MINUTES OF THE MEETING
REGULAR COUNCIL MEETING JUNE 18, 2012
CALL TO ORDER
The Regular Council Meeting of June 18, 2012, was convened at 6:00 P.M. by Mayor
Eric Struemph.
ROLL CALL
The following Council Members were present for the roll call:
Present: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Scrivner, and
Weber
Absent: *Carroll (arrived at 6:10 P.M.) and Schulte
A quorum was declared present.
Mayor Struemph stated that he notices a Boy Scout in the audience and asked him to
stand and introduce himself and state the badges he is trying to achieve. The Scout was
from Troop 11 and is working toward receiving his Citizenship in the Community badge.
MISCELLANEOUS AGENDA ITEMS
There were no miscellaneous items brought forward at this time.
PUBLIC HEARINGS
a. Amending Zoning Code Pertaining to Land Uses
A staff presentation was made by Planning and Protective Services Department
Director Janice McMillan. Following her presentation, the following persons came
forward to speak on the issue:
In Favor
Mr. Leonard Steinman stated he is in favor due to the new category for dog day care
facilities.
There being no one else coming forward to speak, Mayor Struemph declared the
evidentiary portion of the public hearing concluded, and announced that the Council will
now take up the associated pending bill 2012 -30.

b. Amending Zoning Code Pertaining to Standards and Modifications to Off - Street
Parking Requirements
A staff presentation was made by Planning and Protective Services Department
Director Janice McMillan. Following her presentation, no one came forward to speak on
the issue.
Mayor Struemph declared the evidentiary portion of the public hearing concluded, and
announced that the Council will now take up the associated pending bill 2012 -31.

Mayor Struemph announced that the following minutes and reports have been received
and are on file for review in the City Clerk's office:

Mayor Struemph thanked the citizens who volunteer their time and expertise on these
boards and commissions.

COUNCIL COMMITTEE REPORTS
Administration Committee - Councilwoman Carrie Carroll announced that the next
meeting would be Wednesday, June 27 at 8:00 A.M.
Finance Committee - Councilman Ralph Bray announced that the June 26 meeting
was canceled, and that there would be a special meeting held instead on Thursday
morning, June 28, immediately following the 7:30 A.M. Brown Bagel meeting.
Public Safety Committee - Councilman Bryan Pope reported the June 28 meeting was
canceled and has not yet been rescheduled.
Public Works & Planning Committee - Councilman Bob Scrivner announced that the
next meeting will be held on Thursday, June 21 at 7:30 A.M.
Other Committee and Liaison Reports - There were no other reports given at this
time.

Third -term appointments: A motion was made by Councilman Bryan Pope, seconded
by Councilman Larry Henry, to approve the appointments of Jeff Ahlers, Garry Taylor,
Marty Miller, and Steve Duncan to third terms. The motion was approved unanimously
by the following roll -call vote:

Weber
Nay: None
Other Appointments: A motion was made by Councilman Rick Mihalevich, seconded
by Councilman Rick Prather, to approve the remainder of the appointments. The motion

PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS
City Counselor Drew Hilpert made a brief presentation explaining how the City is
legally obligated to follow state laws regarding the issue of texting while driving. At the
conclusion of his presentation, Councilwoman Carrie Carroll asked for clarification
regarding City employees, to which Mr. Hilpert and Human Resources Director Gail
Strope answered that City employees are prohibited from texting while driving any City
vehicle.

ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
The following announcements were made by City Staff and Council:
Salute to America 4th of July Event: Nathan Nickolaus gave the dates and brief details
of this year's planned fireworks display.
Introduction of Summer Interns was made by Gail Strope. Each intern introduced
himself / herself and stated where they were attending school, and in which City
department they will working this summer.
Animal Shelter Ribbon Cutting Ceremony was announced by Michelle Gleba. It will
be held on Friday, June 22 at 10:00 A.M. and the public is invited to attend.
Special Council Work Session to be held on Thursday morning, June 28, immediately
following the 7:30 a.m. Brown Bagel Work Session to discuss Revenue Projections was
announced by City Administrator Nathan Nickolaus.
Citizens' Committee for Fire Department Improvement Plan Campaign Kick -off
event at 11:00 a.m. on Monday, July 2 at Fire Station No. 1 was announced by
Councilman Bryan Pope.

A motion was made by Councilman Bob Weber for approval of the Consent Agenda as
presented, seconded by Councilman Bryan Pope, and approved unanimously.

Substitute Bill 2012 -28 which was previously distributed to the Council, a motion was
made by Councilman Bob Weber to accept the Substitute Bill, seconded by Councilman
Bryan Pope, and approved unanimously by the following roll -call vote:

PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS
Mr. Leonard Steinman made a presentation regarding the issue of dogs brought into
the community from other communities which may have a history of being vicious in
those other communities.
Mr. Dan Massie made a presentation regarding Missouri River access limits because of
the railroad. Following his presentation, he answered questions by the Council.
COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY
Councilman Bryan Pope asked why there was no access to the Missouri River on the
south side of the river after the railroad was built. City Administrator Nathan Nickolaus

gave a description of the history of this issue, and stated that there are currently
discussions ongoing with the railroad regarding this issue.
NEW BUSINESS
Councilman Bob Scrivner asked questions about the fire improvement plan and how it
would affect the current property tax if it passed. City Counselor Drew Hilpert stated he
would research the answer to Councilman Scrivner's question and send that information
to the Council.

There was no unfinished business brought forward.

A motion was made by Councilman Bob Weber for adjournment, seconded by Bob
Scrivner, and approved unanimously at 7:50 P.M.
