On June 8 1993 the Plannin Commission a � , , g pproved the request to develop sixteen (16) units at the subject site. 4 2. On June 12, 1993, the Planning Cominission decision of approval , was appealed by Henry L. Sims to the City Council. � ,_ 3. On July 20, 1993, the City Council heard the matter and made ; a recommendation to have the project developer redesign the project and present the revised plans to the community group i in opposition. Upon review and consent from the community group the project was to go back to the Planning Commission I for action. 4. On November 9,' 1993, the applicant submitted a written ', correspondence requesting an extension of the project to the 1 Planning Commission meeting of December 9, 1993 to allow time ; for redesign of the project. � 5. On November 9, 1993, the Planning Commission approved the � continuation of the project at the request of the applicant. ! CONCLUSION• � � Prior to the last Planning Commission meeting, staff was ' recommending withdrawal of the project due to the developer's ' , failure to ineet with the community and submit revised project , - plans. The applicant requested that this case be continued to this ' meeting. Staff spoke with Mr. Kesseler on Monday, December 6, � . 1993. He indicated that he had talked to the neighbors and they � were still opposed to the project. WHEREAS, the Lynwood Planning Commission, pursuant to law, ` conducted a public hearing on the subject application; and WHEREAS, the Planning Commission, considered all pertinent testimony offered at the public hearing; and WHEREAS, the Community Development Director has determined that the proposal will not have a negative effect on the�, environment, and has therefore declared a Negative Declaration : for the project; and WHEREAS, a Conditional Use Permit is required for development of a new commercial use in area designated as;., Commercial under the General Plan and in a CB-1 (Planned Business) zone. The applicant is required to submit a landscape plan drawn' by a licensed landscape architect to the satisfaction of the" Director of Community Development prior to any building; permit being issued, . , 26. The amount of landscaping required shall be provided and' consistent with the proposed landscape plan. . � 27.. All plantings� are to be kept in a healthy and growing condition. An� automatic sprinkler or irrigation system shall be provided' and maintained in working condition. 29. Where vehicles are to be parked immediately adjacent to a� , public or private street or alley, a decorative masonry wall " a maximum of thirty-six inches in height measured from the�' finished surface of the parking area, shall be provided.• There must be minimum landscaping to screen wall from street, view and accessibility. 30. Prior to the installation or construction.of any fence or1 masonry wall within any zone, the property owner shall� obtain a permit and submit the following information to the� Planning Division of the Community Development Department: •, i 3 � � I` . i i ' a. A simple�lot plan showing the lo�tion of fence or ; . masonry wall in relation to the property lines, heights,i proposed materials, and openings or gates to provide access.for vehicles and pedestrians. { b. For masonry walls a buiiding permit shall be applied for; upon approval of the plot plan described above. All" masonry walls of any height shall meet the requirements, for masonry construction as defined in Chapter 24 of the� Uniform Building Code. A fee based on the valuation of� the proposed construction.shall be paid to the Building' Division. 31. All fences or masonry walls shall be required to maintain� adequate pedestrian access for the purpose of safety and, convenience. A thirty-six (36) inch or three foot clearr gate or opening shall be provided to all enclosures for', pedestrian and wheelchair access. Pedestrian and,vehicular� access shall be provided. ; ; 32. AT1 fences or masonry walls shall be required to be; installed with a ffnished, esthetically pleasing side facing, out toward adjacent properties or the public right-of-way to the satisfaction of the Director of Community Development or: , his/her designee. ; 33. ' 34. The applicant must provide a trash enclosure consistent with, the materials and color of the main building(s), with gates,' on the site of the subject property. The trash enclosure; shall be built as per Building and Safety Division: i standards. , ' j ' PARKING i 1 35. Parking shall be a minimum of 54 stalls for customer parking� � only. { 36. Each off-street parking space shall not be less than twenty; ' {20) feet in length and nine (9) feet in width, exclusive of; access driveways or aisles, except as noted below: a. Any standard parking space that is immediately adjacent; to a wall, structural column, light standards, or i similar obstruction on one or both of its longer sides� or in an enclosed space shall be at least ten (10') feet. in width and twenty (20') feet in length. , b. At a minimum two parking spaces designed for the� handicapped shall be provided. These spaces may be� provided as follows: , 1. Dimensions. The minimum dimensions of each' automobile parking stall for the handicapped shall' be not less than fourteen (14) feet in width byj, twenty (20) feet in lenqth. Prior to the installation, display, enlarging, modifying,� relocating or changing of signs, a permit must be obtained' from the Department of Community Development, Planning° Division. i 39. Central heating, cooling ventilation equipment, swimming� pool pumps and heaters and all other mechanical devices shall be screened from public view. Such equipment shall be; screened from surrounding properties and streets and' operated so that they do not disturb the peace, quiet and " comfort of neighboring residents, in accordance with the� City's Noise Ordinance. All means of access to the; referenced equipment shall be designed and installed so as' to prevent access to unauthorized persons and shall be; approved by the Building and Safety Division. � , 40. All security fences, grills, etc. shall be architecturally' compatible with the design of the subject and adjacent� I buildings. In addition, no security fences, grills, etc. I shall be installed without the prior written approval of the� i Director of Community Development and required building' � permits as per plan. 41. Pursuant to Ordinance No. 1319 to insure variation.and � I esthetically pleasing color schemes for buildings in' Redevelopment Areas along major City streets, i.e. Long. Beach Blvd., Atlantic Ave., Martin Luther King Jr. Blvd., or' Imperial Highway, the exterior of any building or structure� - shall be painted with a color within a range of colors approved by.the Community Development Director. ; 42. The existing property shall be cleaned and maintained in a; sanitary condition pending construction and shall be' maintained in a neat and orderly manner at all times. Failure to comply may result in revocation of the: Conditional Use Permit. , 43. Entity will eliminate graffiti from the structures, fences; and any accessory building on a daily basis.
