It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire, soil
and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including all
environmental laws and regulations when applicable, subsequent owners should be informed that any alterations to the property must be
approved by the issuance of another building permit. Permit holder agrees to hold the City of Tybee Island harmless on any construction
covered by this permit.
This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted work
will be stopped. The building contractor will replace curb paving and gutter broken during construction. This permit will be voided unless
work has begun within six months of the date of issuance.

LEAD -BASED PAINT RRP RULES
Ordinary renovation and maintenance activities can create dust that contains lead. Contractors who perform
renovation, repairs, and painting jobs in pre -1978 housing and child- occupied facilities must, before beginning
work, provide owners, tenants, and child -care facilities with a copy of EPA's lead hazard information pamphlet
Renovate Right: Important Lead Hazard information for Families, Child Care Providers, and Schools.
Contractors must document compliance with this requirement. After April 22, 2010, federal law will require you
to be certified and to use lead -safe work practices. Georgia Environmental Protection Division Lead -Based
Paint and Asbestos Program (404) 363 -7026.
Projects must be done by a Certified Lead Renovation Firm AND a Certified Renovator
When disturbing lead -based painted or coated surfaces or components more than 6 ft2 per interior
room or 20 ft2 of exterior surfaces AND all window replacements and partial demolitions of any size.

Asbestos /Environmental Notification to Georgia EPD for
Projects Involving Demolition, Wrecking, or Renovation
The undersigned hereby acknowledges that the issuance of this permit does not in any way grant permission
to the owner, owner's representative, or permit holder to proceed with demolition, wrecking, or renovation of a
structure prior to the filing of any required ten (10) day "Project Notification for Asbestos Renovation
Encapsulation or Demolition" form in accordance with the Georgia Asbestos Rules. The Georgia
Environmental Protection Division administers the rules. In most cases, the rules require both the owner and
the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by
an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before
renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed
demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the
building. Further guidance for regulatory compliance and contact telephone numbers are provided by the
brochures entitled Asbestos & Renovation and Asbestos and Demolition. Other environmental issues such
as asbestos removal techniques, lead abatement, ground contamination, or unusual site conditions may have
EPD regulations that could affect the project.

BMPs
While BMP deficiencies are not necessarily the fault of the owner or his agent, BMPs are their responsibility.
Two areas of deficiencies are in the most basic and common BMPs; Co — Construction Exit and Sd1 —
Sediment Barrier. Correct installation information can be found in the Field Manual for Erosion and Sediment
Control in Georgia, Fourth Edition 2002, Georgia Soil and Water Conservation Commission;

Problems with the Co is not limited to the installation, but to material. The stone will be a representation of
1.5 " -3.5" stone or larger.
Type A sediment barriers have been installed where Type C is required and shown on the permit drawings.
Where two rows are called for they will be installed with a separation that allows for the first one to fail (fall
over) without impacting the second one. The complete assembly and installation must be compliant; steel or
wood posts, post spacing, Type C or A.

RE: Revocable License - Modification of an existing Private Residence Dock Facility, Horse Pen Creek,
Chatham County, Georgia (GPS- 32.007673 °N /- 80.849032 °W)
Dear Mr. Zapp & Ms. Kelley:
In response to your application for a Department of the Army Programmatic General Permit PGP0083
(960009050) for a private, single - family residence, recreational dock facility, please find enclosed a
fully executed Revocable License for the modification and maintenance of a private, single - family
residence, recreational dock facility. This license serves as authorization to utilize state -owned tidal
water bottoms for your dock facility as per the location, dimensions, and configuration depicted in your
application for such license.
Your modified facility will consist of reconstructing a 3' x 15' walkway to the existing 16' x 7' fixed
deck. The dock will be constructed approximately 60' from the extended property line to the left and
approximately 10', from the extended property line to the right of the structure. No portion of this
facility will extend into the waterway. The waterway is approximately 5' at mean low water. There is
no cover existing or proposed for this facility.
Any change in the use, location, dirniensions, or configuration of the approved facility, without prior
notification and approval from this office, could result in the revocation of this license and in required
removal of the facility. Based on the information and plans submitted with your application, it has been
determined that the dock facility, if constructed as proposed, will comply with the terms and
requirements outlined in the PGP0083.
No construction materials or debris may be placed, disposed of or stored in jurisdictional areas.
Any incidental impacts associated with this project must be rectified by fully restoring areas to their
pre - construction topographic and vegetative states.
All activities performed under this permit must meet the conditions stated in the enclosed copy of the
PGP0083. This dock facility must be constructed precisely to the approved location dimension and
contiruration as depicted in the drawings and description provided If corridors exist, please
ensure that this dock facility is constructed in such a fashion that the entire structure fits between the
extended property lines. The facility, for which these authorizations are issued, shall not be used at any
time for business or commercial purposes. Prohibited uses include, but are not limited to, liveaboards,
leasing of the permitted dock space; docking a commercial fishing vessel of any type; and utilization of
the dock facility in any tour or charter boat fishing activities. Pursuant to the Official Code of Georgia
Annotated § 12- 5- 295(7), the structure for which this permit is issued is intended for the single parcel as

