HomeMy Public PortalAboutr 08:128f i Poahifiou No. 08-128 Date of Adoptio M, 22. 2 008 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT WITH CNIE ASSOCIATES, RE: PROFESSIONAL ENVIRONMENTAL ENGINEERING SERVICES WHEREAS, the Borough of Carteret is in need of professional enviromnenal engineering services for the Carteret DPW Project; and WHEREAS, CME Associates, 1460 Route 9 South, Howell, New Jersey 07731, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $24,400.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that fiords are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for professional environmental engineering services for the Carteret DPW Project at a total cost not to exceed $24,400.00 is hereby approved. 2. That this professional services contract is hereby approved contingent upon the Borough's receipt of the HDSRF Funds. 3. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) awarded pursuant to the Borough's Fair and Open Process as authorized by law. 4. A copy of this Resolution be forwarded to the Borough's Purchasing Department and CME Associates. Adopted this 22 " day of May, 2008 and certified as a true copy of the original on May 23, 2008. As you know, the removal of contaminated soil due to the previous abandonment of the 5/1 UST systems at the Borough Department of Public Works site has been completed for sometime now. Due to escrow funding no longer being available, we have been unable to complete the groundwater monitoring, remedial action report and classification exception proposal for NJDEP submission. As such, we are pleased to have the opportunity to present our proposal for professional engineering and environmental engineering services for the above - referenced project. As you are aware, our office has provided professional engineering services for the field observation of site construction, contract administration for the remediation work performed by T. Slack Environmental Services, Inc., and the preparation of support documents for the remediation work as required by the NJDEP. As requested, CME Associates has prepared the following scope of work and cost estimate for environmental engineering services required to complete the remedial action phase tasks at the Carteret DPW site. In March 2007, the remedial action for contaminated soil was implemented in accordance with the RAW. T. Slack Environmental Services, Inc. was retained through an open bidding process to conduct the work, and CME Associates provided field oversight. Contaminated soil was excavated to clean limits in AOC -1 and AOC- 3 /AOC- 5, and the excavations were backfilled with clean fill. In May 2007, the first of two rounds of post - remedial groundwater samples was collected. Scope of Work The tasks required in order to complete the remedial action phase of the project and comply with the NJDEP NOV requirements are outlined as follows. Task 1: Groundwater Monitoring In the RAW that was submitted to the NJDEP, two (2) rounds of post - remedial groundwater sampling were proposed. The initial round was conducted in May 2007, and one additional round of sampling remains. CME Associates will sample each of the eight (8) onsite wells. The samples will be collected in accordance with the NJDEP Field Sampling Procedures Manual (August 2005). All samples will be delivered to a New Jersey certified laboratory for analysis of potential contaminants. Samples from AOC -1 will be analyzed for volatile (VO +10) and semi - volatile (BN +15) organic compounds. Samples from AOC- 3 /AOC -5 will be analyzed for lead and VO +10, including MTBE and TBA. The post - remedial groundwater sampling results will be included in the Remedial Action Report (Task 2) for submittal to the NJDEP case manager. Task 2: Remedial Action Report ICON /CME will prepare a Remedial Action Report (RAR) in accordance with the Technical Requirements for Site Remediation (NJAC 7:26E -6.7). The report will include a summary of contamination in each area of concern, a description of the completed remedial activities, the results of post- excavation sampling and a comparison to the remedial goals, and a description of site restoration. Post - remedial groundwater sampling results will also be included in the RAR. Appropriate documentation for sealing of old wells, installation of new monitoring wells, offsite transport of waste material, and importation of clean fill will be provided in the report. The report will include as -built drawings delineating the extent of soil excavation and backfill. Task 3: Groundwater Classification Exception Area Proposal Although the excavation of remaining contaminated soil in AOC -1 and AOC- 3 /AOC -5 removed an ongoing source of groundwater contamination, it may take some time until PROMA 600-014-14-08 CJ Mayor Daniel Reiman Re: Proposal for Professional Engineering and Environmental Engineering Services for The Carteret DPW Project April 14, 2008 Proposal No. 2008 -049 HCA00500 -01 Page 3 the concentrations of groundwater contaminants attenuate to compliance levels. The July 15, 2004 NJDEP letter and the June 28, 2005 Notice of Violation indicate that a Classification Exception Area (CEA) proposal should be submitted to the Department if groundwater contamination remains at the site. A CEA is an institutional control established as part of a remedial action for groundwater at a contaminated site, and serves to provide notice that the groundwater does not meet the groundwater quality standards (NJAC 7:9C) in a localized area. The designated uses of water from the contaminated aquifer will thereby be restricted. If the post - remedial monitoring indicates that groundwater contamination remains at the site, then a CEA proposal in accordance with NJAC 7:26E -8.3 will be prepared and submitted to the NJDEP. This task will include field tests, analysis, and reporting as needed to prepare the proposal and determine the duration (expiration date) and boundaries of the CEA. Please note that quarterly groundwater monitoring and reporting is typically required as a condition of a CEA, and is not included in this scope of services (see Limitations below). Budget Estimate The estimated budget to complete the scope of work outlined above is $24,400 as outlined in the following table. Task Description Cost Task 1: Groundwater Monitoring $6,900 Task 2: Remedial Action Report $8,000 - Task 3: CEA Proposal $9,500 GRAND TOTAL $24,400 Limitations Based on NJDEP review of the remedial action report, additional tasks not included in this scope of work and budget may be required to obtain a No Further Action determination for the areas of concern. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon writing. • The above - quoted fees will be in effect for a period of twelve (12) months from the date of this proposal; however, the fees on the hourly rate schedule are subject to change by-January 1 of each year.
