HomeMy Public PortalAboutMinutes - 1975/05/28 - Special" " CITY OF TEMPLE CITY PARKS AND RECREATION COMMISSION Minutes of May 28, 1975 " The special meeting of the Parks and Recreation Commission was called to order by Vice- Chairman Seibert at 6.35 p.m. on May 28, 1975 in the Council Chambers of the City Hall. Present were Commissioners Adams, Seibert and Stack. Chairman Villar arrived at 6:40 p.m. and Commissioner Andrews arrived at .6:44 p.m. Vice - Chairman Sel..bert explained that the purpose of the meeting was to consider a request received from Temple City: Baptist Temple, 9764 Woodruff, Temple City, to conduct a God and Country Sing in Temple City Park on Friday, July 4, 1975-from. 12:00 noon to 3:00 p.m. with set -up time from 10:00 a.m. to 12:00 noon and clean-up time from 3:00 1:o 4:00 p.m. He called on Pastor Dowers to speak in this regard. Pastor Dowers informed the Commission that this church uses the Woman's Club building and have been located in Temple City for approximately one year. He explained that the purpose of the event is to "entertain the residents of Temple City and lift up our country in song and in spirit." He stated__t -hat the event will not be a'religious service. He further described the program as being the singing of up- lifting songs about America by recognized and talented singers. In addition to singing, he continued, there will be one or two talks, the intent being to recognize the greatness of this nation. Pastor Dowers indicated that what this church is requesting is permission to use a portion of the park designated as center area from the palm trees north to the library, the placing of a portable platform on the grass for use by the speakers and singers, the use of their public address system for the speakers, singers and the announcements and the use of an electrical. outlet. The portable platform would be set up Shortly before the event and removed immediately thereafter. A responsible adult will be assigned to the plat- form at all times as a safety precaution. He assured the Commission that . the area of the park they used would be cleaned immediately after the program.. Commissioner Seibert commented that he found the program as described to be very acceptable for presenting in the park. He informed Pastor Dowers that if the Commission approves the request that the use must also be approved by the City Council. He also advised him that an insurance certificate 0-naming the City of Temple City as additionally insured must be filed with the City Clerk prior to the event in an amount not less than 100/300 thousand dollars_ to include bodily injury liability and 25 thousand dollars property damage Commissioner Stack commented that he was in favor of the event and felt it was an excellent program especially during the bicen.tehnial period.: Commissioner Adams expressed concern if the event was a religious service and was assured by Pastor Dowers that it was not. Commissioner Seibert stated that -the clarification was necessary as an opinion received from the City Attorney states that the City cannot legally permit the use of public .park property and /or buildings for religious places of worship. In the discussion.: that followed the Commission identified eleven (11) conditions for use of the park and reviewed them with Pastor Dowers. He agreed to abide by all conditions set forth by the Commission. Commissioner Seibert moved to recommend to the City Council that the request received from the Temple City Baptist Temple for use of a portion of Temple City Park on. July 4, 1975 from 1000 a.m. to 4:00 p.,m. to present a "God 0 and Country Day," be approved subject to the following Conditions of Park Use 1. Adherence to Temple City Municipal Code Section 3700 et seq. setting forth conduct in public parks. (A copy of the Municipal. Code is on file in the City Clerk's office and available for reference). Applicant assumes all liability for injuries to persons or property as a result of said use and agrees to indemnify and hold the City of Temple " City free and harmless from all liability imposed by law for the injury of people or damage to property. 3. That an insurance certificate naming the City of Temple City as addi- tionally insured be filed with the City Clerk no less than fourteen (14) days in advance of the stated event in an amount not less than 100/300 thou- sand dollars to include bodily injury liability and $25,000 property damage. 4. Parking shall be in authorized marked areas in adjacent parking lots and on- street parking as presently posted. No cars or motorbikes shall be permitted on the park at any time. NO EXCEPTIONS. 5. That the applicant: shall use only the section of the park assigned, that being the area south of the library to the palm trees and to the in- terior sidewalks to the east and westward of the center section of the park. 6. That the loud speakers and /or amplified sound equipment must be reason- ably used and be compatible with the residential neighborhood. 7. That the premises would be cleaned up immediately after the event has " been completed. 8. There shall be no selling of food, beverages or goods. 9. There shall be no admission charge, no tickets sold and no collections or donations made or accepted. 10. Applicant must adhere to the day, date and time approved by the City. All changes must be approved by the Parks and Recreation Commission at least ten (10) days in advance of use date. 11. That no religious services be conducted. As there were no objections to the motion, Chairman Villar declared the motion carried. There being no further business, Commissioner Andrews moved to adjourn to the next regular meeting on Wednesday, June 18, 1975 at 7:30 p.m. in the Council Chambers of the City Hall, 5938 North. Kauffman Avenue, Temple City. Commissioner Adams seconded the motion, which carried, Chairman Villar adjourned the meeting at 7:00 p.m. ATTEST: City Clerk " "
