HomeMy Public PortalAboutOrd. 1639ORDINANCE NO. 1639 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA AMENDING THE LYNWOOD MUNICIPAL CODE TO REMOVE REFERENCES TO INACTIVE COMMISSIONS AND MERGING THE DUTIES OF THE PUBLIC SAFETY COMMISSION WITH THE TRAFFIC, PARKING AND SAFETY COMMISSION, ASSIGN THE DUTIES OF THE DESIGN REVIEW BOARD TO THE LYNWOOD PLANNING COMMISSION, AND AMEND RULES RELATED TO ABSENTEEISM RULES APPLICABLE TO COMMISSIONS AND BOARDS WHEREAS, on January 18, 2011, to promote efficiency, save City resources and conserve on City staff time, the City Council voted to discontinue use of several City of Lynwood commissions and boards and directed staff to prepare an appropriate ordinance amending the Lynwood Municipal Code to remove references to such City commissions and boards; WHEREAS, the City Council's action on January 18, 2011 directed that the following Lynwood boards and commissions be dissolved: Recreation and Parks Commission, Design Review Board, Women's Commission, Youth Commission, Senior Advisory Council, Veteran's Affairs Council, Community Affairs Commission, Library Commission, and the Board and Commissioners of Vehicle Parking Districts; WHEREAS, the City Council further directed that the boards of the Public Safety Commission and Traffic, Parking and Safety Commission be merged to create a single body known as the Public Safety/Traffic and Parking Commission and that the duties of the Design Review Board be assigned to the Lynwood Planning Commission; WHEREAS, the City Council further directed that the boards of the Public Safety Commission and Traffic, Parking and Safety Commission be merged to create a single body known as the Public Safety/Traffic and Parking Commission and that the duties of the Design Review Board be assigned to the Lynwood Planning Commission; WHEREAS, clarifications are necessary to the rules on commissioner attendance, including that the time for counting the number of absences is to run on a calendar rather than 12 month period, that tardiness of 15 minutes or more to a commission or board shall be treated as an absence, and that commissioners are not to be paid a stipend for any meeting in which he /she is not present; and WHEREAS, the City Council now desires to codify these changes to the Lynwood Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Subsection 2- 12.1.a, "Absences From Commission, Board, And Committee Meetings; Removal," of the Lynwood Municipal Code is hereby amended as to subparagraph 1 to read as follows, with Subparagraph 2- 12.1.a.2 and Subsection 2- 12.1.b remaining unmodified and in full force and effect: "2 -12.1 Absence From Meetings; Removal; Compensation: a. Absences from Commission, Board, And Committee Meetings; Removal: 1. Regardless of other stipulations in legislation or guidelines establishing any boards, commissions or committees, the following policy will be adhered to: (a) Three (3) unexcused absences within a calendar year (January- December) shall constitute a vacating of the position for boards, commissions or committees meeting once a month. (b) Four (4) unexcused absences within a calendar year (January- December) shall constitute a vacating of the position for boards, commissions or committees meeting twice a month. (c) No compensation shall be paid to any board /committee member or commissioner for any meeting in which he /she is absent, whether excused or unexcused. (d) Arrival late by fifteen (15) minutes or more to a board, commission or committee meeting shall constitute an unexcused absence and no compensation shall be paid to the commissioner or board or committee member for attending the meeting late. (e) In order for the boards', commissioners' and committees' chairmen to appropriately plan for their meetings, any member who has to be absent should notify the chairman of the respective board, commission and committee or in his /her absence, the staff representative. No more than two (2) excused absences may be permitted within a calendar year (January — December). Board /committee members or commissioners who will not be able to attend a scheduled meeting should properly notify the staff liaison prior to the meeting (f) The City Clerk shall send out notices of any vacated seats. (g) If any section of this subsection is found to be in conflict with any other section of this code, this section hereby supersedes all other codes." Section 2. Section 2 -12.3, "Membership of Subsidiary Public Bodies," of the Lynwood Municipal Code is hereby amended in its entirety to remove the "Board of commissioners of vehicle parking districts nos. 1 and 2, Board of commissioners of all other vehicle parking districts, Community affairs commission, Design review board, Library commission, Parking and business improvement district advisory board, Recreation and parks commission, Senior advisory council, Women's commission, and Youth commission" and also merge the "Public safety commission" with the "Traffic, parking and safety commission," which revised Section 2 -12.3 shall read as follows: "2 -12.3 Membership Of Subsidiary Public Bodies: Notwithstanding any other provisions to the contrary in this