4A) CARES Act Funding to Cities
MANAGEMENT SERVICES DEPARTMENT MEMORANDUM DATE: June 4, 2020 TO: The Honorable City Council FROM: Bryan Cook, City Manager By: Brian Haworth, Assistant to the City Manager SUBJECT: REQUEST TO INCREASE CARES ACT FUNDING TO CITIES RECOMMENDATION: The City Council is requested to approve the attached letter requesting an increase in the state’s CARES Act funding to cities. ANALYSIS: 1. On March 27, 2020, President Trump signed the CARES Act into law. Among other things, the $2 trillion coronavirus (COVID-19) relief bill provided one-time payments to individuals, strengthened unemployment insurance, boosted healthcare funding, and prevented layoffs through business loans and grants. 2. On April 7, 2020, the Los Angeles Urban County received nearly $14 million in CARES Act funding. Distributed as CDBG funds, these one-time monies are to be used by cities to enhance or create CDBG programs that help mitigate the financial impacts of COVID-19. The City of Temple City received just over $123,000, which may soon be earmarked for low-income rental assistance and small business emergency relief. 3. On May 14, 2020, Governor Newsom released a revised state budget proposal for fiscal year 2020-21, allocating $450 million of the state’s CARES Act funding (totaling $9.5 billion) to cities. These monies are intended for COVID-19 expenditures incurred between March 1 and December 30, 2020; eligible uses include services pertaining to homelessness, public health and public safety. The funds cannot be used by cities to backfill lost revenues or to serve as a state match for drawing down other federal funds, e.g. FEMA reimbursements. City Council June 4, 2020 Page 2 of 2 4. On May 21, 2020, the Assembly Budget Subcommittee No. 4 announced that the state’s CARES Act funding to cities would be allocated based on population: $225 million to seven cities with populations between 300,000 and 500,000; and $225 million to cities with populations under 300,000 via the county. As detailed in Attachment “A”, there is a wide allocation disparity between the seven cities sharing the $225 million and the remaining cities (including Temple City) sharing the other $225 million. Funding is minimal to California’s smallest municipalities. 5. On June 2, 2020, the League of California Cities released an alternative proposal that increases the state’s CARES Act funding (to cities) to $500 million and establishes a floor allocation of $50,000 per jurisdiction. These recommendations provide cities with additional funding to cover COVID-19 expenses, and ensure that funding is distributed fairly at a meaningful amount (Attachment “B”). As it pertains to the City of Temple City, this proposal would boost the state’s initial allocation by $80,000 for a total of $449,412. 6. The state legislature is deliberating the Governor’s revised budget proposal, ahead of the June 15 constitutional deadline for the legislature to pass the state budget. Approval of the requested letter will support the League’s alternative proposal and provide formal record of Council’s request to Senator Rubio and Assemblymember Chau as they consider passage of the state budget (Attachment “C”). CITY STRATEGIC GOAL: The recommended action aligns with the strategic goal of good governance. FISCAL IMPACT: The requested letter presents no budgetary impact; however, it may influence deliberations as officials consider adoption of the state budget. If the League’s alternative proposal is successful, the City’s funding allocation would increase from $369,321 to $449,412. ATTACHMENTS: A. Since the beginning of the COVID-19 outbreak, cities have been coordinating across jurisdictional lines, enacting emergency measures to slow the spread of the coronavirus pandemic, taking action to protect individuals and small businesses, and incurring significant unplanned expenses to protect public health and the economy. These actions have saved lives and serve as a model for the country. But, these actions come at a cost. The City of Temple City appreciates the May Revision allocation of $450 million of the state’s CARES Act funding to cover COVID-19-related costs by cities. However, under the current formula our city will only receive $369,321. This is not nearly enough to provide adequate levels of personal protective equipment to front line workers, to disinfect and sanitize public facilities, or to take other needed public health actions to begin the process of reopening. We are calling on the Legislature and the Governor to increase the state’s CARES Act funding allocation to cities to $500 million and establish a floor allocation of $50,000 per city. Cities need additional funding and a minimum allocation to ensure that CARES Act funding is distributed fairly and equitably, and is a meaningful amount for all jurisdictions. CARES Act funding will help our city recover from this pandemic faster, and reopen our communities without furthering city revenue shortfalls and threatening core city services. It is important to note that CARES Act funding is only for COVID-19-related expenses. Our city still needs direct state and federal funding to address the devastating impact stay- at-home orders have had on our budget and local economy. In total, cities around the state are facing a nearly $7 billion revenue shortfall over the next two years, and this shortfall grows by billions of dollars as modified stay-at-home orders extend into the summer months and beyond.
