Craig Britton, General Manager Contact person: Same as above Regional Open Space MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-05-73 Meeting 05-16 July 13, 2005 AGENDA ITEM 2 AGENDA ITEM Authorization to Execute a Contract with Donald Hays T ail Co actor, Inc. for Construction of Ridgetop Trail at Pulgas Ridge Open Space Preserve IN GENERAL MANAGER'S RECOMMENDATION Authorize the General Manager to execute a contract with Donald Hays Trail Contractor, Inc. of Tahoe City, CA for the bid amount of$119,716.80, plus a contingency amount of up to $17,957.52, for a total amount not to exceed $137,674.32 for the construction of Ridgetop Trail that includes the installation of two pedestrian footbridges at Pulgas Ridge Open Space Preserve. DISCUSSION At your June 1, 2005 meeting, you authorized staff to solicit bids for the construction of Ridgetop Trail at Pulgas Ridge Open Space Preserve (see Report R-05-57). The project includes the construction of a 2.4-mile hiking trail with three (3) culverts, three (3) rocked fords, retaining walls and the installation of two (2) pre-manufactured pedestrian bridges, similar to those installed at El Corte de Madera Creek and Purisima Creek Redwoods Open Space Preserves (see Exhibit A). Using construction costs from previous trail projects, staff estimated that construction of Ridgetop Trail would cost approximately $120,000. Two pre-bid meetings were held at the project site on June 21 and June 24, 2005 that were attended by interested licensed contractors. Sealed bids were due on July 5, 2005 and three bids were received, summarized as follows: Bidder Location Total Bid Percent Difference from Cost Estimate I. Donald Hays Trail Contractor, Inc. Having reviewed the bidders' qualifications and the Bid Proposal, staff recommends awarding the contract to Donald Hays Trail Contractor, R-05-73 Page 2 Inc. (DHTC), the lowest responsive and responsible bidder. DHTC has over thirty years of specialized professional experience in trail construction and has completed numerous projects in Colorado, Oregon, Idaho, and California. DHTC's most recently completed trail projects in the Bay area were for the Cities of Saratoga and Santa Cruz and the Alameda County Resource Conservation District. DHTC is also a member of the Professional Trailbuilders Association (formerly the Western Trailbuilders Association). Founded in 1976, the Professional Trailbuilders Association is North America's largest private sector group of trail specialists, professional trail contractors, designers, and consultants. The Bid Proposal includes sufficient equipment and labor to construct the project as described above. The contingency allowance of$17,957.52 is fifteen percent (15%) of the bid and is expected to cover the cost of any additional services determined to be necessary by the District that are not identified in the original scope of work for this contract. Staff recommends that the amount of funding required for these potential additions be authorized on a"not-to-exceed" basis. Staff anticipates the project will be completed by late-October 2005 as San Mateo County and Department of Fish and Game regulations prohibit grading activities between October 15 and i P g April 15. FUNDING At your March 23, 2005 meeting, you adopted the fiscal year 2005-2006 budget that included j $304,903 to complete the Pulgas Ridge Public Access Improvements which consists of the new parking and staging area and the three new trails. Staff estimates that the allocated budget will be sufficient to fund the construction of this trail. PUBLIC NOTIFICATION Notification of this project will be posted on the District's website and signs will be installed on site at Pulgas Ridge Open Space Preserve to inform the public of the impending construction activities. However, no trail closures are anticipated during construction. CE A COMPLIANCE At the August 13, 2003 meeting, the Board approved the Mitigated Negative Declaration and Mitigation Monitoring Program for the Pulgas Ridge Trail Construction Project. DISCUSSION Year Two of the El Corte de Madera Creek Watershed Protection Program is underway. On March 23, 2005, the Board approved the Planning Department budget for Fiscal Year 2005-2006, which included $250,000 for sedimentation reduction and erosion control work El Corte de Madera Creek Open Space Preserve (see Report R-05-38). The project budget included funds for equipment rental to perform trail upgrades by in-house Operations field staff. District staff obtained written estimates from three heavy equipment rental companies in April 2005. Companies were asked to provide daily, weekly, and monthly rental rates for different types of equipment. Cresco Rentals provided the best rates for four pieces of equipment (tractor, excavator, water truck and compactor), and Hertz Equipment Rentals provided the best rate for a loader. The District currently has rental agreements with both companies. In order to maximize cost savings to the District, staff recommends that the District continue renting the loader equipment from Hertz Equipment Rentals for a total amount not to exceed $13,500, an amount for which the General Manager is authorized to approve. Additionally, staff