A RESOLUTION OF THE VILLAGE COT]NCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, CONFIRMING
EMERGENCY EXPENDITURES RELATING TO THE
NOVEL CORONAVIRUS/COVID-19; PROVIDING FOR
RATIFICATION; AND PROVIDING FOR AN EFFECTIVE
DATE.
WIIEREAS, the Novel Coronavirus Disease 2019 ("COVID-l9") is a severe acute
respiratory illness that can spread among humans through respiratory transmission and presents
symptoms similar to those of influenza; and
WHEREAS, COVID-l9 poses a public health risk to residents of the Village of Key
Biscayne (the "Village"), particularly elderly residents; and
WHEREAS, on March 1,2020, Florida Governor Ron Desantis issued Executive Order
No. 20-51 directing the Florida Department of Health to issue a Public Health Emergency; and
WHEREAS, on March9,2020, a State of Emergency was declared by Florida Governor
Ron DeSantis and by Miami-Dade County Mayor Carlos Gimenez on March 12,2020; and
WHEREAS, on March 13,2020, the Village Manager issued a Declaration of State of
Emergency concerning COVID-l9 (the "Declaration") and subsequently issued various
emergency orders to mitigate and slow the spread of COVID-19 within the Village; and
WHEREAS, on April7,2020, the Village Council approved Resolution No. 2020-21
confirming the Declaration and emergency expenditures and actions taken by the Village
Manager and rati$ring any action or emergency order issued by the Village Manager to protect
the public from COVID-l9; and
WHEREAS, on April28,2020, the Village Council approved Resolution No. 2020-23
confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratifying the emergency orders issued since the adoption
of Resoluti on 2020 -2I ; and
WHEREAS, on May 19, 2020, the Village Council approved Resolution No. 2020-35
confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and rati$zing the emergency orders issued since the adoption
of Resoluti on 2020 -23 ; and
WHEREAS, on June 9, 2020, the Village Council approved Resolution No. 2020-40
confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratifying the emergency orders issued since the adoption
of Resoluti on 2020 -3 5 ; and
WHEREAS, on August25,2020, the Village Council approved Resolution No.2020-47
confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratifuing the emergency orders issued since the adoption
of Resoluti on 2020 -40 ; and
WHEREAS, on October 13, 2020, the Village Council approved Resolution No. 2020-
55 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratifying the emergency orders issued since the adoption
of Resoluti on 2020-47 ; and
WHEREAS, on October 27,2020, the Village Council approved Resolution No. 2020-
56 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratifying the emergency orders issued since the adoption
of Resoluti on 2020 -5 5 ; and

WHEREAS, on November 17,2020, the Village Council approved Resolution No. 2020-
61 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and rati$ring the emergency orders issued since the adoption
of Resoluti on 2020 -5 6; and
WHEREAS, on December 08, 2020, the Village Council approved Resolution No. 2020-
65 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-l9 and ratifying the emergency orders issued since the adoption
of Resoluti on 2020 -6I ; and
WHEREAS, on January 12,202I, the Village Council approved Resolution No. 2021-
01 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and ratiffing the emergency orders issued since the adoption
of Resoluti on 2020 -6 5 ; and
WHEREAS, on January 26,2021, the Village Council approved Resolution No. 2021-
05 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-l9 and ratifzing the emergency orders issued since the adoption
of Resoluti on 202I -0 I ; and
WHEREAS, on February 9,2021, the Village Council approved Resolution No. 2021-
07 confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-l9 and rati$iing the emergency orders issued since the adoption
of Resoluti on 202I -05 ; and
WHEREAS, on February 23,202I, the Village Council approved Resolution No. 2021-
10 confirming additional emergency expenditures and actions taken by the Village Manager to

protect the public from COVID-19 and rati$ring the emergency orders issued since the adoption
of Resoluti on 202I -07 ; and
WHEREAS, on March 9,202I, the Village Council approved Resolution No. 2021-12
confirming additional emergency expenditures and actions taken by the Village Manager to
protect the public from COVID-19 and rati$'ing the emergency orders issued since the adoption
of Resoluti on 202I - I0 ; and
WHEREAS, in an effort to continue mitigating and slowing the spread of COVID-l9
within the Village, the Village Manager has issued additional emergency orders; and
WHEREAS, the Village Council desires to confirm any additional emergency
expenditures and actions taken by the Village Manager to protect the public from COVID-19 and
ratify the emergency orders issued since the adoption of Resolution No. 2021-12; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That the above recitals are true and correct and incorporated
herein by this reference.
Section 2.Confirming Expenditures. That, in accordance with Section 9-5 of the
Village Code, the Village Council hereby confirms any additional emergency expenditures and
actions taken by the Village Manager relating to the Declaration to protect the public from COVID-
19, as fuither provided in the Village Manager's staff report supporting this Resolution.

Section 3. Ratification. That the Village Council hereby ratifies and approves any
action or emergency order issued since the adoption of Resolution No. 2021-12 by the Village
Managerto protect the public from COVID-I9.
Secfion 4. Effective Date. This Resolution shall take effect immediately upon
adoption.
