HomeMy Public PortalAbout20111121REGULAR COUNCIL MEETING NOVEMBER 21, 2011 1 CALL TO ORDER The Regular Council Meeting of November 21, 2011, was convened at 6:00 P.M. by Mayor Eric Struemph. ROLL CALL The following Council Members were present for the roll call: Present: Bray, Griffith, Harvey, Koon, Luebbert, Pope, Schulte, Scrivner, and Weber Absent: *Carroll A quorum was declared present. MISCELLANEOUS AGENDA ITEMS There were no miscellaneous items brought forward. PUBLIC HEARINGS (a) Rezoning 0.12 Acres of Land at 1015 E. Atchison Street from RD to PUD (b) Amended Final PUD Plan for Property Addressed as 1015 E. Atchison Street A staff presentation was made by Janice McMillan on combined Public Hearing Items (a) and (b). Following her presentation, no one came forward to speak in favor of, or opposition to, the proposed rezoning or the Amended Final PUD Plan. Mayor Eric Struemph declared the evidentiary portion of the public hearing concluded and announced that the Council will now take up the associated pending bills. Bill 2011 -104, sponsored by Councilman Schulte, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 0.14 ACRES OF PROPERTY LOCATED AT 1015 EAST REGULAR COUNCIL MEETING NOVEMBER 21, 2011 2 ATCHISON STREET FROM RD MEDIUM DENSITY RESIDENTIAL TO PUD PLANNED UNIT DEVELOPMENT, IN THE CITY OF JEFFERSON, COLE COUNTY, MISSOURI. Bill 2011 -104 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 14886: Aye: Bray, Griffith, Harvey, Koon, Luebbert, Pope, Schulte, Scrivner, and Weber Nay: None Bill 2011 -105, sponsored by Councilman Schulte, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING AN AMENDED FINAL PUD PLAN FOR PROPERTY LOCATED AT 1015 EAST ATCHISON STREET; DESCRIBED AS PART OF OUTLOT 60, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2011 -105 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 14887: Aye: Bray, Griffith, Harvey, Koon, Luebbert, Pope, Schulte, Scrivner, and Weber Nay: None *Councilwoman Carrie Carroll arrived at this point in the meeting (6:05 P.M.) (c) Rezoning 1.33 Acres of Land at 1002 Myrtle Avenue from RA -2 to PUD (d) Preliminary and Final PUD Plan for Property Addressed as 1002 Myrtle Avenue A staff presentation was made by Janice McMillan on combined Public Hearing Items (c) and (d). Following her presentation, the following persons came forward to speak: IN FAVOR: Mr. Allen Pollack, Director of the Jefferson City Housing Authority, stated he did not really have testimony to bring forward, but offered to answer any questions the City Council may have on the matter since it pertains to Housing Authority property. There were no questions for Mr. Pollack. No one came forward to speak in opposition to either the rezoning or the Preliminary and Final PUD Plan. Country Club Drive (Schulte) A staff presentation was made by Janice McMillan on combined the Amended Final PUD Plan. Following her presentation, no one came forward to speak on the issue. Bill 2011 -108, sponsored by Councilman Schulte, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING AN AMENDED FINAL PUD PLAN FOR PROPERTY LOCATED AT 925 SOUTH COUNTRY CLUB DRIVE; DESCRIBED AS PART OF THE SOUTHEAST QUARTER OF SECTION 8, TOWNSHIP 44 NORTH, RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2011 -108 was read third time by title, placed on final passage and passed by the following roll -call vote as Ordinance 14890: Aye: Bray, Carroll, Griffith, Harvey, Koon, Luebbert, Pope, Schulte, Scrivner, and Weber Nay: None REGULAR COUNCIL MEETING NOVEMBER 21, 2011 4 MINUTES AND REPORTS RECEIVED AND FILED Mayor Eric Struemph announced that the following minutes and reports have been received and are on file for review in the City Clerk's office: a. Board of Adjustment, October 11 and October 25, 2011 b. CAMPO Technical Committee, September 1, 2011 c. Historic Preservation Commission, October 11, 2011 d. Council Committee on Administration, October 12, 2011 e. Mural Permit Administrative Hearing, November 1, 2011 Mayor Struemph thanked all the citizens who give their time and efforts to serve on City boards and commissions. COUNCIL COMMITTEE REPORTS Administration Committee - Councilwoman Carrie Carroll announced that the next meeting will be held on Wednesday, December 14 at 8:00 A.M. Annexation Committee - Councilman Bob Scrivner announced that the next meeting will be held on Thursday, December 15 immediately following the Brown Bagel Work Session. Finance Committee - Councilman Rich Koon announced that the next meeting will be held on Thursday, December 15, immediately following the Annexation Committee meeting which will follow the "Brown Bagel" work session. Public Safety Committee - Councilman Mike Harvey announced that next meeting will be held on Thursday, December 1 immediately after the "Brown Bagel" work session, and will be held at Fire Station 3. Public Works & Planning Committee - Councilman Bob Scrivner announced that the next meeting will be held on Friday, December 9, at 7:30 A.M. Other Committee and Liaison Reports - There were no other reports given at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Interim City Administrator Nathan Nickolaus gave a brief report on the fire which occurred at an apartment complex over the weekend. He commended the Fire Department, Police Department, Cole County, and the EMS staff. He asked Chief Rennick to provide a few more details. ANNOUNCEMENTS OF UPCOMING MEETINGS AND EVENTS Parks & Recreation Director Bill Lockwood announced the following upcoming Christmas holiday events and invited citizens to come out and participate: Annual Mayor's Christmas Tree Lighting Ceremony on Thursday evening, Dec. 1 Living Windows on Friday evening, Dec. 2 Christmas Parade on Saturday afternoon, Dec. 3 Councilman Dave Griffith asked if High Street will be closing Friday evening and remain closed until after the parade on Saturday afternoon. Staff indicated they would find out and get the information to the Council. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS There were no presentations made at this time. Councilman Pope asked staff to provide the Council the number of private detention basins previously turned overto the City. Mayor Eric Struemph also asked for information regarding the approximate depth of the basin in question after rain. Bill 2011 -118, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING AND RESCINDING ORDINANCE #14671 IN ITS ENTIRETY AND ENACTING A NEW ORDINANCE ACCEPTING AND APPROVING THE FINAL SUBDIVISION PLAT OF JEFFERSON CITY WEST COMMERCIAL PARK, SECTION ONE, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI. REGULAR COUNCIL MEETING NOVEMBER 21, 2011 11 COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY No comments were made at this time. NEW BUSINESS Mayor Eric Struemph reminded citizens that 5:00 P.M. tomorrow, November 22, is the final day to file to run for election to the City Council. UNFINISHED BUSINESS There was no unfinished business brought forward. GO INTO CLOSED SESSION Mayor Eric Struemph stated that Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Council will go into Closed Session to discuss the following: a.
