After the meeting, it was discovered that the amendment should have been the Sixth Amendment to the development agreement instead of the Fifth Amendment. The contents of the agreement have not been changed. Here is the timeline for the Alpine Village development agreement and associated amendments: Original Development Agreement in December 2007 outlined the requirements for water and sewer system improvement, roads, stormwater, parks and snow removal, community housing, utilizes, and financial guarantees. The First Amendment to the Development Agreement eliminates the Community Housing Plan. The Second Amendment to Development Agreement memorialized and established the Phasing Plan for the development of the PUD. The Third Amendment to the Development Agreement extended the deadline for the submittal of Phase 2 Final Plat submission. The Fourth Amendment to Development Agreement outlines the construction of the regional BMP, the allocation of the costs of construction, and a completion timeline of December 31, 2011. The Fifth Amendment to Development Agreement modifies the Phasing Plan. The Sixth Amendment to Development Agreement extends the deadline for the construction of the regional BMP and requires Alpine Village to receive final acceptance from the City by September 30, 2012.  RECOMMENDED ACTION: Approve the Sixth Amendment to the Development Agreement for Alpine Village SUB-06-07 and authorize the Mayor to sign all related documents.
