HomeMy Public PortalAbout201302191 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 CALL TO ORDER The Regular Council Meeting of February 19, 2013, was convened at 6:00 P.M. by President Pro Tempore Bob Weber in the absence of Mayor Eric Struemph. ROLL CALL The following Council Members were present for the roll call: Present: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Absent: Carroll A quorum was declared present. MISCELLANEOUS AGENDA ITEMS Communications Manager Michelle Gleba made a presentation of a proclamation in honor of Black History Month, regarding former Jefferson City resident, Cathay Williams, the only known and documented female Buffalo Soldier who served during the Civil War. Present to accept the proclamation were members of Lincoln University's R.O.T.C., Cadet LaShundra Taliaferro and Cadet DeVonte L. Drummer. Cadet Taliaferro made comments regarding her own experience with Lincoln University's R.O.T.C. program, and thanked the City for honoring Cathay Williams and her outstanding contribution to the history of both the City and Lincoln University. Jefferson City Police Captain Robert Cynova announced the following new hires to the Police Department, and introduced Mr. Starr who was at tonight's meeting: 1. Charlie St. Onge, Communications Operator (unable to attend tonight's meeting) 2. Ethan Starr, Animal Control Officer, was introduced, and welcomed to the Department by President Pro Tempore Weber. PUBLIC HEARINGS No public hearings were scheduled for this meeting. 2 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 MINUTES AND REPORTS RECEIVED AND FILED President Pro Tempore Weber announced that the following minutes and reports have been received and are on file for review in the City Clerk's office: a. Public Safety Committee, November 1, 2012 b. CAMPO Technical Committee, January 3, 2013 c. Police Personnel Board, January 3, 2013 d. Historic Preservation Commission, November 13, 2012 and January 8, 2013 e. Board of Adjustment, January 8, 2013 COUNCIL COMMITTEE REPORTS Administration Committee — Councilman Larry Henry made an announcement in Councilwoman Carroll's absence that the next meeting would be held Wednesday, February 27, at 8:00 A.M. Finance Committee - Councilman Shawn Schulte announced that next Finance Committee meeting is scheduled for Tuesday, February 26, at 7:30 A.M. Public Safety Committee — Councilman Larry Henry announced that the next meeting will be Thursday, February 28, immediately following the Brown Bagel work session. Public Works & Planning Committee — Councilman Bob Scrivner announced that the next meeting will be held on Thursday, February 21, at 7:30 A.M. Other Committee and Liaison Reports — Councilman Larry Henry reminded citizens of the February 28 fund raiser event hosted by JCTV and encouraged the community to support their efforts. APPOINTMENTS BY THE MAYOR There were no appointments recommended at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS 3 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF City Administrator Nathan Nickolaus reminded the Council of the next Special Council Meeting Closed Session to discuss Conference Center proposals will be held at 4:00 P.M. on Thursday, February 21. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS There were no presentations made at this time. CONSENT AGENDA The following items were brought before the Council for approval by consent: a. Minutes of City Council Meetings: January 31 and February 4, 2013 A motion was made by Councilman Bob Scrivner for approval of the Consent Agenda as presented, seconded by Councilman Rick Prather, and approved unanimously. BIDS OVER $50,000 There were no bids over $50,000 presented at this time. BILLS INTRODUCED There were no bills introduced at this time. BILLS PENDING 2012 -135, sponsored by Councilwoman Carroll, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, SUBMITTING A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF JEFFERSON TO ALLOW ELECTIONS IN FEBRUARY AND ALL OTHER DATES ALLOWED IN MISSOURI STATUTES. Bill 2012 -135 was read third time by title and placed on final passage. 4 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 Councilman Ralph Bray stated that the sponsor of this bill, Councilwoman Carrie Carroll, has indicated her wish to place this bill, as well as 2012 -136, on the informal calendar. However, since she is absence tonight, City Counselor Hilpert has advised that to accomplish Councilwoman Carroll's wish in her absence will require a motion, second, and vote by at least six (6) Council Members. Councilman Bray moved to place Bill 2012 -135 on the Informal Calendar at this time, seconded by Councilman Shawn Schulte, and approved unanimously. 