recommends that the Board authorize execution of a contract with Cresco Rentals for a total amount not to exceed $71,600 for the remainder of the heavy equipment rental. DISCUSSION At your March 23, 2005 meeting, as part of your approval of the 2005/2006 Fiscal Year budget, you approved two additional Ranger positions to be budgeted as of January 1, 2006. At that time, the District was in the process of recruiting for an existing, but vacant Ranger position. That recruitment resulted in locating two highly qualified candidates. One candidate has been hired and began employment with the District on July 6, 2005. Recruitments for Ranger positions are lengthy, highly competitive and very intensive. In recent years, the number of qualified candidates for this position has been somewhat limited because of those factors. Since we have a second qualified candidate, ready and looking forward to working with the District, and we currently have two Rangers on prolonged limited duty, staff recommends that the Board authorize making an offer to the second candidate with an estimated start date of August 15, 2005, The fiscal impact on salaries and benefits of hiring another Ranger in August 2005 versus January 2006 is approximately $23,000. We anticipate salary savings in the Operations Department to cover this additional cost; however, in the event there is insufficient budget balance in the salary and benefit category at mid-year, staff would propose the necessary adjustment at that time. In summer of 2005, Reilly Dibner, a graduate student at the Yale School of Forestry,will be conducting a study on red- legged frog habitat on MROSD preserves. Ms. Dibner will be specifically identifying any upland features which correlate with the presence of red-legged frog, and particularly with successful breeding of this frog. Although much is known about aquatic features that support red-legged frog, there is little information about the influence of upland landscape features surrounding red-legged frog ponds. The structure of upland vegetation may be important because it could provide escape cover from predators and it could shade ponds to maintain cooler temperatures. Vegetation further away from the edge of the pond may influence the movement of red-legged frogs. In the summer, adults often disperse during their summer/dry season dormancy from the breeding ponds to various aquatic and upland habitats, including small mammal burrows and moist leaf letter,. During wet weather, some individuals may cross upland habitat to access other breeding sites. Ms. Dibner's research may contribute to the overall knowledge of red-legged frog habitat requirements and may assist MROSD in identifying what actions should be taken to protect and improve red-legged frog habitat on District preserves. Ms. Dibner obtained all her own grant funding to support her summer research. The 238-acre Stevens Canyon Ranch encompasses hillsides, meadows, and forested canyons in the Santa Clara County foothills west of Saratoga. Tucked back in Stevens Creek Canyon, yet readily accessible from the urban Midpeninsula, Stevens Canyon Ranch lies at the heart of over 6,630 acres of public land in Stevens Creek watershed. The property's strategic location north of Stevens Canyon Road between Monte Bello and Saratoga Gap Open Space Preserve and Stevens Creek Count Park makes it an ideal "gateway" site for public Y staging area. It will provide access to the upper part of the Stevens Creek corridor and to the regional trail system linking the Bay Area Ridge Trail with the San Francisco Bay Trail. The property's outstanding recreational natural a and cultural resource 1 s also will make it an attractive destination in itself. Therese Kollerer, Erfert Fenton, and Jenny Whitman will continue to be mailed notification of Master Plan workshops and opportunities for involvement in the process along with over 3,000 other residents. I am pleased to saythat both Ms. Kollerer and Ms. Fenton joined the docent-led hiking tour of Bear Creek J g Redwoods conducted earlier this month to familiarize Master Plan participants with the areas not currently open to the public. The Sierra Azul and Bear Creek Redwoods Master Plan effort has been widely publicized. In addition to mailing more than 3,000 color brochures about the Master Plan and first public workshop to the community, a press release was sent to all local newspapers and a separate page dedicated to the Master Plan, including links to related reports, maps and an on-line survey was added to the District's web site. We very much support this project but are unable to grant the Water District access to the District's lands for this purpose at this time. We are pleased that the Water District is considering the District's offer for conveyance of a p ermanent easement and a contractual agreement whereby the Water District assumes all responsibility for any contaminants identified or encountered within this easement area. We reiterate that the District is unwilling to accept liability arising through implementation of the Water District's project on District lands, which include this most recent proposal. I am pleased to see that the county and Half Moon Bay Fire Protection