Rios, September 20, 20Ci in the absence of Mayor Daniel J. Reiman, Thursday, September 20, 2007, 6:00 P.M., Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: ROLL CALL Councihnember Vincent Bellino " Jorge Diaz Randy Krum " Susan Naples " Ronald G. Rios " Joseph W. Sitarz Council President Rios noted that the Mayor was excused fi•om the meeting this evening. Also noted present was Borough Attorney Robert Bergen and Municipal Clerk, Kathleen M. Barney. The Meeting was opened with a minute of silent prayer and the SILENT PRAYER/ Pledge of Allegiance by Council President Ronald G. Rios. PLEDGE The Clerk stated that on December 27, 2006, the 2007 Annual STATEMENT OF Notice was published in The Home News Tribune, The Star MEETING NOTICE Ledger and posted on the Bulletin Board. 1 SEPTEMBER 20, 2007 MINUTES FOR Upon MMS &C by Councilmembers Sitarz and Knrm and APPROVAL unanimous affirmative vote of the frill Council present, the Minutes of July 26 and August 9 and 23, 2007 were approved. COMMENDATION The conmrendation for Alexandra Lopez will be held off a little because she had to step out for a moment. Agenda Council President Rios then said they would be Amending the Amended Agenda to include an Ordinance for First Reading, explaining that it is a frill funded ordinance for Tax Appeal Defense. Upon MMS &C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the fill Council present, the Agenda was amended to include Ordinance #07 -28. Upon individual roll call vote Councibnembers Bellino, Diaz, Krum, Naples Rios and Sitarz voted in the Affirmative. ORDINANCE #07 -28 ORDINANCE #07 -28 " Appropriating 900,000 for the Payment of Tax Appeals in the Borough of Carteret" "ORDINANCE APPROPRIATING $900,000 FOR THE First Reading PAYMENT OF TAX APPEALS IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY" Council President then said they would now present a COMMENDATION, Re: Commendation to Alexandra Lopez and lie asked her to come Alexandra Lopez forward. Council President Rios then spoke on Mrs. Lopez's history. He explained how she had children from the High School do a skit on the first Council Meeting for the re- dedication of Borough Hall. We also appointed her to our Human Relations Connnittee. He then explained that she is now resigning for personal reasons and they are presenting her with a Mayoral Commendation to show her their appreciation for what she has done for our community. Mrs. Lopez accepted the commendation with much appreciation. Councihnember Naples, spoke, saying that Alexandra Lopez is one of her colleges and her friend commented that she can look back and say she left this a better place. Council President Rios then said they would be taking a five (5) Five (5) Minute minute recess. SEPTEMBER 20, 2007 ORDINANCE #07 -18 Cont: Attorney Bergen said there was going to be one (1) slight amendment to Ordinance 407 -18, where it says executive departments it will be changed to borough departments . Joe Novakowski, Coolidge Avenue, questioned if this ordinance involves the girls from the Board of Health. Council President Rios explained that this is an ordinance that will allow the Mayor or Chief Executive Officer to have an Organizational Chart. It will show who may be in charge of each department in case of a department not having a department head available and who the employees will report to in that particular department as not to have a conflict of different department heads. There being no further continents or objections to the Ordinance, the Council President declared the Public Hearing to be closed upon MMS &C by Councihnembers Sitarz and Krum and unanimous affirmative vote of the frill council present. Joe Novakowski asked if there was a fee for an application for Handicapped Parking before this ordinance. Hearing Closed Council President Rios said there was not and the amount was a "not to exceed." There being no further comments or objections to the Ordinance the Council President declared the Public Hearing to be closed upon MMS &C by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the full Council present. Upon individual roll call vote Councilmembers Bellino, Diaz, Krim, Naples, Rios and Sitarz voted in the Affirmative. Councilmember Sitarz said he did not see anywhere on the ordinance saying you need safety lights on it or cones and then asked if it was for dumpsters. SEPTEMBER 20, 2007 Public Hearing Cont: Council President Rios said it was for pods on property and it is to regulate it so we don't have an abuse of it or have people running businesses out of their fi laws or side yards and it would limit the size. Susan questioned what roads would be included. Council President Rios said lie knew that Monroe Street was on the list and explained that he didn't have the list in front of him but if she gives him her phone number he will call her and let her know. Councilmember Komi explained that the State or the County comes in when we get grants and they designate what roads need to be done frost. He spoke on this briefly. Councilmember Diaz said in the last year they paved sixteen (16) or seventeen (17) streets in Carteret. He suggested the Engineer could give her a schedule. Council President Rios explained that this year there is less monies so there will not be as many streets paved. There being no falluer comments or objections to the Ordinance, the Council President declared the Public Hearing to be closed upon MMS &C by Councihnembers Sitarz and Diaz and unanimous affirmative vote of full Council present. BUSINESS Susan Gaydos Susan Gaydos spoke about traffic lines on the corner of Hermann Street and Oakwood Avenue saying the stop bar was worn out so a new one is needed. Attorney Bergen asked Council President Rios to Amend the Agenda to include Resolution #07 -247, which would authorize the agreement to the lowest bidder for the garbage contract pending the attorney reviewing it, and Resolution #07 -248 which would authorize the Mayor to sign documents for the MCIA Closing. Upon MMS &C by Councihnembers Sitarz and Bellino and unanimous affirmative vote of the fill