code, the following subsidiary public bodies shall have the number of members as indicated in the table below: Name Of Subsidiary Public Body Code Number Section Of Reference Members Community development block grant advisory 2 -22 5 board Industrial development authority 2 -16 5 Personnel board 18 -5 5 Planning commission 2 -19; 25 -3 5 Public safety/Traffic and parking commission 2 -24; 7 -7.5 5 Section 3. Section 2 -13, entitled "COMMUNITY AFFAIRS COMMISSION," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 4. Section 2 -14, entitled "RECREATION AND PARKS COMMISSION," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 5. Section 2 -20, entitled "WOMEN'S COMMISSION," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 6. Section 2 -21, entitled "YOUTH COMMISSION," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 7. Section 2 -22, entitled "COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD," shall be amended, as to subsections c and d.5 read as follows, with all other provisions of Section 2 -22 remaining unmodified and in full force and effect: "2 -22 COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD: c. The CDBGAB shall meet on the dates set per subsection d.5 below at seven o'clock (7:00) p.m. in the city hall council chambers. d. 5. The CDBGAB board shall meet on those dates and times which coincide with the meeting times and dates of the planning commission and only when business of the CDBGAB is required to be transacted. Section 8. Section 2 -24, entitled "PUBLIC SAFETY COMMISSION," shall be re -named to "PUBLIC SAFETY/TRAFFIC AND PARKING COMMISSION" and all provisions under Section 2 -24 shall be amended in their entirety to read as follows: "2 -24 PUBLIC SAFETY /TRAFFIC AND PARKING COMMISSION: 2 -24.1 Public Safety /Traffic and Parking Commission: A Public Safety/Traffic and Parking Commission is hereby created and established. Said commission may be known and referred to as the Lynwood Public Safety/Traffic and Parking Commission or the Public Safety/Traffic and Parking Commission. 2 -24.2 Composition; Appointment Of Members: The Lynwood Public Safety/Traffic and Parking Commission shall consist of five (5) members who shall be residents of the city. Members shall not be officers or employees of the city. All members shall serve at the will and pleasure of the city council. Each member of the city council shall appoint a person to the public safety commission to represent that council member's interest with the community. The mayor shall appoint an additional two (2) persons to serve on the commission 2 -24.3 Term Of Office: Each member of the Lynwood Public Safety/Traffic and Parking Commission shall serve a four (4) year term commencing on January 1 following a general municipal election at which the appointing council member was elected. In the event the office of any appointing council member becomes vacant during the term thereof, the term of the commission member appointed by such council member shall terminate thirty (30) days after such vacancy occurs. Following the expiration of the term of office, each commission member shall submit a letter to their duly appointing council member and express his /her desire to either resign or to serve another four (4) years. Failure to submit such a letter shall constitute a desire to resign from the Commission. 2 -24.4 Meetings: Meetings of the Lynwood Public Safety/Traffic and Parking Commission shall occur only when business of the Public Safety/Traffic and Parking Commission is required to be transacted. 2 -24.5 Records: The Lynwood Public Safety/Traffic and Parking Commission shall cause proper, accurate and permanent records of official acts and proceedings to be kept, and such records shall have the same status as records of other administrative departments of the City. Minutes, resolutions and official records of the Commission shall be filed with the City Clerk. 2 -24.6 Organization: The Lynwood Public Safety/Traffic and Parking Commission shall elect one of its members as chairperson, and such election shall be held as soon as practicable. Appointment as chairperson shall be for twelve (12) months. No member shall be reelected to serve as chairperson after having served a twelve (12) month appointment during his /her term on the Public Safety/Traffic Commission. Elections of chairpersons by the Commission shall be fair and without any bias or prejudice to that commissioner. 