HomeMy Public PortalAboutr 11-06398001 lion of the 1I0znijg4 of (Garterd, �q, T- No. 1 Date of Adoption %Lrl1 24. 2M RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, REFERRING PROPOSED AMENDMENTS TO THE REDEVELOPMENT PLAN FOR THE MIDDLESEX AVENUE REDEVELOPMENT AREA TO THE PLANNING BOARD FOR REVIEW WHEREAS, on August 11, 2005, the Borough Council (the "Borough Council ") of ;h of Carteret (the `Borough "), following the recommendation of the Borough Plann (the "Planning Board "), adopted resolution number 05 -246, designating the proper ed as Block 242, Lots 1, 2, 3 and 5 on the tax map of the Borough (the "Redevelopm as an "area in need of redevelopment' under the Local Redevelopment and Housing L. t. 40A:12A -I et seq. (the "Redevelopment Law"); and WHEREAS, on December 15, 2005, the Borough Council, pursuant to Section 7 of lopment Law (N.J.S.A. 40A:12A -7) and based on the recommendation of the Plann adopted ordinance number 05 -62, approving and adopting a redevelopment plan, da r 4, 2005, for the Middlesex Avenue Redevelopment Area (the "Redevelopment Plat WHEREAS, February 21, 2008, the Borough Council adopted ordinance number ng and adopting certain amendments to the Redevelopment Plan; and WHEREAS, the Borough has caused to be prepared additional amendments to the lopment Plan, which amendments are attached hereto as Exhibit A (the "Proposed ments ");and WHEREAS, the Borough Council desires to refer the Proposed Amendments to the Planning Board for review and recommendation in accordance with N.J.S.A. 40A:12A -7e, after which the Planning Board is to prepare a report regarding its recommendations as to the Proposed Amendments within 45 days as required by N.J.S.A. 40A: 12A-7c. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. The aforementioned recitals are incorporated herein as though fully set forth at length. 2. Pursuant to N.J.S.A. 40A:12A -7e, the Borough Council hereby refers the Proposed Amendments to the Planning Board for review. The Planning Board is directed to prepare a report regarding its recommendations as to the Proposed Amendments and submit same to the Borough Council within 45 days as required by the Redevelopment Law. Amend Section 3.1 (Approach), to add the following text: "The plan also seeks to create opportunities for larger scale retail facilities and warehouse facilities on properties oriented toward the Peter Sica Industrial Highway." 2. Amend Section 3.2 (Plan Interpretation), to add the following text: "7) Provide an opportunity for warehouse and retail facilities along Peter Sica Industrial Highway that will be consistent and compatible with existing warehouse /distribution facilities along this roadway. 3. Amend Section 3.3 (Purpose and Intent) to amend Subsection E to read as follows: "E. To create land use and building requirements specific to the Redevelopment Area that will promote the development of a desirable residential neighborhood with mixed - use commercial uses along Roosevelt Avenue that blends in and compliments the surrounding community, while allowing for warehouse and small to moderate scale retail uses that are compatible with and complement existing industrial uses located along Peter Sica Industrial Highway;" 4. Amend Table 2 in Section 3.5 (Permitted Uses), to add the following uses: Table 2 Permitted Principal Uses Middlesex Avenue Redevelopment Area 6. Food -grade and freezer warehouse facilities.' 7. Retail sales (strip center). 8. Convenience store with accessory gasoline service station. 5. Amend Table 2 in Section 3.5 (Permitted Principal Uses), to add the following notes to Table 2: "3 Food grade and freezer warehouse facilities shall only be permitted on lots with frontage on Peter Sica Industrial Highway. 4 Retail sales uses in strip centers shall only be permitted on lots with frontage on Peter Sica Industrial Highway. 5 Convenience stores with accessory gasoline service stations shall only be permitted on lots with frontage on Peter Sica Industrial Highway." 13030 -066 472066 -1
