SUBJECT: REQUEST TO CONTINUE A PUBLIC HEARING FOR THE APPEAL OF
PLANNING CASE PL 19-1668 AT 5637 SANTA ANITA AVENUE
RECOMMENDATION:
The City Council is requested to consider a request from the appellant to continue the
public hearing for Planning Case PL 19-1668 to February 16, 2020.
BACKGROUND:
1. On July 3, 2018, the Community Preservation staff opened a case at 5637 Santa
Anita Avenue regarding changes to changeable copy sign.
2. On January 11, 2019, planning case PL 19-1668 was opened. The application was
for a conditional use permit to increase the height of an existing electronic
changeable copy sign from 12 feet to 16 feet.
3. On June 9, 2020, the Planning Commission approved the application subject to
conditions of approval.
4. On June 22, 2020, the applicant appealed the Planning Commission’s decision to
the City Council.
5. On August 25, 2020, the appellant requested the City Council continue the public
hearing to February 2021 (see Attachment A).

ANALYSIS:
The Temple City Municipal Code (Section 9-1C-5.G.6.a) requires an appeal to be
scheduled before the appeal body within 90 days of the appeal being filed. Given the
appeal date, in this case, the last day to hold the public hearing would be September 15,
2020. However, the appellant has requested that the item be continued until February of
2021, stating that he needs more time. Staff is prepared to move forward and conduct
the hearing and appeal proceedings as there is no technical or regulatory reason to have
the proceedings beyond the 90-day timeline. Due to this item requiring a public hearing,
staff cannot address the substance of the case; but only the request to continue the
hearing.
CITY STRATEGIC GOALS:
The recommended action fulfills the strategic goals of good governance by being
responsive to the appellant’s request.
FISCAL IMPACT:
There is no fiscal impact to granting a request to continue an item.
