HomeMy Public PortalAbout201208201 REGULAR COUNCIL MEETING, AUGUST 20, 2012 CALL TO ORDER The Regular Council Meeting of August 20, 2012, was convened at 6:00 P.M. by Mayor Eric Struemph. ROLL CALL The following Council Members were present for the roll call: Present: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Absent: None A quorum was declared present. MISCELLANEOUS AGENDA ITEMS Mayor Struemph asked for a moment of silence in memory of Mr. Kevin Meinhardt who passed away. Mr. Meinhardt has served on various volunteer Boards and Commissions and Mayor Struemph stated his appreciation for that service to our community. PUBLIC HEARINGS a. Rezoning 0.5 Acres at 2715 Portabello Place Drive, and Associated Comprehensive Plan Amendment Janice McMillan, Director of Planning and Protective Services, made a presentation of the background and proposed rezoning request. No one present came forward to speak on the issue. Mayor Eric Struemph declared the public hearing concluded, and announced that the Council will now take up the associated pending bill. Bill 2012 -48, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 0.50 ACRES FROM C -O OFFICE COMMERCIAL TO RA -1 HIGH DENSITY RESIDENTIAL, FOR LAND ADDRESSED AS 2715 PORTABELLO PLACE DRIVE, 2 REGULAR COUNCIL MEETING, AUGUST 20, 2012 DESCRIBED AS LOT 30 OF CREEKSIDE PARK SUBDIVISION, SECTION TWO, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2012 -48 was read third time by title, placed on final passage, and passed by the following roll -call vote as Ordinance 15000: Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None Rezoning 1.17 Acres in 1400 Block of Creek Trail Drive, and Associated Comprehensive Plan Amendment Following a presentation by Janice McMillan, no one present came forward to speak on the issue. Bill 2012 -49 was read third time by title, placed on final passage, and passed by the following roll -call vote as Ordinance 15001: Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None MINUTES AND REPORTS RECEIVED AND FILED Mayor Struemph announced that the following minutes and reports have been received and are on file for review in the City Clerk's office: a. Planning and Zoning Commission, July 12, 2012 b. CAMPO Technical Committee, June 7, 2012 3 REGULAR COUNCIL MEETING, AUGUST 20, 2012 c. Storm Water Quality Advisory Committee, July 5, 2012 d. Animal Control Section Monthly Report for July, 2012 e. Public Safety Committee, May 17, 2012 Mayor Struemph thanked the citizens who volunteer their time and expertise on these boards and commissions. COUNCIL COMMITTEE REPORTS Administration Committee - Councilwoman Carrie Carroll announced that the next meeting would be Wednesday, August 22 at 8:00 A.M. Finance Committee - Councilman Shawn Schulte announced that next Budget Committee meetings are scheduled for August 28, and August 30, at 5:30 P.M. in the Boone - Bancroft Room. Public Safety Committee - Councilman Bryan Pope reported the next meeting will be held on Thursday, August 30, immediately following the 7:30 A.M. Brown Bagel Work Session. Public Works & Planning Committee - Councilman Bob Scrivner announced that the next meeting will be held on Thursday, August 23 at 7:30 A.M. Other Committee and Liaison Reports — There were no liaison reports given at this time. APPOINTMENTS BY THE MAYOR There were no appointments brought forward at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS No presentations were made. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF There were no announcements made at this time. 4 REGULAR COUNCIL MEETING, AUGUST 20, 2012 CONSENT AGENDA The following items were brought before the Council for approval by consent: a. Minutes of City Council Meetings: August 2, August 6, and August 10, 2012 b. Minutes of Budget Committee Meetings: August 9, 2012 c. Permissive Use of Right -of -Way: 630 Broadway Street A motion was made by Councilman Shawn Schulte for approval of the Consent Agenda as presented, seconded by Councilman Bill Luebbert, and approved unanimously. BIDS OVER $50,000 There were no bids over $50,000 presented to the Council at this time. BILLS INTRODUCED Bill 2012 -53, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH TWS, INC. TO CONSTRUCT THE ALGOA TREATMENT FACILITY CONTRACT A - BIOSOLIDS REMOVAL. Bill 2012 -54, sponsored by Councilman Pope, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT AMENDMENT WITH PECKHAM AND WRIGHT ARCHITECTS, INC., FOR ARCHITECTURAL SERVICES FOR THE NEW FIRE STATION NO. 3 Several questions were asked, and discussion held, regarding this bill. Bill 2012 -55, sponsored by Councilman Mihalevich, entitled: AN ORDINANCE CHANGING, AMENDING, AND MODIFYING THE ZONING CODE OF THE CITY OF JEFFERSON, MISSOURI, BY MODIFYING SPECIFIC USE STANDARDS FOR OUTDOOR STORAGE AND DISPLAY. 5 REGULAR COUNCIL MEETING, AUGUST 20, 2012 Bill 2012 -56, sponsored by Councilman Mihalevich, entitled: AN ORDINANCE AUTHORIZING A BUDGET ADJUSTMENT TO THE 2011 -2012 BUDGET OF THE CITY OF JEFFERSON, MISSOURI, BY RECOGNIZING THE RECEIPT OF FUNDS FROM MODOT, AND TRANSFERRNG THE FUNDS WITHIN THE TRANSIT BUDGET FOR VEHICLE REPAIRS. Bill 2012 -51, sponsored by Councilman Mihalevich, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401, SCHEDULE (J), (PARKING PROHIBITED), SUBPARAGRAPH (A), (STREETS AND HIGHWAYS), OF THE CODE OF THE CITY OF JEFFERSON, PERTAINING TO TRIBECA CIRCLE, LOCATED IN TRIBECA VILLAGE SUBDIVISION. Councilman Mihalevich requested that Bill 2012 -51 be placed on the Informal Calendar at this time. Bill 2012 -52, sponsored by Councilman Schulte, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A BUDGET AND PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR THE PERIOD OF NOVEMBER 1, 2012, TO OCTOBER 31, 2013, AND APPROPRIATING MONEY IN THE CITY TREASURY TO PAY THE COST OF OPERATING THE CITY GOVERNMENT DURING THAT PERIOD IN ACCORDANCE WITH THE BUDGET. Councilman Schulte requested that Bill 2012 -52 be placed on the Informal Calendar at this time. INFORMAL CALENDAR There were no bills on the Informal Calendar for consideration. RESOLUTIONS 7 REGULAR COUNCIL MEETING, AUGUST 20, 2012 There were no resolutions presented. SCHEDULED REPORTS There were no reports scheduled for this time. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS Councilwoman Carroll brought up the issue of persistent code violations in her ward, as well as in some other wards, and that she believed the Council and the staff are working on solutions to the issue, and she commended the various departments who have worked for so many years on one specific location in the 4th Ward. COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY No comments were made. NEW BUSINESS Councilwoman Carroll noted that Melva Fast will be leaving the City's employment on August 24, and wished her well in her new endeavors. UNFINISHED BUSINESS There was no unfinished business brought forward. APPROVAL OF CLOSED SESSION MINUTES A motion was made by Councilman Weber to approve the August 6, 2012 Closed Session minutes, seconded by Councilman Scrivner, and approved unanimously. ADJOURNMENT A motion for adjournment was made by Councilman Schulte, seconded by Councilman Scrivner, and approved unanimously at 6:44 p.m.
