BOARD OF HEALTH MEETING
WEDNESDAY APRIL 17 , 2019 AT 7 : OOPM
TOWN HALL, ROOM B
Board members present: Carmen Scherzo , DVM , Chairman ; Annette Graczewski , MT (ASCP ) , Vice Chairman ; Joe Ford
and Nancy Leach , PharmD
Board members absent: Penny Hausser Holeman , MPH , MA, MS
Others present: Nancy Ellis Ice , CHO , RS , MPH , Health Director and Tammi Mason , Senior Department Assistant
1 . Chairman's announcements
Dr. Scherzo stated that the Select Board had endorsed the BOH letter to Eversource with regards to spraying .
There will be a community CPR training program at the Brewster Fire Department on April 2 & 2019 at 6 PM . Residents
can call the Fire Dept. at 896-7018 .
The Spring town meeting will be on May 6 , 2019 at 6PM at the Stony Brook Elementary School . The warrant is on the
Town website .
On April 24th there will be a public listening session at Brewster Ladies Library to present the result of the recently
completed Community Vulnerability Workshop .
Still working on updating the Health Directors job description .
2 . Carole Ridley, Ridley & Associates , Inc. - discussion on adding to the Pleasant Bay Alliance Committee
Carole Ridley was present to go over this with the Board . She showed a brief power point presentation .
Brewster has 24 % of the land in the water shed area .
Mr. Leach asked about people living on ponds and upgrading their systems . Is there a time frame on the status of the
systems that George Heufelder is studying ?
Ms . Ridley stated that she couldn 't answer that but that Mr. Heufelder could provide information anytime .
Chris Miller stated that the group is mostly focusing on nitrogen removal .
Dr. Scherzo stated that he really thinks someone from the board or the Health Director needs to be part of the committee .
He will follow up with the Select Board to appoint Mrs . Ice on the committee .

3 . J . D . Marquedant & Associates , Inc . - local variance requests for 33 Pine Pond Road
David Marquedant, Engineer, Michael Cook , Owner and Tim Nelan , Attorney were present . This is an existing 1 bedroom
home built in 1960 . The property has 2 wells and a cesspool .
The well closest to the wetland is not in use .
The Conservation commission gave approval last night.

Their plan is to move the house as far away from wetland and Pine Pond as possible . The SAS will be 113 feet from
wetland and they will tie into town water.
The buildable upland size of the lot is 27 , 724sf.
The following variances are requested ,
1 . To allow the SAS to be 226 ' from Pine Pond
2 . A variance of 2 , 273sf to allow a third bedroom
Mr. Marquedant stated that the house is going to be a 2 bedroom now but they would like to install a 3 bedroom system so
that they can put another bedroom in at a later date.
Dr. Scherzo stated that he would be in favor of letting them put in a 3 bedroom system but only allow 2 bedrooms , If they
wanted to put a 31d bedroom in then they could come back and put an I/A system in .
Mrs. Graczewski agreed that she wouldn 't want a V bedroom without an I/A system .
Motion : Finding that this is an improvement over what is currently there , approve the request to allow the SAS to be 226 '
from Pine Pond and deny the variance request for relief from Title 5 requirement of 10 , OOOsf of land per bedroom , Also , a
2 bedroom deed restriction will be required .
Motion: Annette Graczewski Second: Joe Ford Vote: 4-0-0 Action: Motion carried
4. Discuss Pet's Banned from Public Ponds, Landings, Beaches and Tidal Flats regulation
Ms . Hausser Holeman had requested this be on the agenda and she is not present so this discussion will be tabled until
the whole board is here.
5. Discuss the draft restricting the Sale and Use of Tobacco Products & Nicotine Products regulation
Motion : Accept the recommendations from Town Counsel and incorporate the new effective date of September 1 , 2019 .
Motion : Annette Graczewski Second: Joe Ford Vote: 4-0-0 Action: Motion carried
6 . Discuss the draft letter re : use of disposable wipes and septic systems
A few minor changes were made to the letter and the Board agreed to send to the treatment facilities and the schools .
7. Discuss the 300 foot setback regulation for SAS to ponds/lakes
Mrs . Ice stated that Ms . Hausser Holeman had asked where the 300 ' setback came from . Mrs . Ice looked up the research
that backed this and showed to the Board
8 . Topics the Chairman did not anticipate
There were none.