Council present, the Agenda was Amended to include Resolutions 407 -247 and #07 -248. Council President Rios then asked if any of the Comrcilmembers had any continents or questions on any of the resolutions. Councilmember Bellino referenced 407 -240, explaining that this lighting has been something they have worked on for a long time. Counci President Rios then asked for a motion on the Consent Agenda. COMMITTEES: BUILDINGS & GROUNDS - Committee Chairperson Naples reported that this department has not been engaged in any special projects in the past several weeks. They are just doing routine maintenance. They are ending the summer work and preparing for winter. RESOLUTION #07 -247 "Award of Garbage Bi(r" RESOU)TION #07 -248 "Authorizing Mayor to Execute Agreement with the Middlesex County Improvement Authority for Video Conferencing Equipment" Adopted PAYMENT OF BILLS REPORTS: Departments 15 SEPTEMBER 20, 2007 OhR ITTEES FINANCE & ADMINISTRATION — Committee Chairperson Diaz Cont: reported that the sewer bills were due last week on September 15 " He said there is a thirty (30) day grace period. He said our senior sewer rebate application were due on September 1st and are being processed and our rebates are scheduled to be sent out in October. He said that the tax bills went out in early August and were due on the 28 of this month. Outstanding taxes will be up for a tax sale which is scheduled maybe sometime in December. Our financial audit has been completed and should be released next week. Progress. FIRE & DOMESTIC PREPARDNESS — Conunittee Chairperson Krum said Sergeant Ciarkowski said to apologize to Mrs. Lopez that he missed her getting her commendation. There will be an Open House at the Fire House on October 6' hi the last month the Volunteer Fire and Career Officers to start acting as one (1) Fire Department. They will start training together. Progress. PARKS, RECREATION & PUBLIC PROPERTY — Committee Chairperson Bellino reported they are maintaining the day to day operations in the park and there were many organizations using the park in the last week and the park personnel is trying to stay on top of it. One example was the 911 ceremony. Continued Progress. POLICE- Committee Chairperson Sitarz reported the police car that was in an accident about a month ago should be back on the road sometime next week. There is also discussion on the new police cars we will be getting this year. Progress. PUBLIC WORKS — Committee Chairperson Rios reported the walkways and stop bans are being painted. Faded signs are being changed and if anyone sees one they should contact the Public Works Department. Daily and preventive maintenance work is being done on various vehicles in our fleet and in our public works trucks, the roll off in particular and doing it in house is saving us a lot of money. The catch basins are continued to be cleaned. Progress. 16 SEPTEMBER 20, 200, BOARD OF EDUCATION: Committee Chairperson Naples reported that Carteret Middle School will be up and running on October I" with the 21st Century Grant they received, which is a 1.5 million dollar grant over five (5) years, which was received by the School Board in conjunction with the Mayor and Council. To be a participant in the grant the student has to make a five (5) day conmmitment after school. 300 children will be taken. The five (5) key areas it is addressing is academic remediation and enrichment, cultural and artistic enrichment, positive use development, physical activity and parent and family development. Council President Rios said he had a Proclamation on behalf of the Mayor and then went on to read it aloud: "WHEREAS, Congress defines a prisoner of war as a person who, while serving on active military, naval or air service, is forcibly detained or interned in the line of duty by an enemy government or a hostile force; and WHEREAS, there have been 142,246 reported American Prisoners of War since World War One, and 88, 683 reported Missing in Action since World War Two; and WHEREAS, on July 18, 1979 the first national commemorative ceremony honoring P.O. W's and M.I.A.'s was held at the National Cathedral, Washington, D.C.; and WHEREAS, the 3 d Friday of every September has been set aside to remember and honor the commitments and the sacrifices made by our nation's prisoners of war, and those who are still missing in action; and WHEREAS, National POW/MIA Recognition Day is one of the six days specified by law on which the black POW/MIA flag shall be flown over federal facilities and cemeteries, post offices and military installations, the others being Armed Forces Day, Memorial Day, Flag Day, Independence Day and Veterans Day; COMMITTEES Cont: PROCLAMATION: "National P.O.W. and M.I.A. REIMAN, MAYOR OF THE Cont: BOROUGH OF CARTERET, in the County of Middlesex, State of New Jersey do hereby acknowledge Tomorrow, Friday, September 21 As National P.O.W. and M.I.A. Recognition Day And request that all residents remember the sacrifices made by our military servicemen and servicewomen in the defense of our freedom. FURTHER, I DANIEL J. REIMAN, MAYOR OF THE BOROUGH OF CARTERET , order that the National League of POW /MIA Flag, which first flew over the White House in 1988 on National POW /MIA Recognition Day, be displayed at Memorial Municipal Building in honor of all American P.O.W'S and M.I.A.'s. Council President Council President Rios went on to say that if it wasn't for the Rios Veterans we would not have the fi that we have today and he could not imagine having a loved one being held without their free will on enemy territory by a hostile force or the government. He encouraged us to recognize that day and be thankful for all the sacrifices that all our veterans made on our behalf and pray that we do not have any more casualties in hraq or Afganistan and that they come home safe and sound to their families. Council President Rios went on to say that on the up coming Saturday there is a poker rum ride. It is a fund raiser for Sergeant Eddie Ryan an Iraq veteran that survived casualties and is now having difficulties with medical benefits.
