Board members present: Carmen Scherzo , DVM , Chairman ; Joe Ford ; Penny Hausser Holeman , MPH , MA , MS and

1 . Chairman 's announcements
Massachusetts Substance Abuse helpline number is 800-327-5050 . All calls are confidential .
Rabies Vaccination clinics will be held at the Dennis Veterinary Hospital and the Orleans Hospital of Orleans on April 6 ,
2019 . Cost for a 1 year rabies shot is $ 10 .
The Attorney General disapproved and deleted Article 13 , the general bylaw ban on Marijuana . A new citizen 's petition
has been submitted to amend the existing zoning bylaws .
Joe Ford , Penny Hausser Holeman and James Reynolds have pulled papers for the 3 year term on the BOH and Lucas
Dinwiddie has pulled papers for the 1 year term .
Sherrie McCullough , Assistant Health Director has passed her Registered Sanitarian exam .
2 . Brianna Romme - Romme Raised - food establishment permit application
Brianna Romme was present. She will be selling at farmers markets . She will be making jams and jellies . Potentially
doing breads and baked goods . She has over 10 years of experience in the restaurant business .
Motion : Approve the Food Establishment permit application .

3 . Susan Murray/Stony Brook Elementary School - food establishment permit application
Susan Murray was present. They will be running the concession stand for the Brewster Whitecaps . All the kitchen
equipment from the school is used . The only thing outside is burgers and popcorn .
Motion : Approve the Food Establishment permit application

4 . J . M . O' Reilly & Associates Inc . - 72 Johnson Cartway - Title 5 and Local variance requests
John O' Reilly presented to the Board . This is a family owned property . It is currently a 3 bedroom "classic" cottage . It has
an old leach pit. All properties in the area are served by private wells . The current cottage will be removed and a new 3
bedroom dwelling and attached garage will be built. The Conservation Commission has approved the wetland line . They
will be keeping it out of the 50 foot buffer for the Conservation Commission . The abutting well setbacks were held .

The subject property's well will be moved to the north side of the lot. A 1500 gallon tank, pump chamber, and drip
dispersal field will be installed . The only area to put the septic is the one that is proposed because of wetland and wells .
Existing
system will be removed and all bad sand will be removed and clean sand brought in . The following variances are
requested ,
1 . To allow the SAS to be 1 ' from a front property line
2 . To allow the SAS to be 8 ' from a side property line
3 . To allow the SAS to be 17 ' from a cellar wall
4 . To allow the SAS to be 14 ' from a leaching catch basin
5 . To allow no reserve area
6 . To allow the SAS to be 58' from the surface water
7 . To allow the SAS to be 58' from Long Pond
8 . To allow Parcel 22 septic to be within the proposed well protection zone
9 . To allow Parcel 23 septic to be within the proposed well protection zone
10 . To allow the private well to be V from a property line
Groundwater separation is just over 4 feet. They are proposing almost 19 feet from bottom of Perc- Rite field to
groundwater. They are not adding any flow.
Dr. Scherzo thinks it may be a 4 bedroom with the family room downstairs. Mr. O' Reilly stated that the family room doesn 't
really meet the criteria for a bedroom .
Bruce Johnson , owner of property stated that the intention of the basement room is to allow entrance to the house from
the beach without getting sand everywhere . This won't be a bedroom . It will be for storage etc.
Dr. Scherzo stated that he has a problem with putting the septic in the same place as the original because of the
phosphorus . He doesn 't think drip dispersal is going to work for phosphorus removal ,
Mr. Ford asked how difficult it would be to add technology to this system . Mr. O' Reilly stated that he wouldn 't feel
comfortable promoting an I/A system that isn 't proven .
Mr. Ford stated that he thinks the owner is doing everything he can to make a better septic system for this home .
Motion : Approve the variance requests and make it mandatory that the well is tested spring and fall for 2 years .

5. J . M . O ' Reilly & Associates Inc. - 425 Crowells Bog Road - informal discussion with Board
John O' Reilly was present. He is working with the owners who use this home for a summer cottage . It has a cesspool and
they want to upgrade. They also want to add a bedroom to the cottage and put living space in the basement. The foot
print should not change . The parcel is between 34 acres. Option 1 would be a tank, pump chamber and leaching
chambers and it would be 175' to the pond . Option 2 would not require a variance ,
There is room on the property to place the SAS 300 feet from pond . The reason he suggested coming to the Board is that
the groundwater is flowing away from the pond . It does save from building in a steep slope.
The Board was favorable of option 1 . ,
6 . J . M . O' Reilly & Associates Inc . - 22 Cranberry Lane - Title 5 and local variance requests
John O' Reilly was present. This is an existing 2 bedroom home with a 3 bedroom system . It is190 ' feet from vesper pond .
Groundwater is flowing from cranberry lane towards the pond . They will be adding a 3rd bedroom .
The following variances are requested :

1 . To allow the SAS to be 5' from a property line and reserve area to be 8 ' from a property line
2 . To allow the leaching facility to be 192 ' from a pond and the reserve are to be 222 ' from a pond .
The actual septic flow is down gradient from pond . Conservation commission has given approval ,
Dr. Scherzo stated he was concerned because the property is in an environmentally sensitive area .
Motion : Finding that there is no change in design flow and the new system will be farther away from Vesper Pond , approve
the variances .

7 . Coastal Engineering - 289 Crocker Lane - Title 5 variance requests
Stacy Kanaga was present. This is a renovation of an existing home . They will be putting in a new system . The house
was built in 1979 , pre title 5 . It is a 5 bedroom home . Due to constraints on the lot, there was only 1 place to put the
system . The house will remain a 5 bedroom with no living space in garage . Existing system will be either removed or
abandoned and filled in .
The following variances are requested ,
1 . To allow the SAS to be 5 ' from a front property line and 5' from a side property line
Motion : Finding that there is no change in design flow and is an improvement over what is there, approve the requested
variances .

8 . Discussion on the hiring of a new Health Director
Dr. Scherzo stated that he will be meeting with Mary Chaffee, Select Board liaison and Susan Broderick, Assistant Town
Administrator tomorrow to talk about this . He feels the Board needs to know a lot more about the process before they go
forward . Nancy Ice will also be meeting with Sue Broderick next week . He believe that they should develop a time line ,
Dr. Scherzo asked that Mrs . Ice put this back on the agenda in 2 weeks . He asked the Board to think about what they want
in the new director and what items they want the new director to pursue .
9 . Discussion on the proposed plastic bottle ban on Town properties
Dr. Scherzo stated that he had listened to Select Board meeting from Monday night and they had some good information
on this warrant article.
Dr. Chaffee spoke to the Board about how this came about. The language in the warrant is very broad and problematic.
The Select Board told the petitioners about their concerns and the Recycling Committee was not in favor of it as it was
written because there were many issues with the wording . The petitioner will be making some changes for town meeting .
They asked the Recycling Committee to take a look at each department's use of plastic.
10 . Topics the Chairman did not anticipate
There were none .
