Miller, Herb Meyring, Katie Soles, Parnell Quinn and Ryan Barwick

Mayor Vandernail called the meeting to order at 7:10 p.m.
1. Rollcall: Mayor Philip Vandernail; Mayor Pro-Tem Eileen Waldow; Trustees; Andy
Miller, Herb Meyring, Katie Soles, Parnell Quinn and Ryan Barwick
2. Approval of Agenda:
Trustee Soles moved, and Trustee Miller seconded the motion to approve the agenda.
Motion carried: 7-0.
3. Consent Agenda:
a) Minutes October 16, 2019
b) Resolution 2019-11-01 PW Vehicle Purchase
Trustee Quinn moved, and Trustee Barwick seconded the motion to approve the
consent agenda. Motion carried: 7-0.
4. Discussion and Possible Action Regarding:
a) Rocky Mountain Cannabis Letter of Request
Alejandro Perez from Rocky Mountain Cannabis presented to the board.
Trustee Waldow moved, and Trustee Meyring seconded the motion to allow the hours
of operation to remain open until 9pm. Motion carried: 5-2, Nay Miller and Soles.
A public hearing will be held at a future meeting to discuss allowing "cannabis" on the
sign. This will require an amendment to the town code because currently this is not
allowed. The Board asked Perez to provide information and pictures from the other
towns that allow "Cannabis" in the sign, towns where Rocky Mountain Cannabis owns
additional dispensaries.
5. Public Hearing:

a) 2020 Budget
Mayor Vandernail opened the Public Hearing regarding the 2020 Budget.
TM Durbin presented the 2020 preliminary budget.
Trustee Soles moved, and Trustee Quinn seconded the motion to continue the Public
Hearing to November 20, 2019. Motion carried: 7-0
6. Open Forum:
a) Business not on the agenda
7. Updates:
Soles: The stop sign at CR 72 in front of the tubing hill is missing. The BOCC will have a
public hearing on Byers Peak Ranch is on Wednesday November 13, 2019.
Waldow: Lights in the median cross walks? The town is still waiting for final acceptance
for the median project from CDOT. Until this is complete no changes can be made.
Miller: NWCOG member needs to be reappointed. The Board agreed to have Trustee
Miller continue with this appointment. Look into Home Rule vs. Statutory.
8. Executive Session Personnel Matter:
Town Manager Evaluation: For discussion of a personnel matter under C.R.S. Section
24-6-402(4)(f)(I) and not involving any specific employees who have requested
discussion of the matter in open session to include TM Durbin.
Trustee Waldow moved, and Trustee Soles seconded the motion to enter the executive
session at 8:26 p.m. Motion carried: 7-0.
Trustee Soles moved, and Trustee Meyring seconded the motion to exit the executive
session at 8:55 p.m. Motion carried: 7-0.
Trustee Barwick moved, and Trustee Waldow seconded the motion to authorize the
Mayor to execute the employee agreement with Jeff Durbin. Motion carried: 7-0.
9. Adjourn:
Trustee Soles moved, and Trustee Quinn seconded the motion to adjourn. Motion
carried: 7-0. Meeting adjourned at 9:00 p.m.