recreational use. Deviation from this use, including by dual and multi- family or community use, will
result in the immediate revocation of the license and in required removal of the entire facility from state -
owned property, and possible criminal and civil penalties as provided by law. This agreement is not
transferable with ownership interest in the upland property. These authorizations do not relieve you
from obtaining any other required federal, state, or local permits. You must obtain a county or
municipal building permit prior to beginning construction of the dock facility.
The tidal water bottoms and marshlands of coastal Georgia are public trust lands controlled by the state,
except over such lands where a validated Crown or State Grant exists. This license authorizes use of
lands assumed to be under the control of the state. You may proceed with construction of this project
with the knowledge and understanding that this license agreement could be rendered invalid should
another person produce a validated Crown Grant or State Grant.

I am making application for a permit with the U.S. Department of the Army, Corps of Engineers, Savannah District. I
understand that the issuance of such a permit will not relieve me of the obligation to obtain authorization from the State of Georgia since
the proposed project would constitute an encroachment on the beds of tidewaters which are State -owned property. Accordingly, I hereby
request that I be granted a revocable license from the State of Georgia. Attached hereto and made a part of this request is a copy of the
plans and description of the project that will be the subject of such a license. I certify that all information submitted is true and correct to
the best of my knowledge and understand that willful misrepresentation or falsification is punishable by law.
I understand that if permission from the State is granted, it will be a revocable license and will not constitute a license coupled
with an interest. I acknowledge that this revocable license does not resolve any actual or potential disputes regarding the ownership of, or

The State of Georgia hereby grants you a revocable license not coupled with an interest as provided in your request. This area may now
or in the future be utilized by boats employing power drawn nets under the provisions for commercial or sport bait shrimping. In its
occupancy and use of the premises, licensee shall not discriminate against any person on the basis of race, gender, color, national origin,
religion, age, or disability. This covenant by licensee may be enforced by termination of this license, by injunction, and by any other
remedy available at law to the Department. The project proposed for this license must be completed within 3 years of the date of issuance
of the license and must be maintained in serviceable condition. Otherwise, action will be initiated to revoke this license and all structure
must be removed immediately at the licensee's expense.

Construction of docks, walkways, etc.; liability insurance. This subsection is intended to supplement and
expressly not repeal existing provisions of Tybee's Code of Ordinances relating to permits required for
construction, relating to building permits, regarding wetlands protection, regarding beach dune or
vegetation disturbance.
All those individuals engaged in the construction or repairs of docks, walkways, marinas or marine
facilities, or any other structure on or over coastal marshlands as defined in O.C.G.A. § 12 -5- 282(3)
shall, prior to the commencement of any such construction, preparation or work provide to the City of
Tybee Island evidence of liability insurance and /or bonds and /or letters of credit specifically covering
environmental and other damages. Such applicant shall also provide for coverage and /or bonds and /or
letters of credit in the nature of a performance bond requiring the completion of the work if it is not
performed in accordance with the anticipated completion schedule filed with the city and shall further
include the cost of removal of any equipment, debris or materials of any nature not removed by the
dockbuilder. When a bond or letter of credit is used for the purposes described herein such bond or
letter of credit shall be issued to the benefit of either the City of Tybee Island or the owner of the
property depending upon the circumstances and the building official of the city shall be authorized to
determine to whom the bond or letter of credit should be payable.
The amount of insurance, bond, or letter of credit shall be based on the nature, scope and cost of the
anticipated work and shall take into consideration the potential consequences of spills, removal of
equipment, debris or materials and other risk and shall be in such amount as is set by the building
official of the city or his designee.
Including but not limited to fuel spills, fires, submersions of equipment and building supplies, etc., all
dockbuilders shall be required to report any accidents, casualties or events which occur in connection
with activities provided for in this subsection and which are likely to cause damage or which may cause
damage to property, persons, the environment or coastal marshlands and in no event shall the
responsible party wait more than two hours after the occurrence of such event, casualty or occurrence.
Any violation of this subsection shall subject the offender to punishment under section 5 -160.

