GREENCASTLE BOARD OF WORKS
SPECIAL SESSION
WEDNESDAY, APRIL 30, 2003 4:00 P.M.

The Greencastle Board of Works met in Special Session Wednesday, April 30, 2003,
4:00 p.m. at City Hall. Mayor Michael called the meeting to Order at 4:05 p.m. On the
Roll Call, the following were found to be present: Sue Murray and George Murphey.
This meeting was held to review the Settlement Agreement for PAE & Associates vs.
City of Greencastle. The Settlement Agreement was distributed to members at the
meeting. This agreement calls for the City to pay PAE $379,300.00. This amount
includes retainage in the amount of $161,452.66, but does not include the interest which
also has to be paid to PAE, and allows $40,400.00 to be held until the punch list is
completed.
Motion to authorize the Mayor to sign the Settlement Agreement was made by George
Murphey, seconded by Sue Murray. Vote was unanimous.
Sue Murray made the motion to authorize CT Jones to send a letter to National City Bank
releasing PAE retainage and interest, seconded by George Murphey. Vote was
unanimous.
Attorney Darrell Felling was present and reported to the Board that a new appraisal has
been furnished in the City of Greencastle vs. Jack Ton Famis litigation. Attorney Felling
is to meet with Tort's Attorney John Zeiner tomorrow. Attorney Felling requested an
Executive Session be set to discuss this litigation. Executive Session was set for
Monday, May 5, 2003, 11:30 a.m. at City Hall.
Police Chief Hendrich requested an Executive Session be set for Police Personnel. An
Executive Session was set for Tuesday, May 13, 2003, 11:30 a.m. at City Hall.
Motion to adjourn made by George Murphey, seconded by Sue Murray. Vote was
unanimous.
