HomeMy Public PortalAboutResolutions-2022-096Tiffin/436989/Urban Revite Amend MINUTES OF MEETING TO SET HEARING DATE ON PROPOSED AMENDMENT TO REVITALIZATION PLAN 436989 Tiffin, Iowa December 20, 2022 A meeting of the City Council of the City of Tiffin, Iowa was held at 7p.m., at the City Hall Council Chambers, in the City, on December 20, 2022. The Mayor presided and the roll was called, showing members present and absent as follows: Present: Limkemann, Schnedler, Orris, Olney, Havens. Absent: None. The City Council took up and considered a proposed amendment to the revitalization plan for the Villages Part I Urban Revitalization Area in the City of Tiffin, Iowa. Whereupon, Council Member Havens moved the adoption of the resolution declaring necessity and providing for notice of hearing on proposed amendment to the revitalization plan for the Villages Part I Urban Revitalization Area. The motion was seconded by Council Member Limkemann, and passed by record vote as follows: Ayes: Havens, Limkemann, Orris, Olney, Schnedler. Nays: None. Whereupon, the Mayor declared the resolution adopted as follows: -1- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA Tiffin/436989/Urban Revite Amend RESOLUTION NO. 2022-096 Resolution Providing for Notice of Hearing on Proposed Amendment to the Revitalization Plan for the Villages Part I Urban Revitalization Area WHEREAS, pursuant to the provisions of Chapter 404 (the "Act") of the Code of Iowa the City of Tiffin, Iowa (the "City"), has designated certain real property situated within the City as the Villages Part I Urban Revitalization Area (the "Urban Revitalization Area") and has adopted the Villages Part I Urban Revitalization Plan (the "Plan") for such Urban Revitalization Area; and WHEREAS, it has been proposed that the Plan be amended to clarify that the availability for tax exemption under the Plan is for residential properties containing three or more dwelling units and assessed as residential property under Section 441.21, subsection 14, paragraph "a", subparagraph (6) of the Code of Iowa; and WHEREAS, pursuant to the provisions of the Act, before amending the Plan, the City must prepare an amended plan, hold a public hearing thereon, and otherwise comply with the procedures set forth in the Act; and WHEREAS, an amendment to the Plan (the "Plan Amendment") has been prepared for presentation to the City Council for consideration in accordance with the provisions of the Act, said Plan Amendment to have the contents substantially as set forth in Exhibit A attached hereto and by this reference made a part hereof; NOW, THEREFORE, BE IT RESOLVED by the City Council of Tiffin, Iowa, as follows: Section 1. It is hereby found and determined that the Plan Amendment attached hereto as Exhibit A has been prepared in accordance with the provisions of the Act. Section 2. This City Council will meet at 7:00 p.m., on January 3, 2023, at the Tiffin City Council Chambers, 300 Railroad Street, in the City, at which time and place it will conduct a public hearing on the Plan Amendment, pursuant to the Act. Section 3. The City Clerk is hereby authorized and directed to give notice as required by the provisions of the Act of such hearing by publication once, in a newspaper published at least once weekly and having general circulation in the City, not less than seven and not more than twenty days before the date on which the hearing will be held. Section 4. Such notice shall be in the form substantially, as follows: -2- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA Tiffin/436989/Urban Revite Amend NOTICE OF PUBLIC HEARING OF THE CITY COUNCIL OF TIFFIN, IOWA, RELATING TO THE ADOPTION OF AN AMENDMENT TO THE PLAN FOR THE VILLAGES PART I URBAN REVITALIZATION AREA FOR THE CITY OF TIFFIN, IOWA, PURSUANT TO CHAPTER 404 OF THE CODE OF IOWA NOTICE IS HEREBY GIVEN: That there is now on file for public inspection in the office of the City Clerk of Tiffin, Iowa, an Amendment to the Urban Revitalization Plan for the Villages Part I Urban Revitalization Area within the City. This City Council will meet at 7:00 p.m., on January 3, 2023, at the Tiffin City Council Chambers, 300 Railroad Street, Tiffin, Iowa, at which time a hearing will be held pursuant to the provisions of Chapter 404 (the "Act") of the Code of Iowa on the proposal to adopt the Amendment to the Urban Revitalization Plan, pursuant to the provisions of the Act. At such public hearing all residents of the City, and any other person having an interest in the matter, may appear and be heard for or against the adoption of the Amendment to the Urban Revitalization Plan, pursuant to the Act. The Amendment to the Urban Revitalization Plan will clarify that the availability for tax exemption under the Urban Revitalization Plan is for residential properties containing three or more dwelling units and assessed as residential property under Section 441.21, subsection 14, paragraph "a", subparagraph (6) of the Code of Iowa. Section F of the Plan is hereby amended to read as follows: F. ELIGIBLE IMPROVEMENTS AND EXEMPTIONS for the Villages Residential Improvements (Multifamily). The construction of new residential facilities and the rehabilitation of and additions to residential facilities if such residential facilities contain three or more separate dwelling units.