2 -24.7 Duties Of The Commission: The Lynwood Public Safety/Traffic and Parking Commission shall have the power and required duty to: a. Policy Recommendations: Analyze the minimal level of law enforcement needs and make policy recommendations to the City Council; such minimal level of law enforcement needs shall not constitute danger to the public safety or to the deputy sheriffs who deliver such service. Any and all special law enforcement contract services by any private vendor or body outside of the City government shall come before the Public Safety/Traffic and Parking Commission to make such request for law enforcement service for stated event. The Public Safety/Traffic Commission shall evaluate each fiscal year the necessity to increase, decrease or to deploy special contract delivery services to any part of the City deemed in need of additional or special targeted or directed law enforcement need. b. Fire Safety: Analyze the minimal level of fire safety needs and make policy recommendations to the City Council; such minimal level of fire safety needs shall not constitute danger to the public safety or to the Lynwood firefighters who deliver such service. The Public Safety/Traffic and Parking Commission shall review the standards of section 1500 of the National Fire Protection Agency relative to Fire Department Occupational Safety and Health, and may elect to seek policy recommendations to adopt, modify or comply to set standards pertaining to firefighter safety. The Commission shall identify how any adopted policy recommendations will directly or indirectly impact the overall public safety of the City residents and businesses. c. Animal Control: Analyze the City contract with the Los Angeles County Department of Animal Care and Control, its level of service and make policy recommendations to the City Council; the Commission shall oversee the dog licensing, canvassing of licensing, and registration within the City and fees established by resolution of the City Council. The Commission shall oversee all applicable laws, City codes and regulations including zoning of such regulations relative to animals within the City limits, and direct such recommendations to the City Council. The Commission shall set policy recommendations into rabies vaccination and animal control (spay /neuter) with a yearly prepared report to the City Council. The Commission shall be responsible for inspecting the premises of the Los Angeles County Department of Animal Care and Control site of said contract with the City on a yearly basis. A prepared written report accounting for each yearly inspection of animal premises shall be forwarded to the City Council. The report shall include all observations of the animal facility including care and control of animals. Any recommendation shall be addressed to the City Council. The Commission shall assist in spay /neuter programs for dogs and cats within the City. d. Health Department: Analyze the level of services received by the Los Angeles County Health Department and make policy recommendations to the City Council; the Commission shall monitor any closure of businesses, restaurant facilities or any other locations within the City which may constitute a health hazard dangerous to the public safety of the citizens. The Commission shall forward any health recommendations to the City Council for review and findings of consideration. e. Civil Emergency Operational Planning: The Lynwood Public Safety/Traffic and Parking Commission shall evaluate and make policy recommendations to the City Council on ways to maximize its civil emergency operational planning. The Public Safety/Traffic and Parking Commission shall work as an assisting body in preparing a civil emergency operational plan with the office of the Sheriff; the Fire Chief or his assistant with the Lynwood Fire Department or the Los Angeles County Fire Department; St. Francis Medical Center; American Medical Response; Red Cross; Lynwood Unified School District and any other office of emergency services including the National Guard and State agencies. f. Community Relations: The Lynwood Public Safety/Traffic and Parking Commission shall evaluate, review and make policy recommendations to the City Council on ways to maximize community relations between the Los Angeles County Sheriff's office and the minority community of Lynwood including the senior citizen community, youth and teen involvement and any other group that may have special needs. The Public Safety/Traffic Commission will further serve as the principal citizen liaison with the Los Angeles County Sheriffs office. g. Citizen Input; Complaints: The Lynwood Public Safety/Traffic and Parking Commission shall serve in conjunction with a staff person in the City Manager's office, as the City's mechanism to establish and maintain communications with citizens relative to public safety, including processing, hearing and monitoring trends in complaints received by the City regarding law enforcement, fire safety and animal control. The Public Safety/Traffic and Parking Commission shall further assist the City Council in developing ways to improve citizen input on public safety issues and forward any recommendations for Council consideration. h. Emergency Preparedness: The Lynwood Public Safety/Traffic and Parking Commission shall provide a forum for the receipt of information, recommendations, and complaints from the community relating to emergency preparedness. The Commission shall recommend to the City Council plans, programs, procedures, policies, and proposed legislation for the purpose of promoting, enhancing, and improving emergency preparedness in the community. The Commission shall cooperate with City departments and other public agencies in promoting all aspects of emergency preparedness, and, if so authorized by the City Council, shall organize workshops relating to emergency