MANAGEMENT SERVICES DEPARTMENT MEMORANDUM DATE: April 7, 2020 TO: The Honorable City Council FROM: Bryan Cook, City Manager By: Bryan Ariizumi, Public Safety Supervisor SUBJECT: AD OPTION OF RESOLUTION NO. 20-5461, AUTHORIZING AGENTS TO EXECUTE FOR AND ON BEHALF OF THE CITY OF TEMPLE CITY FOR THE PURPOSE OF OBTAINING STATE AND FEDERAL DISASTER FINANCIAL ASSISTANCE RECOMMENDATION: The City Council is requested to adopt Resolution No. 20-5461 (Attachment “A”), authorizing agents to execute for on behalf of the City of Temple City for the purpose of obtaining state and federal disaster financial assistance. BACKGROUND: 1. On March 4, 2020, the Health Officer of Los Angeles County declared a local health emergency regarding COVID-19 and the Los Angeles County Board of Supervisors concurrently proclaimed the existence of a local emergency for the County of Los Angeles. 2. On March 4, 2020, Governor Newsom of the State of California declared a State of Emergency in response to the COVID-19 (Corona Virus Disease 19). 3. On March 13, 2020, the President of the United States declared a national state of emergency regarding COVID-19. 4. On March 13, 2020, the City Council adopted Resolution No. 20-5457, proclaiming the existence of a local emergency regarding COVID-19. City Council April 7, 2020 Page 2 of 2 ANALYSIS : The Federal Emergency Management Agency (FEMA) and the California Governor’s Office of Emergency Services (Cal OES) provide local jurisdictions with specific guidelines for the management and administration of disaster assistance programs that detail activities and expenditures that are allowable under their respective programs established by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988 (Stafford Act) and the California Disaster Assistance Act (CDAA). To participate in the disaster assistance programs, the City Council must adopt the Cal OES Form 130 “Designation of Applicant’s Agent Resolution for Non-State Agencies” (Attachment “B”), to designate Authorized Agents to apply for and seek reimbursement of disaster assistance funds from the Federal and State governments. Approval of the designation Resolution will allow the City to seek reimbursement for eligible disaster-related expenditures under the FEMA and Cal OES disaster assistance programs. This action will allow the City to participate fully in present and future Federal and State disaster assistance programs. CITY STRATEGIC GOALS: Designation of authorized agents to apply and seek reimbursement of disaster assistance funds from the Federal and State governments will further the City’s Strategic Goals of Good Governance and Public Health and Safety. FISCAL IMPACT : Adoption of this resolution will not have an impact on the Fiscal Year (FY) 2019-20 City Budget. ATTACHMENTS: A. Resolution No. 20-5461 B. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE THAT CITY MANAGER , OR ADMINISTRATIVE SERVICES DIRECTOR , OR ACCOUNTANT , OR PUBLIC SAFETY SUPERVISOR is hereby authorized to execute for and on behalf of the named applicant , City of Temple City, a public entity established under the laws of the State of California, this application and to file it with the California Governor’s Office of Emergency Services for the purpose of obtaining certain federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance Act. THAT the City of Temple City. a public entity established under the laws of the State of California here by authorizes its agent(s) to provide to the California Governor’s Office of Emergency Services for all matters pertaining to such state disaster assistance the assurances and agreements required. This is a universal resolution and is effective for all open and futures disasters up to three (3) years following the date of approval.
