SUMMARY STATEMENT:
Since 2010 the City has had an Agreement with No Late Payments/NXGen which allows utility customers to pay on-line with a credit or debit card. Those customers pay a 4% convenience fee,
which goes entirely to No Late Payments/NXGen. The January 26, 2010 Transaction Processing Agreement is attached.
The Recreation Fund would like to add on-line payment as an option for recreation program registrants (see AB12-95). No Late Payments/NXGen can provide that service to the City by adding
an additional payment portal to allow for collection of recreation fees separate from on-line utility payments. No Late Payments/NXGen has changed their fee structure since the original
agreement was signed in 2010 making it necessary to add a pricing addendum. They now charge a monthly customer service fee of $25.00 for up to two payment portals.
Additionally, the attached Pricing/Contract Update Addendum revises Sections 4.2 and 6.0 of the January 26, 2010 agreement to bring them into conformance with the Idaho Constitution.
RECOMMENDED ACTION:
Approve the No Late Payments/NXGen Pricing/Contract Update Addendum and authorize the Mayor to sign all necessary documents.
