HomeMy Public PortalAbout20090105REGULAR COUNCIL MEETING JANUARY 5, 2009 1 CALL TO ORDER The Regular Council Meeting of January 5, 2009, was convened at 6:00 P.M. by Mayor John Landwehr. ROLL CALL The following Council Members were present for the roll call: Present: Carroll, Harvey, Klindt, Koon, Layton, Medin, Penfold, Randolph, and Scrivner Absent: Ferguson A quorum was declared present. MINUTES AND REPORTS RECEIVED AND FILED Mayor John Landwehr stated the following minutes have been received and are on file for review in the City Clerk's office, and thanked all members who serve for the time they dedicate to making our City better. CVB Reports and Minutes (available for review in City Clerk's office) CAMPO Board of Directors, October 15, 2008 Finance Committee, November 14, 2008 Public Safety Committee, October 31, 2008 Plumbing Board of Review & Examiners, July 2, 2008 Public Works & Planning Committee, November 20 and December 10, 2008 Housing Authority Board of Commissioners, November 18, 2008 Mayor Landwehr thanked citizens who serve on the various City boards and commissions for their time and effort to make Jefferson City a better place to live. COUNCIL LIAISON REPORTS REGULAR COUNCIL MEETING JANUARY 5, 2009 2 Administration Committee - Councilman Ron Medin reported that the next meeting will be Wednesday, January 7 at 8:00 A.M. Finance Committee - Councilman Rich Koon stated the next meeting will be held on Friday, January 16 immediately following the 12:00 P.M. Brown Bag work session. Public Safety Committee - Councilman Mike Harvey announced that the next meeting will be held Friday, January 30, immediately following the Brown Bag work session. Public Works & Planning Committee - Councilman Jim Penfold announced that the next meeting will be held on Thursday, January 22 at 7:45 A.M. Ad Hoc Committees, if any: Councilwoman Cindy Layton announced that a meeting of the Ad Hoc Committee on the Arts will be held on Thursday, January 8 at 12:00 P.M., and a public forum will be held on Thursday evening, January 15 from 5:00 to 6:30 P.M. ANNOUNCEMENTS OF OTHER UPCOMING MEETINGS AND EVENTS Mayor John Landwehr reminded citizens that an election will be held on Tuesday, February 2 to decide the issue of extending the lodgings tax in Jefferson City. Mayor John Landwehr announced that unless someone can think of any issues to be discussed at a January 12 work session, that work session would not be held. APPOINTMENTS BY THE MAYOR MayorJohn Landwehr recommended the following appointments to the Council for approval: Jefferson City Police Department: 1. Collier Nichols - appointment /promotion to Police Officer Following introduction of nominee Mr. Nichols by Police Chief Roger Schroeder, a motion was made by Councilman Ron Medin for approval of the appointment as presented, seconded by Councilman Dan Klindt, and approved unanimously. PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS REGULAR COUNCIL MEETING JANUARY 5, 2009 3 Mayor John Landwehr stated that he would like to add to this part of the agenda Cole County Presiding Commissioner Marc Ellinger to address the Council tonight. Marc Ellinger, Cole County Commission, made comments regarding issues of mutual interest to the City of Jefferson and Cole County. He invited the Mayor or City Council Members to reciprocate by attending and speaking at meetings of the Cole County Commission. City Administrator Steve Rasmussen made a presentation on the status of the new bus transfer station on Miller Street. He indicated that will go into effect on Tuesday, January 20 at 6:45 A.M. and that the City would be doing everything possible to get the word out about the changes that will result from the new transfer station. Mr. Eric Seaman, Waste Water Division Director, made a presentation regarding the status of sewer projects utilizing sewer bond revenues. Following his presentation, he answered questions asked by the Council. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Mr. Ted Walz, 2155 S. Belfry Court, Hartsburg, stated he would be willing to answer any questions about Bill 2008 -113 (vacation of general utility easement), and thanked the City staff for their help in putting together this issue to bring before the Council. No questions were asked. CONSENT AGENDA The following items were presented to the Council for their approval by Consent: (a) Minutes of 2008 -2009 Budget Committee meetings (b) Minutes of December 12, December 15, and December 22, 2008 City Council Meetings A motion was made by Councilman Jim Penfold for approval of the Consent Agenda as presented, seconded by Councilman Dan Klindt, and approved unanimously. BILLS INTRODUCED Bill 2008 -113, sponsored by Councilman Penfold, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES IN LOT 150 OF LANDWEHR REGULAR COUNCIL MEETING JANUARY 5, 2009 4 HILLS. Bill 2008 -114, sponsored by Councilman Penfold, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A RIGHT -OF -WAY ON A PORTION OF STRONG -THARP SUBDIVISION. Bill 2008 -115, sponsored by Councilman Koon, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN PROPERTY TO BE SURPLUS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. Bill 2008 -116, sponsored by Councilman Randolph, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE BUDGET OF THE CITY OF JEFFERSON, MISSOURI BY APPROPRIATING ADDITIONAL FUNDS WITHIN THE CAPITAL IMPROVEMENTS SALES TAX "D" AND "E" FUNDS. Bill 2008 -117, sponsored by Councilman Penfold, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING THE NAME OF CITY VIEW DRIVE TO MCCARTY STREET. Bill 2008 -118, sponsored by Councilman Medin, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401, (STREETS AND HIGHWAYS), SCHEDULE (J), (PARKING PROHIBITED), SUBPARAGRAPH (A), OF THE CODE OF THE CITY OF JEFFERSON, BY THE ADDITION OF A PORTION OF ADAMS STREET. Bill 2008 -119, sponsored by Councilman Koon, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 28 (FOOD SERVICE), OF THE CODE OF THE CITY OF JEFFERSON, BY AMENDING SECTION 28 -2 PERTAINING TO FEES. Mayor John Landwehr asked staff to give the Council a list of non - profit organizations and businesses who were added as a result of this ordinance. A motion was made REGULAR COUNCIL MEETING JANUARY 5, 2009 7 by Councilman Jim Penfold to accept the Substitute Bill 2008 -110 previously distributed to the Council, seconded by Councilwoman Anita Randolph, and approved unanimously. Bill 2008 -110 was then passed, as substituted, by the following roll -call vote as Ordinance 14459: Aye: Carroll, Harvey, Klindt, Koon, Layton, Medin, Penfold, Randolph, and Scrivner Nay: None Bill 2008 -111, sponsored by Councilman Koon, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE 2008 -2009 BUDGET OF THE CITY OF JEFFERSON, MISSOURI BY APPROPRIATING ADDITIONAL FUNDS WITHIN THE GENERAL FUND. RESOLUTIONS There were no Resolutions brought before the Council at this time. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS Mr. Leonard Steinman, 2217 W. Edgewood, made statements urging the City to make the state legislators feel welcome in the City. Councilman Jim Penfold asked Mr. Steinman for specific examples of how the City could accomplish that. COUNCIL AND STAFF DISCUSSION OF PRESENTATION TOPICS REGULAR COUNCIL MEETING JANUARY 5, 2009 8 No comments were made at this time.