Sec. 5 -010. Permits required for construction.
The following is a list of permits needed for construction of a building or structure or the movement of a building
or structure that may be needed for any type of land development in the city.
(A) Building permit. All building permits seeking to expand the exterior of any existing structure or seeking to
construct any new structure must be accompanied by a valid survey depicting, among other things, the
present location of all property lines and structures then on the property.
(B) Relocation permit. A relocation permit is required any time a manufactured home, trailer, out building,
house or structure is moved from any location to any lot or parcel within the city limits. Buildings used for
the purpose of storage only with no need for electricity or plumbing are exempt from this requirement.
Electrical, mechanical and plumbing permits are included within this permit.
(C) Sign permit. Prior to the erection of a sign for either on- premises or off - premises advertising, the zoning
administrator must first issue a permit in accordance with the sign regulations set forth in article 6.
Permits are required for both temporary signs as well as permanent signs.
(D) Demolition permit. Prior to destruction of a building, structure, or sign, a demolition permit is needed.
Such permit may be attained from the city code enforcement department.
(E) Electrical permit. An electrical permit is needed before installing any electrical wiring or fixtures. This
permit is not needed if a relocation permit or building permit has already been issued on the structure.
(F) Plumbing permit. A plumbing permit is needed whenever a plumber installs a new plumbing system in
an existing structure. This permit is not needed if a relocation permit or building permit has already been
issued on the structure.
(G) Mechanical permit. A mechanical permit is needed before a licensed installer may install any mechanical
device such as a heating and /or cooling system for air or water. This permit is not needed if a relocation
permit or building permit has already been issued on the structure.
(H) Land clearing, disturbance or excavation permit. Regardless of the use of the land, a permit is required
prior to the clearing of trees, topsoil, or water on any parcel of land in the city. A drainage plan with
supporting calculations is required prior to the issuance of any permit for all new construction. The plan
and calculations shall be prepared by a professional engineer licensed by the state to provide such
services. Furthermore, there shall be no excavation or addition of soil, trees, or water until all proper
permits are obtained. This permit is not needed if a relocation permit or building permit has already been
issued on the structure.
(1) Tree removal. A tree removal permit is required if a person intends to remove either a significant tree or
any number of trees that will result in a tree density of less than required. This permit is required
regardless of any other permits obtained.
(J) Reserved.
(K) Prohibit placing materials in the marshlands. Notwithstanding any other provision of any ordinance or
regulation to the contrary, no permit for building, land clearing, land filling or for the addition of materials
to any area of " marsh," "marshlands," "coastal marshlands," "vegetated marshlands," or isolated
freshwater wetlands as such terms are now or hereafter defined by the Coastal Marshlands Protection
Act of 1970 (O.C.G.A. § 12 -5 -280 et seq.) or to any area of isolated freshwater wetlands shall be issued
in the absence of a variance granted by the mayor and council subject to the strict application hereof
pursuant to section 5 -090. In addition to those provisions of article V, chapter 22 of the City Code which
may be applicable, it shall be unlawful for any person or entity to place in marsh, marshland, or coastal
marshlands as so defined any material whatsoever, in the absence of a permit issued pursuant to a
variance properly granted.

