At the November 19, 2009 Council meeting staff presented a suggested ordinance change. Council instructed staff to change the proposed ordinance to allow more flexibility for the Parks and Recreation Director to implement the ordinance change allowing pets in parks. At the December 17, 2009 a second ordinance with changes requested by the City Council was presented to the Council for approval. The Council added a “sunset clause” to the ordinance requiring a review of the ordinance on December 31, 2011. Staff missed the deadline for Council to reauthorize the ordinance prior to that date. Therefore, to keep the the amended sections of Title 8, Chapter 14, Section 4, from reverting back to the code that was in effect prior to the adoption of Ordinance 871, a new ordinance has been prepared for Council’s adoption making the amended sections permanent. During the summer of 2010 and continuing through 2012 there have been few problems with allowing dogs in Fairway Park, Legacy Park and Brown Park. The majority of dog owners have been responsible with controlling their dogs and with cleaning up after them. The only issue we have had has been with dogs on the beaches. With the establishment of a dog swim area north of the marina this problem has lessened. Attached are the proposed Ordinance and Ordinance Summary. The Ordinance has been reviewed by the City’s Attorney. Staff recommends adoption of the proposed ordinance.  RECOMMENDED ACTION: Suspend the rules, read by title only, one time only Ordinance No.____, amending Title 8. Adopt Ordinance No._____, amending Title 8, approve the publication of the summary, and authorize the Mayor to sign all necessary documents.