preparedness. i. Neighborhood Block Watch Program: The Lynwood Public Safety/Traffic and Parking Commission shall evaluate and make policy recommendations to the City Council regarding development of the Neighborhood Block Watch Program and shall provide a forum for the exchange of positive ideas and information among neighbors and residents. j. Hearing Procedures: The Public Safety/Traffic and Parking Commission shall adopt rules of procedure relative to law enforcement complaints and further provide written procedures to a complainant. Hearings shall be informal. There will be no cross - examination of either the complainant, any witness(s) or a request to interrogate a deputy sheriff. The Commission may ask questions to any party as a point of information, or to gain elaboration of points made. The Commission will have no power to take any action regarding a complaint, except that it may forward its recommendation of action to the Sheriff's office. Any material, notes, evidence or minutes generated from the Public Safety/Traffic and Parking Commission hearing will be forwarded as a result of the complainant's public address to the Sheriff's Department of Internal Affairs Bureau. The Lynwood Public Safety/Traffic and Parking Commission shall not be a "Police Review Board ", nor shall it conduct itself as one. k. Limitations: It shall not be the role of the Lynwood Public Safety/Traffic and Parking Commission to conduct investigations into individual complaints related to the service being provided by the City or any of its contractors including the Los Angeles County Sheriff's office. Nor shall it be the role of the Commission to direct the process or the procedure by which service level recommendations are carried out. 2 -24.8 Traffic, Parking and Safety Duties: The Lynwood Public Safety/Traffic and Parking Commission shall have the following additional powers and duties related to traffic, parking and safety: a. Parking Matters. With respect to parking matters, the Commission shall suggest the most practical means for coordinating the activities of all officers and agencies of the city having authority with respect to the administration and /or enforcement of parking regulations; stimulate and assist in the preparation and publication of reports concerning parking; receive complaints having to do with parking matters; and recommend to the city council and to the city engineer, law enforcement officials, and other city officials ways and means of improving parking conditions and the administration and enforcement of parking regulations. b. Traffic Matters. With respect to traffic matters, the Commission shall suggest the most practical means for coordinating the activities of all officers and agencies of the city having authority with respect to the administration and /or enforcement of traffic regulations; stimulate and assist in the preparation and publication of traffic reports; receive complaints having to do with traffic matters; and recommend to the city council, the city engineer, law enforcement officials and other city officials ways and means of improving traffic conditions and the administration and enforcement of traffic regulations. C. Safety Matters. With respect to safety matters, the Commission shall provide a forum for the receipt of information, recommendations, and complaints from the community relating to emergency preparedness. The commission shall recommend to the city council, plans, programs, procedures, policies and proposed legislation for the purpose of promoting, enhancing, and improving emergency preparedness in the community. The commission shall cooperate with city departments and other public agencies in promoting all aspects of emergency preparedness, and, if so authorized by the city council, shall organize workshops relating to emergency preparedness." Section 9. Section 7 -7.5, entitled 'Traffic, Parking, And Safety Commission," and all subsections thereunder of the Lynwood Municipal Code is hereby amended in its entirety to read as follows. 7-7.5 Public Safety/Traffic and Parking Commission. The Lynwood Public Safety/Traffic and Parking Commission shall address traffic, parking and safety matters as set forth under Section 2- 24.8." Section 10. Section 2 -27, entitled "DESIGN REVIEW BOARD," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 11. Section 2 -25, entitled "LIBRARY COMMISSION," and all subsections thereunder of the Lynwood Municipal Code is hereby deleted in its entirety. Section 12. Section 25 -3, entitled "PLANNING COMMISSION" shall be amended to add the following subsections 25 -3.14 through 25 -3.22, to supplement the powers of the Lynwood Planning Commission to include the duties formerly performed by the Lynwood Design Review Board, which added subsections 25 -3.14 through 25- 3.22 shall read as follows, with all other provisions of Section 25 -3 remaining unmodified and in full force and effect: "25 -3.14 Design Review Authority Over Discretionary Zoning Entitlements: For development applications encompassing new or substantially rehabilitated buildings or structures requiring discretionary approval from the Planning Commission pursuant to this code, the Planning Commission, in addition to other duties prescribed under this code, shall be authorized to ensure that the nature and appearance of land uses and developments will be compatible and harmonious with the use and enjoyment of surrounding properties and will not have a detrimental effect upon the historic, economic, social, and cultural well being and development of the community. "Substantially rehabilitated ", as used herein, shall mean reconstruction that exceeds fifty percent (50 %) of the appraised value of such structure. 