HomeMy Public PortalAbout1993-02-08 Special Meeting1.6g COUNCIL MINUTES SPECIAL JOINT WORKSHOP SESSION FEBRUARY 8, 1993 The special joint workshop session between the Bal Harbour Village Council and the City of North Miami Council was held on Monday, February 8, 1993 in the Council Chamber at North Miami City Hall. The meeting was called to order at 12:15 p.m. by Mayor Colodny of the City of North Miami. Mayor Colodny then turned the meeting over to Mr. Wolpin, City Attorney of North Miami, who then introduced those present: City of North Miami Mayor Mike Colodny Councilwoman Jeanette Carr Councilman Howard Premer Councilman David Caserta Larry Casey, City Manager Simon Bloom, City Clerk Dr. Clifford Bragdon, Noise Consultant Bal Harbour Village Mayor Estelle Stern Assistant Mayor Andrew R. Hirschl Councilman Matthew B. Blank Councilman James E. Boggess Carole Sherouse Morris, Village Manager Jeanette Horton, Village Clerk Sam Poole, Attorney Dr. Stanley Dunn, Noise Consultant Mr. Wolpin stated that this session is a follow up to the January 26 North Miami Council Meeting discussion on the amphitheater issue. He further stated that progress has been made between the joint councils and staff, toward the focus on the difference of the two communities. Mr. Wolpin invited the Bal Harbour Village Council to work with the City of North Miami on each step of the noise study that will be performed by Dr. Bragdon. He continued then to review what has transpired to date, referring to the ordinance that was passed by the City of North Miami on December 8, 1992. He stated that this ordinance has built in safeguards as to noise. Dr. Bragdon reviewed his proposed work plan outline, step by step, that will be conducted by him for the City of North Miami. Dr. Dunn will also be working with Dr. Bragdon. It was decided that two members of each Council accompany Dr. Bragdon on his field trips and that the cities that are chosen are similar to Bal Harbour as far as water and high rise conditions. All agreed that the educational workshop on sound which was tentatively scheduled between April 15 and May 1, 1993, should be held before the field trips are taken. It was recommended by Councilman Premer that if the two noise consultants could not agree, then a third scientist in this field will be asked for his recommendation. 17 U Bal Harbour agreed not to continue with a law suit at this time but the City of North Miami does recognize that Bal Harbour Village may file a Verified Compliant under the procedures of Chapter 163 of the Florida State Statute. The members of the North Miami Council agreed. It was agreed by both Councils that Mr. Poole and Mr. Wolpin write a Resolution to be signed by both municipalities in which the Resolution will convey the agreements of this workshop such as if a technical disagreement should arise between Dr Bragdon and Dr. Dunn it will be resolved by a third independent scientist mutually selected; that Bal Harbour Village will not file any litigation against the City of North Miami at this time but does reserve the right to file a verified complaint; that two members of each Council work with the consultants on the noise study.
