I'he To�,m Caunci_1 of the Town of Wellsburg, Iowa, met in special
session. in the Council Chambers in the 'Down Hall.. at 1+t00 P.°7. on the
abcve date. There were present Luke G. Groninga, Mayor, in the chair,
and the foLl owing named Council.rrian :
Neil O'Kones, Lester Huisman,
Alfred i'ieyer, ivla�ro T jaden

The Counci..l oonsidered and discussed the nature. of the problems
of other sewage treatment plant sites and the condemnation award as
determined. by the District Court Jury of Grundy County on I.2ay .�:Z ,
1g58.
Co���nci_lman Lester Huisman introduced the follo�,iing Resolution and
moved its adoption., Councilman Neil O�Kones seconded the motion to
adopt. `I`he roil was cal:l_ed and the vote was as follows, to®wit:

RESOLU'I'ION xCCEPTING CONDEMNATION AWARD OF
DISTRICT COURT JURY M�'�Y �,�-, 195�
IN THE MATTER OF A.��NDA IV-t�;SSEN, PLAINTIFF

'I'OWN OF WELLSBURG, DEFEND�iIV'T .
'u�HEREAS, on the _�� day of May, 195�, the damages award in the
case entitled Amanda iveessen, Plaintiff -vs- Town of 'vellsburg, De-
fendant, before the District Court of the State of Iowa, in and for
Grundy County, was affixed by said Jury in the sum of �6232.00, and
uVHEREAS, said award, in view of considerations of additi.or,al out-
lay in expense by the adoption of another site, does appear in the best
interests of the 'Town of d�lellsburg irA completing said improvement of a
sewage treatment plant and outfall. sewer, and
wHE;HEAS, said sum must be, as provided by la:�r, deposited with the
Clerk of the District Court of Grundy County, Iowa, together wwLth such
later Court costs and reasonable attorneys fees of the Plaintiff as may
be determined by the Court and oertified to by the said Clerk:
NOW, THEHEFURE, BE I'I' RESOLVED BY THE TOGuIti` COliNCIU Or THE TOWN
OP' WELLSBURG, IOWA:
That this Council hereby determines that i.t is necessary and
advisea.ble to accept the proposed. sewage treatment plant site and
easements leading thereto and then°efrom as proposed in the plans
and specifications of the sewage treatment plant and outfall sewer
improvement for the 'Town of Wellsburg, as such proposed sites and
easements do appear on the plat of the Engir_eer, Hoi.lis Ryken,
filed with the Sheriff of Grundy County, Iowa, in condemnation
proceedings initially commenced in his office, and to perfect such
acceptance it is further determined that this Council hereby accept
the damages award of the District Court Jury in the case of Amanda
Neessen -vs- Town of Wellsburg in the District Court of the :Mate
of Iowa, in and for Grundy County, in the sum of �6232.00®
13e it further resolved that the }Mayor of the Town of 'uellsburg
and the City Clerk, John. E, Riekena, be and they are hereby autho-
rized and empower°ed to deliver a `Town voucher, drawn upon the sani-
tation fuzld, to the District Clerk of Grundy County, Iowa, in
acceptance of tk;e award and that said ��iayor and Clerk shall upon
certification of the Clerk of the District Court, cause to be paid
thereunto the Court costs and reasonable attorneys fees for the
Pla.intiffss attorneys as determined by the Court and all as certi-
fied to said Town Officials by the saa.d Clerk and do such things
as are necessary, proper and incident to the completion of the
acquisition of said lands and easements under the Town°s power
r:minent Domain .
