SUBJECT: HARDSHIP REQUEST FOR ANNUAL OVERNIGHT PARKING PERMIT
APPLICATION AT 6037 AGNES AVENUE
RECOMMENDATION:
The Transportation and Public Safety Commission is requested to consider a hardship
request regarding an annual overnight parking permit application at 6037 Agnes Avenue.
BACKGROUND:
On December 10, 2018, Dano Hillard applied for an annual overnight parking permit for
his vehicle registered and parked at 6037 Agnes Avenue. The application stated that
there are three vehicles registered and parked at the address and only two available on-
site parking spaces.
2. On December 10, 2018, staff determined that the property at 6037 Agnes Avenue is not
eligible for an annual permit because there are only three vehicles registered at the
address and more than three available off-street parking spaces, contrary to the two
spaces shown on the application.
3. On December 31, 2018, property owner Vance Ho submitted a hardship request asking
that the permit be approved due to a hardship on the property. The Temple City
Municipal Code (TCMC) provides that an applicant may make a hardship request when
the applicant "does not meet the criteria for an annual overnight parking permit or is
requesting an exemption from the criteria."
4. On January 2, 2019, the Community Development Director reviewed the application and
hardship request to determine whether the permit application was properly denied. The
Director reaffirmed the decision to deny the permit.
5. On January 7, 2019, applicant Dano Hillard submitted an appeal asking the
Transportation and Public Safety Commission to review the hardship request and
approve the parking permit application,

NALYSISa
TCMC Sections 3-3A-20 through 3-3A-29 provide the requirements for permits to park on
public streets between the hours of 2:00 AM and 5:00 AM. One of the criteria required for
approval of a permit is that there must be more vehicles registered at the address than
available on-site parking spaces. For the purposes of making this determination, parking
spaces Include "any parking stalls, garages, carports, driveways and other areas designated
for vehicle parking." Otherwise available parking spaces may not be used for storage,
occupied by Inoperative vehicles, or otherwise used for any purpose other than parking a
vehicle that Is registered to the address.
Over the past couple of years, staff has received complaints that some residents have abused
the system by falsifying the number of available parking spaces and using their garages for
storage. To address this concern, staff is now verifying the actual number of available parking
spaces for all single-family homes before a permit is Issued. When determining the number
of available on-site parking spaces, staff looks only at the dimensions of the garage, driveway,
and other available parking areas. The need for storage space or convenience of the
occupants due to the need to shuffle vehicles Is not considered since the TCMC does not
provide an allowance for these purposes.
For driveways, staff generally considers one parking space to be available for every 20 linear
feet of driveway, based on the standard parking stall size of 18 feet and allowing some extra
space for stacking. The location of gates is considered If It would affect the ability to park cars
and operate the gate. In some cases, driveways may be too narrow along the side of a house
to feasibly park a car and open the doors. Such cases are considered on a case-by-case
basis through the review process.
Many applicants are understandably upset because of the Inconvenience Involved when they
learn they are Ineligible for a permit because driveways are counted as available on-site
spaces. With multiple cars stacked in a driveway and blocking access to the garage, cars
must often be shuffled around when residents have different schedules. However, the TCMC
does not include convenience as one of the factors for issuing a permit and clearly states that
driveways are considered part of the on-site parking supply.
The property at 6037 Agnes Avenue was determined to have five available off-street parking
spaces, including a one -car garage, one parking space behind a gate, and three parking
spaces in front of the gate, The applicant Is not disputing the number of spaces identified, but
rather requesting that the Commission find that a hardship exists due to 'limited access to
move other vehicles due to work schedules." While the TCMC does not provide any guidance
as to what is considered a hardship, staff believes that inconvenience caused by vehicle
stacking does not constitute a hardship since the situation is common throughout the City and
is not a unique circumstance related to an individual situation.

I, Vance Ho, currently have three tenants living at 6037 Agnes Ave. Temple City, CA, The driveway and
garage can accommodate this number of residents. However, my tenants have very different work
schedules which are represented below,
• Resident 1: Nazo Wahab, Psychologist (normal working hours)
• Resident 2: Yasmin Wahab, Flight Attendant (unpredictable hours, which includes up early, back
home late hours)
• Resident 3: Dano Nllllard, Biomedical Engineer (variable hours, with frequent late nights), needs
overnight parking permit.
Because of the disparate hours In the tenants, they need one street parking permit to warl<
around the complex parking situation, We would greatly appreciate your careful consideration