25 -3.15 Exemptions from Design Review: The following development applications are exempt from section 25 -3.14: a. Any development application not requiring discretionary approval from the planning commission shall be exempt from the provisions of this section. b. Building permits required for the temporary emergency repair of any structure in any zone shall be exempt from the provisions of this section. 25 -3.16 Required Plans And Materials for Design Review: The plans to be submitted for review under section 25 -3.14, and provided In conjunction with the application required under this code for any approval of new or substantially rehabilitated buildings or structures requiring discretionary review before the planning commission, shall include those items listed below which are determined by the director of development services to be necessary to be submitted to the planning commission: a. A site plan depicting: 1. The complete dimensions of the lot and site plans; 2. All existing and proposed buildings and structures; 3. All existing and proposed street dedications and improvements thereon, including the location and nature of all street improvements in the public right of way; 4. The location of all utility services. b. Architectural drawings, renderings, or sketches showing all elevations of the proposed buildings and structures as they will appear upon completion and the texture and color of all construction materials to be used; c. All existing and proposed yards and spaces between buildings and structures; d. All existing and proposed walls, fences, and landscaping, including the location, height, area, color, nature, and type of design and material composition for the walls and fences; e. A landscape plan showing the location of the trees and shrubs (proposed to be removed, retained, or installed), the amount, height, type, and location of landscaped areas, planting beds, and plant materials, and provisions for irrigation, f. All existing and proposed lighting, including the location and general nature of both off site and on site lighting, the proposed intensity thereof, and the diffusion thereof; g. The exterior lighting plan showing the location, materials, and colors of the illumination; and h. Such other drawings or additional information necessary to adequately consider the drawings set forth in this section and determine compliance with the purpose and intent of the design review authority of the planning commission. 25 -23.17 Design Review Procedures: a. Development Services Department Duties: The director of development services shall notify the applicant and property owner of the subject property of the date, time, and place of the planning commission meeting at which its application shall be considered. Such date shall be within forty five (45) calendar days after the date of notification of said meeting. b. Planning Commission Duties: The planning commission shall have the following duties for design review: 1. Review: The director of development services shall present to the planning commission the original application and plans, including any amendment(s) thereto, and copies of all other relevant papers, along with a written report describing the application, background and any recommendation of the director of development services. The planning commission shall be responsible for reviewing all plans and drawings as part of any request for a discretionary zoning entitlement under the provisions of this section and shall either approve, deny, or conditionally approve such request as part of the planning commission's consideration of the discretionary zoning entitlement. 2. Criteria: All plans and drawings required by this section shall meet the criteria of this section. Conditions may be recommended when the proposed improvements do not comply with the applicable design standards or criteria and shall be proposed to bring such improvements into conformity. 3. Continuance: The planning commission may continue its review from time to time, to a time and date certain. 4. Determinations And Findings: The determinations of the planning commission in reviewing the design of and the findings in support of said recommendation shall be in the form required pursuant to the provisions of this code applicable to the particular zoning entitlement at issue. 