District are taking actions to protect the life and property of residents on this road. My concern is that it took 2 fires with incorrect reporting to start this action. It seems to me that the county and fire districts'response is reactive rather than preventive. I would hope that it won't take loss of response time to an emergency on any of the following roads which have other roads with the same or similar names to consider changing their names: Miramontes, Purisima, Verde(1-3,)Lobitos Creek, Bear Gulch(no longer continuous). There are probably others. One of the factors which reduced response time to the last fire on Purisima Creek Road was that numerous cars were parked illegally on the roadway of Purisima Creek Road. One of the fire fighters on the scene told me"we barely made it through"and my neighbors,who suffered this loss,said they were also told by one of the chiefs that this condition slowed response time. This was not a one time occurence. The location of the parked cars is near the entrance to the Purisima Creek Redwoods open space preserve(more or less where Purisima Creek Road and Higgins meet. The parking lot for this facility is not adequate,as evidenced by the number of cars parked on the roadway. I have counted over 20 on numerous occasions. This condition occurs pretty much any nice day on the weekends or during the week in the summertime. These parked cars are in violation of the state motor vehicle code 22504a. They are also in violation of 902.2.2.1 and 902.2.4.2 of the California Fire Code. Why are these codes not being enforced? This situation is not only a threat to the life and property of residents,but also to the numerous cyclists, pedestrians,and equestrians who have to share the stretch of road(wide enough for 1 car with vehicles parked on the roadway)with cars coming in two directions. In June of 20031 notified the board of P )Y 9 directors of Mid-peninsula Regional Open Space District in writing regarding this parking issue. I have received no reply, nor have I seen any acknowledgment or action to rectify the problem other than them putting a"no parking" sign in their lot at a parking space adjacent to their access road. 1 respectfully request that the appropriate agency take action to eliminate the illegal parking and urge the MROSD to enlarge their lot or shut down this entrance. Rectified Countywide GIS Mapping Data, consisting of: • Parcels — area features of current assessors tax parcels, excluding air-parcels and personal property(mobile homes, boats, etc) • Street Centerlines — line features fully populated with street names, address ranges, and county road numbers. ■ Right-of-Ways — line features representing the public right-of-way, and in some cases the private roads of the county • Street Name Annotation — text features depicting street name for cartographic use • Address Annotation—text features depicting address for cartographic use Color Digital Orthophotography Digital orthophotography will be comprised of a set of approximately 680 files conforming to the County's Grid system and existing numbering scheme. Each file will cover 3000' (horizontal) x 2000' (vertical), and will be in color with 3" pixel resolution in tiles deemed "urban" and 6" resolution in tiles deemed "rural". There will be two formats, uncompressed TIFF/TFW and compressed SID/SDW i.e. two complete sets in each format will be prepared. Two different horizontal accuracies will be flown. All urbanized areas along the coast, and on the San Francisco Bay east of Skyline Boulevard will adhere to 1" = 100' horizontal accuracy standards. The central and southern areas of the county within the Crystal Springs watershed and Regional Open Space areas will adhere to 1" = 200' scale horizontal accuracy standards. This is due to the density of tree cover and rural nature of these areas. These measures translate to approximately 2—2 '/and 4-5 feet of horizontal error. Anecdotally, these specifications are sufficient to identify manhole covers, with 0.7' precision, or to identify new construction monuments, and to measure (COGO)their position to within 1:36000 or about 1.25 feet in 3,000. Vertical accuracy will be sufficient to support 2-foot contours. A Digital Elevation Model (DEM) will be provided in digital format and with sufficient density to support 2 foot contours. The DEM can and will be used to create a variety of 3-dimensional products. Rectified Countywide GIS Mapping Data Once the digital orthophotography is available the countywide GIS basemap will be adjusted to fit this new, more precise image base. The intent of the rectification process is to use the imagery and all available record sources on targeted areas to position the basemap so that it will never require further adjustment on this grand of a scale. Incidentally, it is the need to avoid this basemap rectification in the future that drives the need to procure the most precise imagery possible. The target accuracy of basemap will be 2 feet horizontal. This specification has two intended stipulations. First, 2 feet will be the most that any lot line or right-of-way (ROW) line is allowed to diverge from the complimentary physical feature identified on the orthophotography. For