SUMMARY STATEMENT:
In the Fourth Amendment to the Development Agreement for the Alpine Village Planned Unit Development dated October 21, 2010 (recorded December 9, 2010), Alpine Village agreed to construct
a Regional Stormwater Best Management Practices Facility. Alpine Village has constructed the Facility on the City property located along the City bike path behind City Hall. The City
has agreed to accept the project.
The Stormwater Use Agreement outlines the terms of the Facility. Alpine Village will be entitled to discharge its stormwater into the Facility, and City agrees to accept that stormwater
discharge for management and treatment. City is responsible for the operation and maintenance of the Facility and the City may discharge its own stormwater or the stormwater of other
properties, into the Facility so long as sufficient capacity is reserved for stormwater discharged from the entire Alpine Village Planned Unit Development. The agreement also states
that the City agrees that it will not discontinue operation of the Facility, except and unless City provides an alternative means for acceptance and treatment of the stormwater discharge.
The Stormwater Use Agreement has been reviewed by the City Attorney and Alpine Village has agreed to sign the agreement. The Stormwater Use Agreement and the Fourth Amendment to the
Development Agreement are attached.
RECOMMENDED ACTION:
Approve the Alpine Village Stormwater Use Agreement and authorize the Mayor to sign all necessary documents.