5. Appeals To The City Council: The planning commission determination shall be final, unless appealed to the city council or its designated hearing officer, in accordance with this code. 25 -3.18 Design Review Findings: For every application subject to design review pursuant to section 25 -3.14, the planning commission shall base its decision on the following findings: a. That the proposed development plans and design features will integrate harmoniously with, and enhance the character and design of both the immediate neighborhood and the surrounding areas of the city. b. That the plan and design will enhance the desirability and enjoyment of the immediate neighborhood. c. That the plan and design of the buildings, parking areas, signs, landscaping, lighting, and other site features indicate that consideration has been given to both the functional aspects of the site development, such as automobile and pedestrian circulation, and the visual impacts of the development from the view of the public streets. d. That the plan and design shall tend to enhance property values and appearance in the immediate neighborhood and surrounding areas with an accompanying betterment of conditions affecting the public health, safety, and welfare. 25 -3.19 Design Review Factors And Considerations: For every application for design review, the planning commission shall consider the following factors in applying criteria when making findings with respect to site plan and design review: a. The height, bulk, and other design features of all structures should be in proportion to the building site with a balance and unity among external features so as to present a harmonious appearance. b. The design of structures and grounds should contribute to the physical character of the community while maintaining a harmonious relationship with the existing and proposed adjoining development. c. The layout, orientation, and location of structures and their relationship to one another and to open spaces, parking areas, pedestrian walks, signs, illumination, and landscaping should be interrelated and arranged as to achieve an efficient, and harmonious development. d. Each building shall reflect due consideration of a total design concept which shall be an integral part of the design treatment and architectural detail accomplished in a professional manner consistent with good design practices. e. The grading and development of sites should be accomplished with due regard for the qualities of the natural terrain and landscape, trees, shrubs, and other natural features should not be indiscriminately destroyed. f. The location and type of landscape plantings should consider the following: 1. Landscaping should separate or screen storage, parking, and service areas from the street and adjoining building sites. 2. Landscaping should break up large expanses of paved areas. 3. Landscaping should separate building areas from paved areas. g. The design, size, lighting, placement, and character of signs should be appropriately related to the structures and grounds and be in harmony with the general development of the site and the surrounding neighborhood. h. The mechanical equipment or machinery, trash, and other exterior service areas necessary to serve the structure should be concealed or treated in a manner which is in harmony with the design of the structures and grounds. i. When a site subject to design review is within or adjacent to a residential zone, the proposed improvements to such site should show consideration for the R zoned district and not impinge upon the character or value of the residential area. 25 -3.20 Administration Of Approved Plans: If there is substantial change from the original design plans, the matter or plans shall be resubmitted to the planning commission, subject to all of the provisions of this section, as if it were a new design review. 25 -3.21 Parking And Business Improvement District Advisory Board Duties. The Lynwood Planning Commission shall further have the duties pursuant to Section 36500, et. sec. of the Streets and Highway Code of the State of California formerly performed by the Parking and Business Improvement District Advisory Board (PBID) established on November 27, 1985, Ordinance 1262. The Planning Commission shall meet to perform the duties of the PBID on those dates and times which coincide with the meeting times and dates of the planning commission and only when business of the PBID is required to be transacted. 25 -3.22 Other City Duties: Nothing in this section 24 -3 is intended to restrict the powers and duties otherwise pertaining to any city body, agency, commission, or staff." Section 13. Except as expressly modified pursuant to this Ordinance, all provisions of the Lynwood Municipal Code shall remain unmodified and in full force and effect. Section 14. If any section, subsection, clause or phrase of this ordinance is for any reason, held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections of this ordinance. The Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 15. This Ordinance shall take effect 30 days after its final passage, and within fifteen (15) days after its passage, the City Clerk shall cause it to be posted as required by law, and hereby designated for that purpose. First read at a regular meeting of the City Council held on the 19th day of April, 2011, and adopted and ordered published at a regular meeting of said Council on 3rd day of May, 2011.
