equipment shall be � designed and installed so as to prevent access to � unauthorized persons and shall be approved by the Building i and Safety Division. � 25. The existing property shall be cleaned and maintained in a I sanitary condition pending construction and shall be maintained in a neat and orderly manner at all times. ' ' Failure to comply may result in revocation of the ' Conditional Use Permit. 26. Applicant will maintain a pro-active approach to the elimination of graffiti from the structures, fences and ; accessory building. � 27. A cover sheet with approved conditions must be attached to I plans prior to submission to the Building and Safety Division. , ; i 28. Any violation of said conditions in this resolution may , result in revocation or modification of the Conditional Use , Permit by the issuing body at a regularly scheduled meeting. ; 3 � 1 9 i PUBLIC WORKS ENGINEER DIVISION 29. Submit a grading plan prepared and signed by a reqistered Civil Engineer. Property is located within 100 year flood level zone per flood boundary map. Also conform to all applicable Section of Chapter 15, "Flood Damage Prevention", bf the Lynwood Municipal Code. Build one (1) foot above flood level or flood proof structure. Flood level is at 82 feet. 30. Dedicate 10 feet wide strip of property along Atlantic Avenue (across lots 4,5,and 6). 32. Underground all utilities (including SCE, SCG, Cable. TV, Pacific Bell. 33. Underground existing utilities if any modifications are proposed for the electrical service panel. 34. A permit from the Engineering Division is required for all j off-site improvements. i 35. All required water meters, meter service changes and/or fire i protection lines shall be installed by the developer. The � work shall be performed by a licensed contractor hired by i the developer. The contractor must obtain a permit from the ' Public Works/Engineering Division prior to performing any , work. , FIRE DEPARTMENT i 36. The Fire Department found no cause to impose conditions at this time. Section 3. TO: PLANNING COMMISSION � }�' �`' Z � C rlv�_ f�dJ FROM: Sol Blumenfeld, Director� Community Development Depa ment , BY: Robert Diplock, Planning Manager SUBJECT: Zonina Ordinance Amendment Case No. ZOA 36 Applicant: Pac Tel Cellular Pronosal• The applicant is requesting approval for a Zoning Ordinance Amendment by amending Code Section 25-15.13 to allow the development of a new legal use (an antenna receiving and transmitting facility enclosed in a bell tower) on a parcel accommodating an existing non-conforming use (church) at 11822 Atlantic Avenue in the CB-1 (Controlled Business). Source of Authoritv: Section 25-27.1 of the Zoning Ordinance provides that the zoning regulations or any other provisions of the Zoninq Ordinance may be changed upon the initiation of the Planning Commission and by following the procedures prescribed in Section 25-27. Issues and Analvsis: The subject site is zoned CB-1 which allows radio and TV receiving and transmitting antennas as a permitted use, if the project complies with Section 25-16.6 (i.e site plan review, et � al). The church is currently a legal non-conforming use (Section 25- 7.3b). Generally a non-conforming building may not be enlarged or structurally altered except in limited situations (Section 25- 15.12). However Section 25-15.13 specifically allows non- conforming churches to be "altered, enlarged or replaced...." � Another section of the ordinance prohibits establishing another uses on a lot containing a legal non-conforming use, even if the I new use is conforming (Section 25-15.2). � Therefore, in order to permit the antenna project to be approved, j the property would have to be rezoned (to make the church a I conforming use) or provisions of the Ordinance would have to be i amended to allow non-conforming churches to establish conforming uses on their'sites. Since Section 25-15.13 of the ordinance I already allows legal nonconforming churches to alter, expand or � rebuild (essentially treating them as conforming uses), staff i sees no real objection to such an amendment. The one problem with i this proposal is that it would allow all legal non-conforming churches (those in the R-1 and CB-1 zones) to establish � additional conforminq uses if they wanted, upon obtaining the ; necessary permits. However, there are very few churches in these j two categories. Staff has identified 3 additional churches in the � 2 2ones. Envirnnmental P.s�essment: The Director o! Draft ordinance f:\staffrpt\zoa36 , . i i I I I i ; ' I I � I f i i i i i i i � ' i i � I 2 � , RESOLUTION NO. 2522 i A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LYNWOOD APPROVING THE AMENDMENT OF CIIAPTER 25, SECTION 25- 15.13 OF THE OFFICIAL ZONING ORDINANCE OF THE CITY OF LYNWOOD TO ALLOW CONFORMING USES TO BE ESTABLISHED ON PARCELS CONTAINING A NON-CONFORMING CHURCH WHEREAS, the Planning Commission of the City of Lynwood, did, pursuant to law, on June 14, 1994 conduct a public hearing on a proposed amendment to the Lynwood Municipal Code with respect to the above subject; and WHEREAS, The Planning Commission of the City of Lynwood wishes to permit the establishment of conforming uses on properties in the R-1 and CB-1 zones containing non-conforming churches and; WHEREAS, the Community Development Director has determined that no substantial environmental impact will result from the proposed amendment and therefore, a Negative Declaration has been prepared and is on file in the Community Development I Department and the office of the City Clerk. Purnose- To inform the Commission of a proposal to remodel/rehabilitate and develop a 4,500 sq. ft. commercial property within Redevelopment Project Area "A", at 12200 Long Beach Boulevard on the southeast corner of.Long Beach Boulevard and Magnolia Avenue. Backvround• . The applicant is proposing to remodel and rehabilitate a partially completed 4,500 sq. ft. commercial building on a 11,250 sq. ft. lot on the southeast corner of Long Beach Boulevard and Magnolia Avenue in Redevelopment Project Area "A". Tenants are proposed to be two retail stores and a laundry. The development will provide the required 13 parking spaces, including one handicapped space. The property is shown as Commercial on the General Plan and is zoned C-2A. The proposed development is permitted by right in this zone. A previous owner had filed a CUP for the off sale of beer and ' wine, which.was denied by the Planning Commission. This property has been abandoned for some time when the former ," owner defaulted. Since then the property has become a nuisance to the neighborhood and the City. The new owner has submitted revised plans for the development for Plan Check and a field inspection on the condition of the structure has been completed. Analvsis• The proposed use is permitted by right in the C2-A zone. However, staff is requiring site plan review, since the development can be considered new construction. Since the project is located in the Redevelopment Project Area it also is being submitted to the Redevelopment Agency for review. Because of the dilapidated condition of the building, staff has required the property owner to have the building evaluated by a structural engineer. Improvement plans have been prepared to insure that the'building will meet current building and safety _ requirements. The weathered plywood sheeting is to be removed and replaced. Staff has also reviewed the proposed facade and landscaping and has required an upgrade of the plans. The proposed development is a logical extension of the commercial , development to the south along Long Beach Boulevard. The rehabilitated structure will eliminate a blighting influence in the area and may help to stimulate development of other abandoned , existing commercial structures and vacant lots along the Boulevard.
