HomeMy Public PortalAbout1993-11-09 Workshop MeetingCOUNCIL MINUTES WORKSHOP MEETING - NOVEMBER 9, 1993 A workshop meeting of the Bal Harbour Village Council was held on Tuesday, November 9, 1993, in the Conference Room at Bal Harbour Village Hall. The meeting was called to order at 4:08 p.m. by Mayor Spiegel. The roll was called and those present were: Also present: Mayor Estelle Spiegel Assistant Mayor Matthew B. Blank Councilman James E. Boggess Councilman Andrew R. Hirschl Carole Sherouse Morris, Village Manager Jeanette Horton, Village Clerk Steve Helfman, Deputy Village Attorney George Desharnais, Jr., Building Inspector Dr. Thomas Kelsey, Craig Smith & Associates Richard Olsen, President Civic Association Absent: Councilman Sol M. Taplin As a quorum was determined to be present, the meeting commenced. Mayor Spiegel stated the purpose of this meeting is to review zoning issues. 2. Review of Zoning Issues: Mrs. Morris introduced Dr. Kelsey, of Craig Smith & Associates. She then proceeded to distribute to the Council members a summary, which capitalizes the key issues, what the Code currently says and her areas of concerns. She reviewed the areas of concern which are Roof/Building Height; Model Buildings; Height and Setback requirements in the PC Private Club District; Building Heights RM1- RM5. Mrs. Morris then displayed pictures that should help clarify some of the issues. She further explained the Code Sections on each of the above mentioned areas of concern. Discussion ensued as to density, crown of road versus flood elevation, uniform signage for the apartments in the residential section. Councilman Hirschl stated it is very important for the Council to regulate the density. He further suggested that by recessing the second story, it would reduce the bulk of the house. Assistant Mayor Blank questioned when was the last time zoning was changed. Mrs. Morris replied around 1986. At which time the regulation on height was enacted, as well as allowing for pools in setbacks. Workshop Meeting 11/09/93 1 Councilman Boggess stated his concerns about buildings in RM5 district, which could be a potential slum area. He further stated the Village should watch this area. Dr. Kelsey suggested the Council consider allowing a different type of building in this area, such as Villas or Townhouses, if a developer purchases these buildings. Which would offer an alterative to the apartment buildings. Mr. Helfman suggested make the existing buildings non conforming. Therefore, at some point they could not rehabilitate the buildings without bringing them into compliance with the new Code. Discussion ensued as to having the Buildings front on Park Drive. Mr. Helfman stated the Cities of Coral Gables and Key Biscayne are dealing with the same height and bulk issues. He continued to explain how the City of Coral Gables is dealing with the bulk issue. Which is, if the home is above a certain elevation, they treat it as floor area, as though there was second story. Mr. Helfman stated that the first issue is height, a uniform provision on height, where it is to be measured from and a total mass on height. The next issue is setbacks, which is being addressed because of the massing issue. He further suggested that the Council request the Architectural Review Board to study these issues, and make a recommendation. It was the consensus of the Council that Mrs. Morris write the members of the Architectural Review Board for their recommendations. As well as Mrs. Morris and Mr. Desharnais work with Dr. Kelsey and Mr. Helfmnan, and then make their recommendations to the Council. Mrs. Morris suggested scheduling another workshop to discuss the recommendations of the Architectural Review Board and of Dr. Kelsey and the staff. Before having a night meeting, which is required for Zoning issues. The Council agreed to hold another workshop before having the night meetings. Councilman Hirschl stated he has received several inquires in regards to the Private Club. He continued to state the concerns are that a new club will be built, at the yacht club site, which is in the residential section. That there are currently no provisions in the Village Code because of the Private Club zoning. Mr. Olsen explained a proposal has been received from Mr. Kovens to purchase the property on the Ocean Front. But, the Civic Association has not accepted his proposal at this time. He further explained if the property, on the Ocean Front, is sold it would have to be rezoned. He continued to explain that on Thursday he has a meeting with the Lawyers, who represent the Civic Association, to review the items the Association wants included in the contract. Councilman Hirschl stated he feels some provision should be in the Code relating to the Private Club Zoning in the Workshop Meeting 11/09/03 residential district. 3. Other Business: None 4. Adjourn: There being no further discussion, a motion was offered by Councilman Boggess and seconded by Assistant Mayor Blank to adjourn.