2012 -136, sponsored by Councilwoman Carroll, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, SUBMITTING A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF JEFFERSON TO A VOTE OF THE CITIZENS OF THE CITY OF JEFFERSON TO ELIMINATE PRIMARY ELECTIONS. Bill 2012 -136 was read third time by title and placed on final passage. Councilman Bray made a motion to place Bill 2012 -136 on the Informal Calendar, seconded by Councilman Shawn Schulte, and approved unanimously. 2012 -137, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A PARKING LEASE AGREEMENT WITH WELCOME INN AGAIN, LLC, FOR THE LEASE OF THE PARKING LOT KNOWN AS LOT 31. Bill 2012 -137 was read third time by title and placed on final passage. Following discussion, Councilman Pope made a motion that the contract be amended to disallow any subleasing on the lot which is the subject of this contract, seconded by Councilman Bob Scrivner, and approved unanimously. Bill 2012 -137 was then passed, as amended, by the following roll -call vote as Ordinance 15081: Aye: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 2012 -138, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING THE RIGHT -OF -WAY ON MORRIS AVENUE AND ELIZABETH STREET. 5 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 Bill 2012 -138 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 15082: Aye: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 2012 -139, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401, (MOTOR VEHICLES AND TRAFFIC), SCHEDULE (W), (SNOW ROUTES), OF THE CODE OF THE CITY OF JEFFERSON, PERTAINING TO VARIOUS STREETS IN JEFFERSON CITY. Need to accept substitute Bill 2012 -139 was read third time by title, placed on final passage and passed, as previously substituted at the February 4, 2013 Council Meeting, by the following roll -call vote as Ordinance 15083: Aye: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 2012 -140, sponsored by Councilman Bray, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY REVISING THE DOWNTOWN PARKING ACCOMMODATION PROGRAM. Bill 2012 -141 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 15085: Aye: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber 6 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 Nay: None 2012 -142, sponsored by Councilwoman Carroll, entitled: AN ORDINANCE AMENDING THE 2012 -2013 BUDGET (APPENDIX A — PERSONNEL SCHEDULE) OF THE CITY OF JEFFERSON, MISSOURI, BY COMBINING AUTHORIZED POSITIONS WITHIN THE DEPARTMENT OF PUBLIC WORKS, ENGINEERING DIVISION. Bill 2012 -142 was read third time by title and placed on final passage. Discussion was held regarding the specifics related to this ordinance as it would affect the budget. At the conclusion of the discussion, Bill 2012 -142 was passed by the following roll -call vote as Ordinance 15086: Aye: Bray, Henry, Luebbert, Mihalevich, Prather, Scrivner, and Weber Nay: Pope and Schulte 2012 -143, sponsored by Councilman Weber, Co- sponsored by Councilwoman Carrie Carroll, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE BY COMBINING THE POSITIONS OF DIRECTOR OF FINANCE AND DIRECTOR OF INFORMATION SERVICES INTO THE POSITION OF ASSISTANT CITY ADMINISTRATOR. Councilman Bob Weber stated he is withdrawing this bill at this time. He stated he would like to send the bill back through a Committee and also allow for public input into the issue. INFORMAL CALENDAR There were no items on the Informal Calendar. RESOLUTIONS There were no resolutions at this time. SCHEDULED REPORTS There were no reports scheduled for this time. 7 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS Mr. Richard Groner made a presentation regarding the City's policy recently enacted regarding abandoned buildings. He stated he disagrees with the fee assessed by the City on such properties. COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY Questions were asked of staff regarding the ordinance to which Mr. Groner referred in his presentation. City Administrator Nathan Nickolaus and Planning and Protective Services Director Janice McMillan answered the questions. NEW BUSINESS No New Business was brought forward. UNFINISHED BUSINESS Councilman Scrivner stated he would like to encourage the Council to continue to consider the reorganization proposed by Bill 2012 -143 withdrawn tonight as beneficial to the City irrespective of the process by which it was brought before the Council. APPROVAL OF CLOSED SESSION MINUTES A motion was made by Councilman Bill Luebbert to approve the February 11, 2013, Closed Session Minutes as presented, seconded by Councilman Bob Scrivner, and approved by the following roll -call vote: Aye: Bray, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 8 REGULAR COUNCIL MEETING, FEBRUARY 19, 2013 ADJOURNMENT A motion to adjourn was made by Councilman Rick Prather, seconded by Councilman Bob Scrivner, and approved unanimously at 7:10 P.M.
