MEETING - DECEMBER 17. 1992 The special meeting of the 13a1 Barbour Village Councii was held on Thursday, December 17, 1992 in the Council Chamber of Bal Harbour Village Hall. The meeting was called to order at 5:03 p.m. by Assistant Mayor Hirsch'. The roll was called and those present were: Also Present: Assistant Mayor Andrew R. Hirsch' Councilman Matthew B. Blank Councilman James E. Boggess Councilman Sol M. Taplin Carole S. Morris. Village Manager Jeanette Horton. Village Clerk Richard J. Weiss. Village Attorney Absent: Mayor Estelle Stern As a quorum was determined to be present. the meeting commenced. 2. Ordinance___ Second Readi_na/Publ.ic_ Bearing_ An Ordinance was read by title by the Village Clerk amending Section 1.4 (b) of the Village Charter to allow the election date for Village Elections to be set by the Village Council and providing requisite ballot language. Assistant Mayor Hirsch' then opened the Public Heating. Councilman Boggess explained not only would the normal election date fall on the first day of passoye.r as well as holy week, anG this is the reason for amending the Charter. Councilman Taplin stated if the date is left as April o the Village would lose approximately 30 to 40% of the voters. Mr. Weiss stated that the main reason for the ballot question is to give the Council the power to change the date of the election. Mr. Weiss then proceeded to read the amendment as it would appear on the ballot. There being no further comments, Assistant Mayor Hirsch] closed the. Public Hearing. A motion was offered by Councilman Taplin and seconded by Councilman Blank to enact this Ordinance. The motion carried with the vote as follows: Assistant Mayor Hirsch] aye: Councilman Blank aye; Councilman Boggess: Councilman Taplin aye: Mayor Stern absent: thus; becoming: ORDINANCE NO.380 AN ORDINANCE OF BAL. HARBOUR VILLAGE. FLORIDA AMENDING SECTION 14(b) OF THE VILLAGE CHARTER TO ALLOW ELECTION DATES FOR VILLAGE ELECTIONS TO BE SET BY THE VILLAGE COUNCIL: PROVIDING REQUISITE BALLOT LANGUAGE: PROVIDING FOR SEVERABILITY. 152 INCLUSIUN IN THE CHARTER AND AN FFFECTIVE DATE.. J. Resolution: The Resolution was read by title. by the Village Clerk. calling tot a special election to propose a charter amendment to the Village Charter to allow the Village Elections to be held on a date other than the first Tuesday in April by a majority vote of the Village Council. provides for ballot language. times and places of the balloting and provides for notices. A motion to adopt this Resolution was offered by Councilman Boggess and seconded by Councilman Taplin. Mr. Weiss stated that the Resolution should be amended to reflect the date of the election as February 16. 1993. A motion was offered by Councilman Boggess and seconded by Councilman Taplin to amend the Resolution. The Motion carried with the vote as follows: Assistant Mayor Hirschl aye: Councilman Blank aye: Councilman Boggess aye: Councilman Taplin aye: Mayor Stern absent, and the Resolution was adopted as amended. thus becoming RESOLUTION NO.474 A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA. CALLING A SPECIAL ELECTION TO PROPOSE AN AMENDMENT TO THE VILLAGE CHARTER TO ALLOW VILLAGE ELECTIONS TO BE HELD ON A DATE OTHER THAN THE FIRST TUESDAY IN APRIL BY A MAJORITY VOTE OF THE VILLAGE COUNCIL; PROVIDING FOR REQUISITE LANGUAGE; PROVIDING FOR TIMES AND PLACES OE BALLOTING; PROVIDING FOR NOTICE: PROVIDING FOR AN EFFECTIVE DATE. 4. Other Business: Mr. Sam Poole of the firm Holland and Knight reported to the Council their recommendations that the Village follow since the City of North Miami has passed the ordinance for the North Miami Amphitheater. Mr. Poole referred to his letter dated December l5, 1992 in which he listed the course of action to be taken by the Village. He further stated that the basic strategy outlined is to hold North Miami's feet to the fire with respect to the promised noise studies, to provide a comprehensive evaluation of the environmental issues at the dumpsite. and to ensure that the Department of Community Affairs is fully informed regarding the Development of Regional Impact issue. Councilman Boggess stated the Village must show that Bal Harbour is prepared to pursue this issue. Councilman Taplin stated this issue is very important to the Village and should be prepared to continued if necessary. Assistant Mayor Hirsch] stated the sound that would travel is the primary conr_ein and if the Amphitheater is enclosed from the onset the problem would be solved. Mr. Poole was questioned as to the maximum cost to follow through to the trial court level. Mr. Poole replied the cost would be approximately Special Council Meeting 12/17/92 $60.000. A motion was offered by Councilman Boggess and seconded by Councilman Taplin to proceed with a cap of $60,000 through to the trial court level. The motion carried with the vote as follows: Assistant Mayor Hirschl aye: Councilman Blank aye: Councilman Boggess aye; Councilman Taplin aye: Mayor Stern absent. 5. Adiourn: There being no further business to come before the Council, a motion was offered by Councilman Boggess and seconded by Councilman Taplin to adjourn. The motion carried unanimously (4-0) with Mayor Stern absent. and the meeting adjourned at 6:05 p.m. Assistant Mayor Andrew R.
