Secondly, Lake Forest :Enterprises ,wishes to propose .the adjacent eighteen (18) acres be annexed to the City of McCall. The legal description as follows; . The omitted name of the plat in, the above mentioned letter is known as the Thompson Wooley';Addition No. 2 in Valley County, Idaho. COMES NOW, the undersigned Petitioner and respectfully petitions your honorable council to exerciseits authority under Section 50-1306A of the Idaho Code and vacate a portion of that certain subdivision to the City of McCall-, Idaho, being a part of the Southeast Quarter of Section 9, Township 18 North, Range 3 East, Boise Meridian, more particularly described as follows: Lots 7, 8, 9, 10, 11 and 12 of Block 4, Lots 9, 10, 11, 12, 13, 14, 15 and 16 of Block 2, All, of Block 6 and all of Block 7 of Thompson-Wooley Addition No. 2, according to the Plat thereof filed of record in the office of. the County Recorder of Valley County, Idaho, together with all easements, roadways and rights of way adjacent to said lots. In support of this petition, your petitioner alleges that said partnership is the owner in fee simple of said premises; that said lots are all contiguous one to another and would not harm or prejudice the owners of other lots in said subdivision; that it is necessary and desirable for said vacation to re -plat said premises in conjunction with adjacent lands, hereinafter set forth to be annexed to the City of McCall; thatsaid vacation is in the best interest of the City of McCall. FURTHER, your petitioner respectfully petition your honorable council to exercise its authority under Section 50-222 of the Idaho Code and annex the hereinafter described adjacent property. to the City of McCall, Idaho, to -wit: The NE 1/4 SE 1/4 Section 9, Township 18 North, Range 3 East, Boise Meridian, EXCEPTING THEREFROM, the West 150 feet extending along the entire length of said tract; and a tract 01 land beginning at a point on the North line of said subdivision 180 feet West of the Northeast corner thereof, thence South 660 feet to a point, thence East 180 feet, thence North 660 feet, thence blest 180 feet back to the point of beginning. In support of this petition, your petitioner alleges that sai partnership is the owner in fee simple of said premises; that said lands are adjacent to other lands owned by your petitioner that are within the City of McCall; that it is necessary .and desirable that said lands be annexed to the City of McCall to fulfill the intentions of your petioner to subdivide and plat said lands in conjunction with your petitioner's other lands. WHEREFORE, your petitioner prays that a time and place be set for public hearing on this petition and the proper notice given as required by the Statutes of the State of Idaho, wherein all persons objecting to your petitioner's requests may be heard.
