OPPOSING SENATE BILL S -1137
WHEREAS, Assembly Bill S -1137, as released by the Senate Labor Committee,
seeks to expand the scope of negotiable items under which public union groups
could bargain collectively. Specifically, this far - reaching proposal would require
that all terms and conditions of employment become mandatory subjects for the
bargaining table unless specifically prohibited by State law; and
WHEREAS, tinder the bill, mandatory subjects shall include work to be
performed; compensation and benefits; hours and time of work; employee
transfer; job security and retention; discipline and grievances; contracting;
assignment; and outsourcing; to name a few; and
WHEREAS, S -1137 would re -define the New Jersey Public Employee Relations
Commission (PERC) law by adding new mandatory subjects. PERC is statutorily
empowered to determine the scope of negotiations and decides whether an issue is
prohibited, mandatory or permissive; and
WHEREAS, this bill could not come at a worse time as we are all presently
grappling with a fiscal crisis in our State; we seriously question the wisdom of
advancing this legislation at this time; and
WHEREAS, time New Jersey League of Municipalities opposes S -1137 because it
will severely impair the ability of municipalities to manage their employees; it
will increase the time and cost of negotiations. Prolonged negotiations over a
greater number of subjects emdd lead to further dispute. Such dispute could
potentially result in litigation. And, not to be overlooked, S -1137 advances
potential encroachment by the unions.
WHEREAS, the New Jersey League of Municipalities strongly opposes A -1667
as released and has requested that all of its members to go on record similarly
opposing the same.
( NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Borough of Carteret hereby opposes Senate Bill
S -1137 as released by the Senate Labor Committee.
2. That a copy of this Resolution be forwarded to Carteret's New Jersey
Senate and Assembly delegation, time Senate Labor Committee and to
the New Jersey League of Municipalities.