Construction of docks, walkways, etc.; liability insurance. This subsection is intended to supplement and
expressly not repeal existing provisions of Tybee's Code of Ordinances relating to permits required for
construction, relating to building permits, regarding wetlands protection, regarding beach dune or
vegetation disturbance.
All those individuals engaged in the construction or repairs of docks, walkways, marinas or marine
facilities, or any other structure on or over coastal marshlands as defined in O.C.G.A. § 12 -5- 282(3)
shall, prior to the commencement of any such construction, preparation or work provide to the City of
Tybee Island evidence of liability insurance and /or bonds and /or letters of credit specifically covering
environmental and other damages. Such applicant shall also provide for coverage and /or bonds and /or
letters of credit in the nature of a performance bond requiring the completion of the work if it is not
performed in accordance with the anticipated completion schedule filed with the city and shall further
include the cost of removal of any equipment, debris or materials of any nature not removed by the
dockbuilder. When a bond or letter of credit is used for the purposes described herein such bond or
letter of credit shall be issued to the benefit of either the City of Tybee Island or the owner of the
property depending upon the circumstances and the building official of the city shall be authorized to
determine to whom the bond or letter of credit should be payable.
The amount of insurance, bond, or letter of credit shall be based on the nature, scope and cost of the
anticipated work and shall take into consideration the potential consequences of spills, removal of
equipment, debris or materials and other risk and shall be in such amount as is set by the building
official of the city or his designee.
Including but not limited to fuel spills, fires, submersions of equipment and building supplies, etc., all
dockbuilders shall be required to report any accidents, casualties or events which occur in connection
with activities provided for in this subsection and which are likely to cause damage or which may cause
damage to property, persons, the environment or coastal marshlands and in no event shall the
responsible party wait more than two hours after the occurrence of such event, casualty or occurrence.
Any violation of this subsection shall subject the offender to punishment under section 5 -160.

Sec. 5 -010. Permits required for construction.
The following is a list of permits needed for construction of a building or structure or the movement of a building
or structure that may be needed for any type of land development in the city.

Building permit. All building permits seeking to expand the exterior of any existing structure or seeking to
construct any new structure must be accompanied by a valid survey depicting, among other things, the
present location of all property lines and structures then on the property.
Relocation permit. A relocation permit is required any time a manufactured home, trailer, out building,
house or structure is moved from any location to any lot or parcel within the city limits. Buildings used for
the purpose of storage only with no need for electricity or plumbing are exempt from this requirement.
Electrical, mechanical and plumbing permits are included within this permit.
Sign permit. Prior to the erection of a sign for either on- premises or off - premises advertising, the zoning
administrator must first issue a permit in accordance with the sign regulations set forth in article 6.
Permits are required for both temporary signs as well as permanent signs.
Demolition permit. Prior to destruction of a building, structure, or sign, a demolition permit is needed.
Such permit may be attained from the city code enforcement department.
Electrical permit. An electrical permit is needed before installing any electrical wiring or fixtures. This
permit is not needed if a relocation permit or building permit has already been issued on the structure.
Plumbing permit. A plumbing permit is needed whenever a plumber installs a new plumbing system in
an existing structure. This permit is not needed if a relocation permit or building permit has already been
issued on the structure.
Mechanical permit. A mechanical permit is needed before a licensed installer may install any mechanical
device such as a heating and /or cooling system for air or water. This permit is not needed if a relocation
permit or building permit has already been issued on the structure.
Land clearing, disturbance or excavation permit. Regardless of the use of the land, a permit is required
prior to the clearing of trees, topsoil, or water on any parcel of land in the city. A drainage plan with
supporting calculations is required prior to the issuance of any permit for all new construction. The plan
and calculations shall be prepared by a professional engineer licensed by the state to provide such
services. Furthermore, there shall be no excavation or addition of soil, trees, or water until all proper
permits are obtained. This permit is not needed if a relocation permit or building permit has already been
issued on the structure.
Tree removal. A tree removal permit is required if a person intends to remove either a significant tree or
any number of trees that will result in a tree density of less than required. This permit is required
regardless of any other permits obtained.
Reserved.
Prohibit placing materials in the marshlands. Notwithstanding any other provision of any ordinance or
regulation to the contrary, no permit for building, land clearing, land filling or for the addition of materials
to any area of " marsh," "marshlands," "coastal marshlands," "vegetated marshlands," or isolated
freshwater wetlands as such terms are now or hereafter defined by the Coastal Marshlands Protection
Act of 1970 (O.C.G.A. § 12 -5 -280 et seq.) or to any area of isolated freshwater wetlands shall be issued
in the absence of a variance granted by the mayor and council subject to the strict application hereof
pursuant to section 5 -090. In addition to those provisions of article V, chapter 22 of the City Code which
may be applicable, it shall be unlawful for any person or entity to place in marsh, marshland, or coastal
marshlands as so defined any material whatsoever, in the absence of a permit issued pursuant to a
variance properly granted.