example, a lot line should be within 2 feet of its corresponding fence line. Second, lot width and depth and ROW width should not exceed 2 feet from the reported distance from available record data. Created by voters more than 30 years ago,the District successfully manages approximately 50,000 acres of public open space land in San Mateo, Santa Clara and Santa Cruz Counties. The proposed project is located immediately northeast to the District's Long Ridge Open Space Preserve and in the vicinity of other protected open space lands. The District requests that you accept comments on this proposed project as the County did not notify the District of the proposed Negative Declaration even though the District owns a parcel directly bordering the proposed project parcel. The District is highly concerned with the proposed project and the nature by which the County has proposed to address adherence to the California Environmental Quality Act through the segmented analysis of impacts for each phase of the proposed project. This error is clearly detailed within the project description which reads; "This grading permit project involves only the first phase of a proposed 3-phase master plan." As each phase of the proposed project will require a permit from the County and accompanying CEQA review, impacts from the entire project must be reviewed cumulatively and cannot be reviewed in segments. In addition to the scope and content of environmental review proposed,we would like to bring to your attention other issues that should be analyzed with respect to open space and environmental resources. We have serious concerns about the following: Conformance with the General Plan The proposed project is in direct conflict with the goals of the Open Space and Conservation Element of the County's General Plan. Numerous chemicals are used in growing vineyards and in wine production and bottling.The potential impact of the use and disposal of chemicals in the vineyards including pesticides,herbicides, fertilizers and other toxic substances,and the use and disposal of chemicals in the winemaking operation must be analyzed. Cultural Resources The Santa Cruz Mountains have a rich history of Native American villages, Spanish exploration, and early American settlements associated with the California Gold Rush.The project must be evaluated for its potential impact on archaeological sites,Native American burial sites, and historic structures. Public Services The project will demand public services including, emergency medical services, fire suppression services, utilities, and water.The potential impact of the project on the level of these services must be analyzed. Recreation The potential impact of the project on the historic recreational use of property must be analyzed. Vegetation and Wildlife The project site provides significant habitat for a variety of plant and animal species. The potential impa ct of the project on the conversion of the natural landscape and destruction of the present ecosystem must be analyzed including,but not limited to: tree removal,barriers to connectivity of wildlife corridors, sedimentation in creeks affecting fisheries. Steelhead trout are present within Peters Creek,with the last survey identifying the presence of juvenile salmonids in 1996(California Department of Fish and Game Stream Inventory Report for Peters Creek). Additionally,Pescadero Creek is identified as providing potential habitat for Coho salmon,a species whose listing status under the Federal Endangered Species Act was recently raised from Threatened to Endangered. Run-off from the project site travels underneath State Highway 35 through a culvert and drains into the District's Long Ridge Open Space Preserve and Peters Creek. Any potent ial impacts to steelhead trout or Coho salmon, such as exist with this project, requires mandatory consultation with the regulatory agencies. Traffic and Circulation The impact of the proposed project on traffic volumes, safe access to public roadways,and parking demand must be analyzed. Hydrology and Water Quality The impact of the proposed project on the water quality of the Pescadero Creek Watershed and any potential impacts to water quality and availability to downstream water users resulting from site clearing, alteration of the natural landscape, vineyards, development and operation of a winery, development and use of roads on-site must be analyzed.Potential impacts on the water rights of neighbors must be analyzed. A primary responsiblity for my new job will be to staff the effort by the County to establish and fund a countywide park and recreation district. So I won't be leaving the field, just working on things from a different angle. I look forward to continuing to work with all of you in my new capacity. I 've had a great 12 years with the Bay Area Open Space Council, and thank all of you who have done so much to make the Council a success. The Executive Committee will be meeting within the next few weeks to start the process for finding my successor. This will then be reviewed by the full Council at the regular meeting scheduled for Thursday, July 21st, from 10 am to 1 pm. All of my contact information will remain the same for now.
