CALL TO ORDER Pursuant to Agenda posted December 1, 1989, Mayor Froehle called the meeting of the City Council to order at 7:30 P.M. on Tuesday, December 5, 1989. 2. The invocation was given by Pastor Jim Staten, First Southern Baptist, 4856 North Golden West Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Froehle. 4. ROLL CALL: Present: Councilmembers Atkins, Breazeal, Gillanders, Swain and Froehle Absent: None Also Present: City Manager Koski, City Attorney Martin, Community Development Director Dawson, Public Works Coordinator Peterson, Parks & Recreation Director Kobett, Temple City Times Staff Writer Estrada. 5. CONSENT CALENDAR: Councilmember Atkins moved to approve the Consent Calendar as presented, seconded by Councilmember Swain and unanimously carried, with Councilmember Gillanders abstaining on Item A. A. APPROVAL OF MINUTES - Regular Meeting of November 21, 1989 Approved as written, with Councilmember Gillanders abstaining. B. MUNICIPAL CODE AMENDMENT: ORDINANCE NO. 89 -660 (2ND READ- ING) - Waived further reading and adopted Ordinance #89 -660, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING TIME LIMITATIONS ON PARKING OF COMMERCIAL VEHICLES ON TRUCK ROUTES AND DELETING THE 80" WIDTH LIMIT FOR ALL VEHICLES ON LOCAL CITY STREETS. MUNICIPAL CODE AMENDMENT: ORDINANCE NO. 89 -661 (2ND READ- ING) - Waived further reading and adopted Ordinance #89 -661, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 2606 OF THE MUNICIPAL CODE AS IT RELATES TO THE DUTIES OF THE PARKS & RECREATION COMMISSION. D. 1. ACCEPTANCE OF EASEMENT FOR SANITARY SEWER PURPOSES AT 4851 -4859 AGNES; 2. ADOPTION OF RESOLUTION NO. 89 -2920 DESIGNATING CITY MANAGER AS AUTHORIZED OFFICER TO ACCEPT CONVEYANCES - Approved the Acceptance of Easement and Recordation thereof for subject property and adopted Resolution No. 89 -2920, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REGARDING AUTHORITY TO ACCEPT DEEDS OR GRANTS TO THE CITY OF TEMPLE CITY AS REQUIRED BY SECTION 27281 OF THE GOVERN- MENT CODE AND DESIGNATING CERTAIN OFFICIALS OF THE CITY OF TEMPLE CITY AS AGENTS OF THE CITY TO EXECUTE CERTIFICATES OF ACCEPTANCE OF DEEDS OR GRANTS. E. GENERAL MUNICIPAL ELECTION, APRIL 10, 1990 - Adopted Resolution No. 89 -2917, Resolution No. 89 -2918, Resolution No. 89 -2919, CALLING FOR A GENERAL ELECTION; REQUESTING BOARD OF SUPERVISORS TO PERMIT REGISTRAR OF VOTERS TO RENDER SPECIFIED SERVICES TO THE CITY; AND ADOPT- ING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE. F. CLAIM FOR DAMAGES: SEGRID PRICE - Denied and referred to JPIA. PLANNING COMMISSION ACTIONS FROM THEIR REGULAR MEETING HELD ON NOVEMBER 28, 1989 - Received and filed. H. RESOLUTION NO. 89 -2921: APPROVAL OF PAYMENT OF BILLS - Adopted Resolution No. 89 -2921 allowing claims and demands in the amount of $283,574.42. 6. UNFINISHED BUSINESS: NONE 7. NEW BUSINESS: A. ADOPTION OF L.A. COUNTY CODE, TITLE 20, UTILITIES, DIVISION 2, SANITARY SEWERS AND INDUSTRIAL WASTE AS AMENDED BY REFERENCE - 1 1 1 City Council Minutes, December 5, 1989 - Page 3 As background, City Manager Koski stated that the L.A. County Public Works Dept. has administered for the City all Industrial Waste Ordinance requirements. The County has provided the City with copies of Title 20, Division 2 as amended July 27, 1989, and a breakdown sheet showing fee changes made by the ordinance. It has been several years since City fees were last raised and fees have not, in recent years, covered costs. It is recommended that the City set its fees to match the fees of the County. Fees are charged only from persons or businesses utilizing or needing such industrial waste facilities and services. Councilmember Atkins moved to introduce for first reading by title only, Ordinance No. 89 -662, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 6200 OF THE TEMPLE CITY MUNICIPAL CODE BY ADOPTING BY REFERENCE THE LOS ANGELES SANITARY SEWER AND WASTE ORDI- NANCE AS AMENDED, and set for public hearing on January 2, 1990, seconded by Councilmember Breazeal and unanimously carried. 8. COMMUNICATIONS: NONE 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: NONE RECESS TO CRA: At 7:40 P.M. the City Council met as the Temple City Community Redevelopment Agency; approved the Minutes of the regular meeting of November 21, 1989; adopted Resolution CRA 89 -383 approving the Annual Report; adopted Resolution No. CRA 89 -385 approving agreement between the Agency, Champion Development Company, and Tokai Bank; and adopted Resolution No. CRA 89 -384 allowing claims and demands in the amount of $16,538.75. The Minutes of the Agency are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: NONE 11. MATTERS FROM CITY OFFICIALS: A. CALIFORNIA CONTRACT CITIES, 1990 SACRAMENTO LEGISLATIVE ORIENTATION TOUR (JANUARY 16 -18, 1990) - Councilmember Gillanders moved to approve Councilmembers and City Manager attendance and authorized payment of necessary expenditures, seconded by Councilmember Swain. City Council Minutes, December 5, 1989 - Page 4 Councilmember Breazeal wanted to note that there have been negative remarks made about the sprayings for the Med fly. He feels that we obviously have a substantial agricultural interest in this state to do away with the Med fly. He hopes that a resolution can be adopted at the next City Council meeting supporting the malathion spraying to counteract some of this negative thinking. Councilmember Atkins added that malathion is one of the most common insecticides that has been used for fifty years in our gardens and never thought a thing about it, until now, because a few people have gotten upset over it. He also commented on an article from the San Marino Tribune about San Marino's ordinance on building inspections when they change ownership. He feels that it is a good one and would like to see a draft of it. He asked about the status on the one that Temple City has been working on. Mayor Froehle reminded everyone about the formal lighting of the Christmas tree in Temple City Park at 5:30 P.M., December 9, 1989, and invited all those in the audience to attend. 12. ADJOURNMENT: At 7:45 P.M. it was moved, seconded and unanimously carried to adjourn. The next regular meeting of the City Council to be held on Tuesday, December 19, 1989 at 7:30 P.M. has been can- celled due to a lack of a quorum. MAYOR 1
