AU'T'HORIZING THE EXECU'T'ION OF A DEVELOPER'S
AGREEMENT WITH PROLOGIS
WHEREAS, the Borough of Carteret's Board of Adjustment has granted land
development approvals to Port Reading- Carteret, LLC, Port Reading- Woodbridge I,
LLC, Port Reading - Woodbridge II, LLC and/or ProLogis, hrc., referred to herein
collectively as ProLogis, relating to property in the Borough known as Block 267, Lot I
and Block 1, Lot 4, for a warehouse project; and
WHEREAS, the Borough of Carteret ( "Borough ") and ProLogis are desirous of entering
into a formal Developer's Agreement setting forth the Parties respective rights and
responsibilities with regard to the above referenced approval(s).
NOW THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Carteret, County of Middlesex, State of New Jersey as follows:
That the Mayor and Law Director are hereby authorized to negotiate a
formal Developer's Agreement with ProLogis.
2. That the Mayor and appropriate Borough Officials are hereby authorized
to execute said Developer's Agreement in a form acceptable to the Law
Director.
